Attached is a staff report from Bob Hill, Building Inspector, in
reference to the above construction. Also, attached is a copy of the building
inspection record, the original plans as submitted in February 1974, and the
revised plans as submitted approximately April 1, 1975. I recommend this
report be submitted to the Commission for consideration at their convenience.
The Commission may want to consider re-evaluating the definition
of a story as it appears in Code Section 25.08.600. I would be most willing
to discuss this at their convenience.

- Notes on inspections of garage construction, permit U1595, at 2301
Easton Drive for Charles L. Terry.
During framing inspection, owner wanted to know if he could raise
the roof 4�' from plan. This would enlarge the attic space and since there
was no access to attic space shown on plans and no plumbing into this space,
I had no reason to think the owner had any intention of using the space.
There being no code violation, that I could see, I informed the owner to go
ahead with the work�and bring in the change of plans. The revised plans re-
ceived recently delineate the space "Attic Space Storage".
Definitions which should be considered�
Zoning Code 25:08.600 Story: A story is that portion of any
building included between the surface of any floor and the surface of the
next floor above it, and if there be no floor above it, then the space
between such floor and the ceiling next above it.
Uniform Building Code, Section 420 Story: Story is that portion of
a building included between the upper surface of any floor and the upper sur-
face of the floor next above, except that the topmost story shall be that por-
tion of a building included between the upper surface of the topmost floor and
the ceiling or roof above. If the finished floor level directly above a base-
ment, cellar or unused underfloor space is more than 6 feet above grade as de-
fined herein for more than 50 per cent of the total perimeter or is more than
12 feet above grade as defined herein at any point, such basement, cellar or
unused underfloor space shall be considered as a story.
The �bove definitions do not specify attic space as a story and we
have never considered attic areas to be a second story.
We do not consider the storage area use above a permitted accessory
building to be a violation of 25.28.030 (3) Zoning Code which states rumpus
rooms or hobby rooms shall not be constructed above or as a second story to
accessory buildings.
We consider height limitation of a permitted accessory building to
� be included in 25.28.070 Zoning Code which limits height to 2� stories or 30
feet with exceptions. �

SUBJECT: Variance from front setback requirements in R-1 District
at 2301 Easton Drive by Charles Terry
Last night the Planning Commission approved the Terry variance by a
vote of 4-3. A neighboring property owner and a gentleman living on
Columbus Avenue spoke in opposition at this continued hearing. They
inferred the aczion of the Commission would be appealed to the City
Council. In view of an impending appeal I wish to provide copies of
our staff report to the Planning Commission and letters from.neighbors
affected by the variance.
The Planning Department was placed in an embarrassing position by
exercising consistent zoning code enforcement. We, too, would like to
bail out building inspection but since we're all part of the City Ha11
family we need to accept errors by others. I wish it had not happened
and I sincer_ely hope steps will be taken to see that it does not happen
again. The April 13 l.etter from the Hesses asked, "Udhy didn't the
proper city officials check and double check the inspection report more
closely . . .?"
The C�mmission requested that the staff prepare a report about the two-
stoxy g�arage previously built by Mr. Terry. Building plans were submitted
to•the Planr�ing De�artment as supportive data for the variance application.
We found that the plans showed a one-story garage five feet from the
property line. Mr. Terry built a two-story garage five feet from the
property line o�n verbal approval from a building inspector. A two-story
building at that location should have a six foot side yard.

Mr. Paul Hesse, 2307 Easton Drive, said that he had thought the
public hearing was closed and had therefore written a.letter which he
requested be read. Chairman Mink summarized his letter as stating
that since Mr. Terry's project was s� advanced, the variance should be
granted, but that the City should be more careful in the fu�ure. Mr.
Hesse agreed that was the gist of his communic�tion and questioned what
a property holder is supposed to do when he had submitted p2ans to the
City �nr3 attempted to comply with regulations.

