Dear Mr. and Mrs. Cline,
Since there was no appeal to or suspension by the City Council, the August 26, 2002 Planning
Commission approval of your parking variance became effective September 3, 2002. This
application was to allow for a single uncovered parking space in the front setback at 1545 Carol
Avenue, zoned R-1.
The August 26, 2002 minutes of the Planning Commission state your application was approved with
the following conditions:
1) that the project shall be built as shown on the plans submitted t�-: �.�� �'lanning Department
date stamped August 9, 2002, sheet 1; with a paved parking area 9' x 20' in the front setback
accessed by a curb cut on Carol Avenue;
2) that the parking variance for parking within the front setback shall expire in five years
(September 3, 2007)and that the curb cut shall be removed and replaced by a curb and gutter
that meet city requirements at the expense of the owner when the parking variance expires;
in 5 years time the property owner may apply to the Planning Commission for an extension
for this variance, so long as the application for extension is made prior to the termination of
this variance action ( September 3, 2002);
3) that the conditions of the City Engineer's August 12, 2002, memos shall be met; and
4) that the project shall meet all the requirements of the California Building Code and California
Fire Code, 1998 edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is
made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.
