Appeal by Nick Gener of Planning Commission denial of Variance
Application for property improvements at i457/59 E1 Camino Real

Appiicant proposed to enlarge the studio apartment at the rear by enclosing three
garage spaces and convert them to two bedrooms and a bath, construct a carport to cover
three parking spaces and provide an open parking space in front of the duplex.
The Planning Commission denied the Variance Application 4-2, Commissioners Y.indig and
Taylor dissenting, even though Mr. Gener agreed to do the following:
1. Provide a new 12'x30' paved parking area in the front yard behind the required
20' setback from E1 Camino Rea7.
2. Construct a 6 inch curb along the driveway to prohibit parking in the front area.
3. Landscape the front area between sidewalk and front of existing building.
4. Give a 10 foot wide pedestrian easement to the City.
5. Reimburse City for the cost to construct a curb, gutter and sidewalk across
the width of the property.
6. Enclose two covered parking spaces and retain the garage next to the northerly
property line.
(This modified plan provides four covered parking spaces.)
7. Obtain a building permit and reconstruct improvements to conform with building code.
Applicant's �nodified proposal is identical with the commitments made at the Planning
Commission hearing. Staff recommends that Council give close consideration to approval
of this appeal.

Assistant City Planner Yost reviewed the application, noting the property is nonconfoi7nin�

Mr. Gener stated it lvould be built as one unit. There being no further discussion,

The follo�•ling people spoke in opposition to the aoplication. Plilan Dulik, 1449 Qalboa
Oppos i ti On by Avenue, was concerned about the overloadi ng of sewer faci 1 i ties. Cliai rman Tayl or
advised him this proposal docs not call for any addit-ional units, but an addition
residents t0 parking to an existing unit. Oakley Y.ephart, 1480 High�•�ay Road, stated his concern is the
on Highway Road parking and felt it was not fair to tenants not to provide parking. He noted that
, High4�ay Road is utilized for off-street parking and residents on that str-eet liave
to get a perniit for overnight guests. Anna Alexander, 1504 Hi;hway Road, agreed
with Mr. Kephart, stating there is alread� an overloading of the street. Alexander
Hanson, 1516 High�•�ay Road, did not feel the 20 foot yard,should be used as a parking
lot and stated this t�ould compound the problein of more cars on the street. Secretary
Sine read a letter received February 27, 1978 from Thomas and Julia Prager> 1454 6alboa
Avenue, which opposed the proposal because of the parking.
Mr. Gener responded to the concerns> stating he could not ans�•�er the sewer problem

being no further public input or discussion, the hearing was closed.
Conmissioner Kindi9 and Mr. Yost discussed the property line distances briefly; t•ir. Yost
stated there would be 32 feet to the face of the building from the front pro��erty

VARIANCES
NOTICE IS HEREBY GIVFN that Monday, the 2�th day of February, 1978 , at the
hour of 7:30 P.M., in ihe City Hall Council Chambers , 501 Primrose Road,
Burlinqame, California the Planning Commission of the City of Qurlingame will
conduct a public hearing on the application to permit the conversion of three
covered parking spaces to additional apartment living area and the construction of
a carport with less than the required number of parking spaces, at 1457/59 E1 Camino
Real in the R-3 District, bv Nick Gener with Mrs. T. Gener, owner.
At the time of the hearing all persons ini:erested will be heard.
For further particulars reference is made to the Planning Department.