Gentlemen:
I have submitted a�n application for a, vzri�,nce for relief from the building line
restriction, namely the front set ba,ck.
On 2-14-74, I made a�pplication to the building depa�rtment for � permit for an
addition to my house. I pzid �11 of the fees including a. plzn checking fee. The
plans were duly inspected znd some notations were mzde �th regard to certzin
building regul�tions. The pla,n� after being thoroughly checked were returned to me
a.nd a permit was issued. There was no notation relative to the set back requirement.
Before starting, a site inspection took place on 1 15-75 and then on �-?.].-75 I called
for an inspection of the forms prior to pouring concrete. A building inspector came
to the building site, inspected the forms and approved them. I poured my foundztion
footings znd commenced building. My building is partially framed with �,11 the floor
in, walls and some rafters. The r�ins have prohibited me from continuing further.
On Thursday March 13, 1975 building inspector Mr. C�.lwell advised me that my building
was in excess of t.he property set back limit. At th�at time Mr. John Yost was with
him. We then measured and confir�ned Mr. Calwells �assertion. I must admit the building
zt one corner does protrude over the set back limit. I ha�sten to repeat gentlemen
this is only zt one sma,ll corn�r.
The property line on Easton Drive is a,t �,n extreme a,ngle, zpproxima,tely 44 degrees.
On the other side of my property the house is set back approximately 5� feet which
is well back from the property line. If one were to take zn average the set back would
be zpproximately 28 feet from the property line.
It is unfortunate that I�m in this position of requesting a variznce when n�y
building is well along in construction. I do not wish to cast any �spersions but
I must point out in rr�y own beh�.lf� I took zll of the steps of Lhe process necessary
to obtain a permit, called for zll my i.nspections zt the proper time and felt I had full
zpproval. I ha�d no intent to build my addition without meeting all of the local code
requirements. I a.m emb�r�.ssed to be in this position tod�,y.
I understznd that on March 24th I will be able to appear before you and speak in
person regarding this matter. I look forward to this time and I will be prepared
w:ith further documentation in an effort to convince you of my needs for a variznce.

this 5 Z' encroachmer.t is magnif_ied by tre fa�^t that Easton Drive is at
an angle to the �roperty, and stated he did not understand ho�� the Buiid�_::c;
Department could have made so large �n error. He considered the ordinance
should be enforced, since there was not sufficier.t conc�ition �or a
variance, and that the Building Depart�rient had imposed on Nir. Terry.

given ].6'. The Chief Building Inspector thought both parties had
misca].culateci, and suggested consiaeration of the City Planner's idea
of cutting off one corner of the pr_oposed kitchen. This would c�orrect

Chairman Mink quesi:ioned if to his knaivledge construction was i�
conformance with the plans. The Chief Building Inspector rep�.ied tl~�a�
plans had not been followed in the r.ear garage, which had been plar_nEd
as one story, but riow exists as one stary and a storage area above. :�e
stated this �.s not a code violation as far as height is cancerned. �-Ie
adde� his ir�spector had noted th�s change from plan, but the man did
not recall if he had asked P�ir. Terry to come to the Buil.ding Depa7�'��ent

garuge �resented no cocle violation, noting t.he garage cou.ld be built on
the propert� line in th� rear 30% o� th2 lot with a one-hour wall. It

the Chief Building Inspector confirmed that i:here was no written rec�r�
from his inspector. Mr. T�rry stated that an inspector had visz.ted
the site upon his invitation ta irspect the.framing of the garage since
he did not want to exceed 'che h�ight limit. He wanted to make a char_ge
ii�. the plans, raising the roof a few feet to allow for more head room
ii� the stcrage area. The inspector had assur�d him he �aas not vici�tinr
the height limit, but had not invited him to the Buzlding DepartmL::'. �o
clzange tY?e �lans there. Mr. Terr.y reaffirmed the g�rage was no� �or
living quarters and that the bathroam downstairs is for the swiytuning
pool. The gara�e has a room for pool equipment and a dr�ssing roUm
f�r_ changing pur_poses.

section of the garage in �onjunction with the pool was appropria�e.
H� was assured that it was. Upon a quesii.an from Comrnissioner Francard,
Mr.�Terry confirmed that the old garage would be remaved. Ther�
followed discussion of the actual 'neight of the roof ridge of the garagc.
Commission�r Sine stated 1-ie had arrived at the property the Saturday
preceding for an �rispection of th� garage, and although the house was
occupied, rio one had let hi.m in. He c�nsidered he did riot have ac�equate
infor.mation and s��ggested tizis be coni:inued to the n�xt ,ne�ting. _ Iie
commented t.hai: at the time he ac�reed to have this on the agenda hE was
assured it would be a 7-outine item, and he had n�t realized i� wo�ald

