1475 Alvarado Avenue and Robert S. and Rosemary 69aligore,
1461 �lvarado Avenue (Burlingame Hills) for annexation to the City
of Burlingame ceas submitted to Council at the meeting of ��tay 3,1971,
and action deferred to the present meeting at the request of the
City Attorney.
The City Attorney reported he conferrecl with Mr. Kavanaugh in regard
to wi�hclrawal of the two properties from the Burlingame Fiills
Sewer P�laintenance District (condition imposed by LAFCO in its reso-
lution approving the annexation), suggesting that he submit a written
request to the Board of Supervisors for e�sclusion of the properties
from tiie District effective simultaneously ��ith City of Burlingame's
annexation.
The City Attorney, pointing out there is a three-week interval before
Council's next meeting, suggested that the required ordinance be
introduced at this time; in the meantime, if Mr. Kavanaugh encounters
difficulty at the county level, he will assist him.
ORDINANCE N0. 935 "APPROVING ANPIEXATION TO THE CITY OF BURLINGAME OF
U�IINFi�1SITED CONTIGUOUS T�RRITORY DESIGNATED "LANDS OF WALIGOP.E AND

4. GVHEATLEY/OLIVER RE : LAIQDS OF BURLING�'�IE SHORE LAND COMPANY
Mayor �lristrup ac;:nowledged receipt of a letter datec� PZay 13, 1971,
from Leon M. Wheatley/Richard B. Oliver, 220 California Street,
Palo Alto, signed by Mr. Oliver, submitting copies of preliminary
landscape plan in connection with the proposed development of
Burlingamc Shore Land Company acreage, generally bounded by
Bayshore I3oulevard, Cadillac tVay and Carolan Avenue. Additionally,
the communication reported that a draft of the proposed zoning
contract requested by Council was deliverec� to the City Attorney.
The communication requested Council's favorable consideration to
the �ubmitted drawings and draft of contract.
The City Attorney acknowledged receipt of the draft, stated that
copies were circulated to planning, engineering and fire departments
for comment but, because of the time element, it was not possible
to prepare an agreement in form for transmittal to Council with
the agenua material.
Mayor Amstrup recognized :dr. Oliver w�io explained that he had
attempted to meet the deadline for Council to review the material
prior to the present meeting. Mr. Oliver stated that, at this point,
time is of the essence and that further delay may create serious
problzms in arranging financing.
Councilman Martin objected to`taking an action on the agreement
without prior study.
In response to Councilman riartin's query concerning development of
the parcel designated for restaurant use (Parcel B), Mr. Oliver

AGREENt�NT MODIFICATION TO CIiANGE LANDSCAPE PLAN FOR NORTHPARK
APARTMENTS AT CADILLAC WAY AND BETWEEN CAROLAN AVENi1B AND
ROLLINS ROAD. APPLICANT L. BURLINGAME, INC.
The Northpark Apartment Development is to be constructed in
accordance with the plans approved by the City Council. It
was an agreement between the City Council and the developer;
or, in effect, contract zoning.
Subsequently the Developer found it desirable to revise
the landscaping plans; to change the sidewalk pattern for
better interior circulation, and to improve access to the pool
areas. They also wished to increase the size of the two swim-
ming pools. Minor modifications were made to the parking space
layout without reducing the number of uncovered spaces. The
old landscape plan has been improved and L. Burlingame, Inc.
requested approval of these modifications.
At the Planning Commission hearing on December 27, the
changecl landscape plan and Agreement modifications were con-
sidered, including the Fire Chief's reQuest for 10 foot cicar-
ance over routes to be used by fire equipment and adequate
turning radii. Additional landscaping is to be provided
adjacent to the City Pumping Station and the developer's
architect will explore providing a pathway to the box culvert
entrance for interim access under Bayshore Freeway to
Bayside Park.
Initial landscaping plans rec{uired approval by the
Planning Commission. This action is an advisory recommendation
to the City Council.

