Date: 09.5.02 Marga et Monroe, City Planner �� RESOLUTION APPROVING CATEGORICAL EXEMPTION AND A PARKING VARIANCE TO PROVIDE A SINGLE UNCOVERED PARKING SPACE IN THE FRONT SETBACK RESOLUTION 80-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a�arking variance for a single uncovered parkin�space in the front setback at 1545 Carol Avenue, zoned R-1, Gordon and Billi Cline, propertv owners, APN: 028-303-100; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on August 26, 2002, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED b)� th�s Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15301 - Class 1(c)(1) — minor alterations of existing private facilities involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. 2. Said parking variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for the parking variance are as set forth in the minutes and recording of said meeting. 3. It is fizrther directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. �- 1..�,�. �.,' . I, Ralph Osterling, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26"' day of Au�ust, 2002, by the following vote: AYES: COMMISSIONERS: Auran, Bojues, Keele, Keighran, Osterling and Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: Brownrigg IIIIIIIIII IIIIIIII IIIII IIII I IIII�I�I��II 20022 019425;3 EXHIBIT "A" Conditions of approval for parking variance 1545 CAROL AVENUE effective September 3, 2002 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped August 9, 2002, sheet 1; with a paved parking area 9' x 20' in the ftont setback accessed by a curb cut on Carol Avenue; 2. that the parking variance for parking within the front setback shall expire in five years (September 3, 2007)and that the curb cut shall be removed and replaced by a curb and gutter that meet city requirements at the expense of the owner when the parking variance expires; in 5 years time the property owner may apply to the Planning Commission for an extension for this variance, s� }.�n� as the application for extension is made prior to the termination of this variance action ( September 3, 2002); 3. that the conditions of the City Engineer's August 12, 2002, memos shall be met; and 4. that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame.