Chairman Mink pointed out that the issue no�ra before the Commissian is
a variance on the main structure, and again questioned what additional
information was needed.
Commissioner Taylor questioned tYie fact that Mr. Terry relied on a
draftsman as an authority in drawing his plans, and wanted discussion ��'
al�ernatives. Commissioner Jacobs agreed and also wanted discussion of
cost of changing the structure to meet code. Commissioner Kir.dig
desired additional information on the front setback, and Commissioner
S�.ne cansidered the applicant should provide floor plans that cornply
with the code.
C`haiz-�nan Mink pointed out that the �ubject before the Commission was a
variance, not a discussion or alternatives.
At this point the public hearing was dec�ared closed.
Comrnissioner Sir.e moved tha� the variance b� denied. Commissioner Taylo�
seconded the motione Chairman Mi.nk reques�ced that motion be couched in
the affirmative. After. some discussion, �o�r�missioners Sine and Taylc.r

application be continued either to the study meeting in April or the

SUBJECT: Variance from front setback requirements in R-1 District at
2301 Easton Drive, by Charles L. Terry
1. Ttze background to this appli.cation is described in the attached
letter, dated 3/18/75, from Mr. Terry (Exhibit A).
2.. AZso atta;,Yied is a site glan of the property at 2301 Easton Drive,
showing the 644 SF addition to the main house now under construction
(EYhibit B). A further diagram shows the 5-1/2' encroachment into
the front setback that the Commission has been asked to approvP
(Exhibit C).
3. Sever<31 other facts need to be considered:
i. The original plans submitted contain dimensional errors.
The area within the circle drawn on Exhibit B shows a fror_t
setback dimension of 16'+. Building Inspection accepted
ttiis figu�e wheri checking the plans. Two errors were mad�
at this point; one, the front line shown on the drawing must
be a curb or sidewalk line, rather than the property line;
two, tY�e raported 16' setback was not measured at right angl�s
tn the s�reet or property line.
ii. Mr, Terry is a policeman with Daly City; he is also a fully
c�ua3ifieci, r�i�stered centractor. He is personally doin7 all
the construction wo-T on fii's new house, and could reasor�ably
have been expected tc be raore knowledgeable about set�ack
requirements than the average citizen.
iii. In choosing to extend his nouse to the east, and within the
front setback, Mr. Terry nas quo�.ed both the a4 degree ang.le
that Easton Drive bisects h.is property, and his av�rage overall
setback, as factors that justify his application for a variance.
His lot, ho�aever, is unusually large: 75' wide and up to "l7�'
on its longest side. Iis total area is 16,425 SF.
4. FUur conditions are specified in �he Zoning Ordinance before a
variance may be granted. The �i�st of these refers to "extraordi_ n_ary
circumstances" only appZicable ta the property involved; otr.er
sections o.�aston Drive and other curving streets in the city

Gentlemen:
I have submitted �n zpplication for a� variance for relief from the building line
restriction,namely the front set back. .
pn 2-14-74, I made �pplication to the building department for � permit for �.n
addition to my house. I paid all of the fees including �. pl�,n checking fee. The
plans were duly inspected and so:ne notatians were mzde with regard to certzin
building regul�tions. The plans after being thoroughly checked were returned to me
and a permit was issued. There was no notation relative to the set back requirement.
Before starting, z site inspection took place on I-15-7� and then on 1-?Y1.-75 I called
for an inspection of the forms prior to po�aring concrete, A building inspector came
to.the building site, inspected the forms a.nd approved them. I poured my foundation
footings znd commenced building. Tiy building is partially framed with zll the floor
in, walls and some rafters, The rains have prohibit�d me from continuing further.
On Thursday March 13, 1975 building inspsctor Mr. C�.lwell �dvised me that �y buildi.ng
was in excess of the propex�ty �et back limit. At that time Mr. John Yost was with
him. We then measured and conf'irmed. Mr., Calwells assertion, I must adrnit the building
at one corner does protrude over the set back limit. I h�sien to repeat gentlemen
this is only �,t one sma�ll corner.
The property line on Easton Drive is a.t an extreme angle, zpproximztely 44 degrees.
On the other side of my property the house is set back appro_�cimately 5� feet which
' is well back from the property line. Zf one were to take a,n average the set b�ck would
be approxima.tely 28 feet from the pr•operty line. - -
It is unfortunate that I zm in this position of requesting z variznce vrhen m�y
building is well along in construction. I do not wish to cast any �sgersions but
I must point out in �y own behalf, I toolc all of the steps of the process necessary
to obtain z permit, called for z1I my inspections zt the proper time and felt I had full
approval. I had no intent to build �y addition without meeting a11 of the local code
requirements. I am embarassed to be in this position today,
I understand that on March 21�th I will be able to appear before you and speak in
person regarding this matter. I look forward to this time and I will be prepared
with further documentation in zn effort to convince you of my needs for a variznce.