Z'he City Planner stated �that he had made a study of the bl�ck from
E1 Carairio to Center Avenue which showed that eight Iots were occupied
by two or more units, legal or illegal, and five lots had single
family dwellings on them,one of which �•�as the applicants' building
site. He commented that there was a definite pattern of multi.-family
dwellings on this block, and that the proposal is in accord with the
General Plan which designates this block as low-density multiple.
He commented that the General Plan is a valid document, and if this
is a proper building, bu�.lt according to code with two stories and
garages in the rear, he had no objection.
Commis�ioner Norberg mentioned that he thought the plan for addition
•of the garages could be improved, but �hat he had no other objections.
It was brought aut that the garages are no�v 18 x 20 in accord with
code requirements. -
Commiss�ioners Jacobs, Taylor and Mink had no comment on the plans.
� Commissioner Kindig wanted verbal confirmation that the two trees
in front would stay, and questioned the front and rear setbacks
and height of the building. He was informed that the front is 17'.
the back, 15', and the height of the building was 21'.
Commissioner Cistulli was al.so interested in preserving the trees.
Z'he applicants stated that this would be done, as well as the one
in the rear if it developed that it was on the property of the
applicant. .
Chairman Sine commented on the fence to the east of the property
between 15�14 and 1516 stating that was illegal in that it has a
plastic extension on top of the 6' fence, and askec3 the applicants'
intention with it. They stated that it would be removed if it were
on their property.
Commissioner Jacobs introduced a motion that the variance be granted
to Albar Construction to build a 5-unit ap�rtment building at 1516
Ivewlands complying as near as possible to the elevation shown on the
plans and preserving the two trees in front, plus the one tree in the
rear if possible. Commissioner Mink seconded the m�tion, and it
passed unanimously on roll call vote. _
Chairman Sine informed the applicants that the variance would become
effective on riay 4, 1971 if not appealed to the City CQuncil. '�'.�.�

Chairman Sine ann�unced a public hearing on the above application ior
variance, and plans were distributed to Commission members. A letter
accompanying the application indicated that application would also
be made at a later date for�construction of a restaurant at a site
adjacent to�the apartment area, and �lso that the applicants believed
the project would be an attractive addition to the city and would be
instrumental in improving business in the Broadway area.
Both Mr. Wheatley and Mr. Oliver were present.

He informed the Commission that since the last planning meeting
they had an additional request that an existing structure on the
proper�y be allowed to remain and be r.efurbished for use as a storage
area and possibly a rental office during the rental period. 'I'his is
noY� a one story office building and its rear wall is on the property lin-e
next to a gas station.
Mr. Oliver went on to say that there would be a total of twelve
buildings on the site - ten apartment buildings,.the existing structure,
and the recreation building which does no� contain apartments. The
variance is for the coristruction of these buildings on one parcel of
iand since financing of twelve separate buildings on twelve separate
lots would be extremely difficult: A box culvert carrying storm
�drainage traverses the property. The present overhead utilities are
to be put underground. .
The City Planner reviewec3 the backgrounc� for this variance application.
Z'he property is presently zoned R-4, apartment, and the proposed use
accords with that classification. However, the code also provides that
not more than one residential building may be constructed on a single
parcel and the proposal includes ten such buildings on a single site
in addition to the accessory buildings mentioned. This is similar to
a"planned unit development" but we have nq such provision in ou�r
zoning code. For this reason, the only approach of the applicant is to
request << variance .
He has reviewed the plans. The land coverage, number of car spaces,
distance between buildings and gener�l layout are satisfactory. Since
all residential structures have frontag� on a street, the £ire department
has few objections but will require that through access must be made
av�ilable by proper paving over the box culvert. Z'hey may have other
internal r�quirements. �
He said that there are 510 units but that this number should pose a
�.esser traffic problem than other p�ssible uses of the property. �
An apartment building has f��irly consi�tent traffic while a com.mercial
building would create peak hour^. He would strongly object to an
office building, etc. He inquirea if nliver had solved his problems
with the Fire Chief. " . �
Oliver replied he thought this had been done. They•have assured the
Chief they �vould place some tyne of mateYial over the. culv^rt to
support fire equipment. They are agreeable to �Ln enunciator system
on Carolan Avenue, also a pull box, and the necessary fire entrances.
The City Engineer commentPd that the box culvert easem�nt is 20',
the width of the culvert is 18' and the depth around 6' - that it should
be a.dequate to carry a storrn se�aer. To a question about acces5 in
event of stoppage, he stated that there is an access point on Bayshore
and another access p�int.
Mr. Oliv�r inentioned that there at least t�vo manholes in the culvert.
They plan �o pick up the inv:�rts that are there for drainage of their
property.

