Variance application of Wheatley-Oliver
The application for a variance submitted by Wheatley-Oliver to
construct an apartment complex of 10 separate apartment buildings
on a single site was considered at a public hearing by the Planning
Commission at the regular meeting of April 26. The vote on a
motion to approve was unanimous. The motion follows:
That the variance be granted subject to modification or
cancellation or termination of existing contract with
Burlingame Shore Land Company;
that location of buildings and number of units be in
accordance with plans submitted and that the project be
built generally in accordance with these plans;
that project be in accordance with all building and fire
codes of the eity together with such interior fire pro-
tection devices as are required by the fire department;
that landscaping plans be submitted and approved before
occupancy of the buildings.
This matter differs from the usual Planning Commission actions in
that the existence of the contract with the city on the use of the
property makes the question of the approval of a substitute a
Council decision automatically. With the action of the Commission
completed, the Council should now consider the proposal on its
merits. If approved, the Council should take such legal steps as
are necessary to implement it. -

Re: Burlingame Shore Land
Gentlemen:
On MDnday, April 26, 1971, the Burlingame City Planning
Commission unanimously approved our request f'or a variance
to permit the construction of ten (10) apartment buildings,
plus a recreation building, and ermittin the retention of
the existin masonar structure pursuan o he p ans pre-
sente o them and to the City Council. As I understand the
procedure, their action will automatically be on the agenda
at your meeting on May 3, 1971 for your ratification or
appeal i£ any. Needless to say we request your ratification
of the granting of this variance.
We would also request, i£ procedurally correct, that
the necessary action be taken at this meeting �o modify
the existing contract on the Burlingame Shore Land,~or
set the ma.chinery in motion to�so modify the contract so
that we may hopefully proceed with the project.
If additional information or review is necessary on
the part of the council, we would further request that time
be allotted at the study session of the council on May 12,
1971, to hopefully resolve any remaining problems.
