Following a public hearing Council approved your application with the following conditions: l. that the 9' diameter satellite dish antenna sh311 be installed at the location identified in the plans submitted to the Planning Department and date stamped September 30, 1986; 2. that the maximum height of the dish as installed shall not exceed 6' above the existing grade and the antenna shall be fixed at a maximum height of 6'; 3. that the dish shall be painted or finished in a dark color (green or bl�ck), ;,e r,cnreflecti�e an� the nonreflective surface sha]i�e maintained by the property owner; 4. that the dish shall be enclosed with a 6' maximum wooden fence with a locked gate; 5. that the city shall be notified in the event of the future removal of this dish and the property owner shall be responsible for removing any concrete slab, replacing any excavated area and replacing the removed and disturbed landscaping; 6. that this use permit shall be reviewed fo� compliance with its conditions in 18 months time; and 7. that there shall be only one satellite dish antenna to serve all the apartments in the Northpark developmen.t.' The meeting was called to order at 7:30 p.m. by Mayor Gloria H. Barton. PLEDGE OF ALLEGIANCE TO THE FLAG Led by City Attorney Jerome F. Coleman. ROLL CALL COUNCILMEMBERS PRESENT: AMSTRUP, BARTON, LEMBI, MANGINI, PAGLIARO GOUNCILMEMBERS ABSENT: NONE MINUTES Minutes of the Regular Meeting of November 3, 1986 were approved vith an addition by Councilman Amstrup to page S line 47, "Councilman Amstrup urQed passaQe so that staff could proceed with appraisals on lots and develop more parkinQ for the citv." Minutes of the Study Meeting of November 19, 1986 were approved. Mayor Barton welcomed Councilman Mangini back after his recent illness and complimented him on,his service as Mayor during the past year. PRESENTATION BY SUPERINTENDENT OF HIGH SCHOOL DISTRICT San Mateo Union High School District Superintendent Nicholas Gennaro reviewed the uses of lottery funds in the district. He relayed his appreciation of the city's help during the past year, particularly the assistance of the Recreation Department in the music program. WEBELO TROOP PRESENT Mayor Barton introduced a local Webelo Troop of cub scouts who vere present to meet the Mayor and observe the council meeting. PUBLIC HEARING — REVIEW OF PERMIT FOR DISH ANTENNA AT NORTHPARR APARTMENTS. 1080 CAROLAN AVENUE — RESOLUTION 135-86 APPROVING S City Planner reviewed her memo of November 6 in which she recommended council hold a public hearing and take action. Ed Reese of Premier Channel, representing Northpark Apartments, is requesting a special permit to install a nine foot dish antenna with a height not to exceed six beet above grade in a landscaped area enclosed by buildings 7, 8, 9 and 10 of the Northpark Apartment complex. A special permit is required for all dish antennas in residential zones, this same code limits antenna height to six feet and requires it be installed in the rear yard. Planning Commission approved the permit with conditions at its meeting of November 10, 1986. Mayor Barton opened the public hearing. The applicant Ed Reese, 821 Malcolm, noted this location is secluded and is not visible from the road. Councilman Pagliaro inquired if tenants had been notified of this proposed installation. Reese said notices had been posted at all buildings and that the only calls they had received were inquiries of when the installation would he completed as tenants are anxious to have this service. . Councilman Lembi noted he had called this item up for review and his main concern was visibility; he wondered if the antenna could be � located in a parking area; Reese reviewed that they had investigated several locations and interference was too great at other locations. Mayor Barton closed the public hearing. 1 ` ,';r-_;,, , . . • �' M I""��'tis Councilman Amstrup had no objection to this antenna but expressed concern about future installation of a number of antenna to serve this complex and suggested another condition; that Nnrthpark be limited to one antenna for the entire complex. Councilman Lembi moved to uphold the Planning Commission approval with conditions and with the additional condition suggested by Councilman Amstrup by adoption of RESOLUTION 135-86. Seconded by Councilman Mangini, carried unanimously 5-0 by roll call vote. PUBLIC HEARING — REVIEW AND DENIAL OF A SPECIAL PERMIT FOR FLOWER STAND AT BURLINGAME AVENUE TRAIN STATION — 290 CALIFORNIA D IVE City Planner reviewed her memo of November 24 in which sh recommended ouncil hold a public hearing and take action. Ivan Vil a II is equesting a special permit to locate a temporary flow stand at the B rlingame Avenue Train Station. The stand would be �ut up weekdays fi'�om 11 a.m. to 6 p.m. (Saturday 10 a.m. to 6 p.m.) on the California Drive side of the station and would be manned by one employee except bet" een the hours of 4 p.m. to 6 p.m, when there w�ould be two emp�,oyees. It would be closed on Sundays. TheiPlanning Commission appr'oved a permit with conditions hy a 4-3 vote,,�t its meeting of November 10, 1986. City Planner discussed the /existing drainage on site and the need to determine if it is adequ��'te to meet the Building Inspec'zor's condition. /' / Mayor Barton opened the public hearing. Ivan Villa II stated that he is agreeabl,e� to all the conditions, but thinks that the existing drainage is adequate and no more is required. Councilman ,Mangini questioned the need and location of any signs, and whether the stand could be located on the other side of the station. Villa responded to questions, noting that signs are necessary because of the many paths that communters;take from the train and that the sun on the other s•�de of the station;would wilt the flowers. He currently has a similar b�usiness at the M�'�lbrae Train Station. Mayor Bar�on clo`s.ed the publi¢' hearing. Councilman Amstrup�`urged deg�ial; he noted that thousands of citizens worked to restore this his�'oric site and this use along with the others it would attract a�`e not consistent with the historic character of the station. , / Councilman Pagliaro un��stood Councilman Amstrup�s concerns but did not think a small floWer�stand would hurt the site. ,� Mayor Barton was co cerned a�out the merchants along Burlingame Avenue who pay high rents for their �stablishments and have previously complained about ese portabl� businesses which use the public streets and side alks and do no�R, pay rents. Council has denied other flower stands ac�rd also a hot dog``�Stand using public property. Councilman Am�"�rup moved to reverse�the Planning Commission approval and deny the�permit because it would�impact this historic site. Mayor Barton secon=ded noting council has de�yied other businesses of this type on pu��iic property. , '� Councilm�.m Mangini thought this business �ight have an unfair advanta$e, but that he had nothing against�lowers. AMUSEMENT PERMIT FOR BOBBY MC GEE'S, AT THE EMB SSY SUITES HOTEL, 150 ANZA BOULEVARD City Attorney reviewed his memo of November 21 in w't�ich he recommended council grant an amusement permit to Bobby McGee's f� a restaurant lounge with recorded music for dancing. He suggested`m,ne condition, that any valet parking be free of charge. � A representative of Bobby McGee's was present and assured council that valet parking would be free and that they have arranged for use of .� :�, . .. 2