Chaixman Sine asked for. comments from the audience in favor of this
variance. Mr. Ferd Gebhard, of 1212 Rollins Road, appeared and
voiced his approval, saying that this was the only logical d�velopment
to be put on the site, since a shopping center would damage Broadway
Avenue busin�ss, and the apartment builaings being between the railroad.

Mrs. Lillian Triplett o£ 900 Toyon Drive then came forth �nd stated
she thoroughly approved, that it wauld be a desirable location because
of its proximity to the shopping district. She mentioned the aesthetic
improvement that will result, although she felt that in the construction
of the apartments adequate protection should be made against noise.
Mrs. Mary Crockett, 1032 Toyon Drive, also indicated her approval.
Chairman Sine then requested comments from the audience against this

opinions regarding density. � ,
Commissioner Jacobs felt that the plan was very good and there would
be no density problem. Commissioner Taylor agreed, stating that it
was the best organized project presented in several years.
Commissioner :�iink felt that the real problem is the relationship o£
open space to aensity, and the plan showed gooc3 work in that the
maximu.m amount of open space had been maintained. Co►nmissioner
Kindig asked for a review of the parking ratio, and he was informed
by Mr. Oliver that it was 1% to 1; that there were 510 covered spaces
directly under the buildings, which meant that there was sufficient
parking in each building for all occupants. There ��ere an addi tional
258 parking spaces on the site. Commissioner Kindig felt that the
density feature was all right.
Commissioner Cistulli commented that he approved highly of the .?roject,
ana was happy with the density. He hoped that this project �vould �
go through as it woula be an asset to Broad���ay.
Chairman Sine had other questions, one of which �vas the question of
fencing around the �oin 1 andgthere5is ahspecificls�immingapoolthat
the code requires fenc g,

The Chairman then inquired about children. Mr. Oliver said they had
nat definitel.y decided. Commissioner Cistulli suggested that possibly
chi].dren of up to age 4 or 5 might be .con�'r7ered. Mr. Oliver commen�ed
that maybe one building might be given over to young families with
young children. �his was a possibi�.ty. In reply to the Chairman's
question as to start and finish of the project, Mr. Oliver stated that
they plan to start August 17 and allow 18 months for completion, the
contractor moving From building to building.
Chairman Sine mentioned that the existing traffic problem would be
eompounded. He �vondered if the company wou�d be amenable, if the
traffic grew too heavy on Carolan, to assuming their fair share of a
traffic Iight. Mr. Oliver stated�that he could not say until he knew
what sort of cost would be necessary and commented on the ten access
driveways. Chairman Sine replied that regardless of this, all
driveways bunch up into tcvo exits. Upon being asked for an opinion,
the City Attorney stated that the property could be liable for the lights
to the extent that it contributed to the traffic problem.
Commissioner Mi,nk moved that the variance be granted subject to
modification or to cancellation or termination o� existing contract
with Burlingame Shore Land Company, that location of buildings and
number of unit^ be in accordance with plans,submitted and that the
project be built generally in accv rdance with these plans, that the
project be in accordance with all building and fire codes of the ci�y
together with such interior fire protection devices required by the
fire department, and that landscaping plans be submitt�d and approved
before occupancy of the buildings. Com�nis�ioner Jacobs seconded the
motion, and it carried unanirnously on roll call vote.
