The proposed addition will extend an existing non- conforming side setback 4'-1" along the right side property line with a 3'-0" setback (where 4'-0" is required). Your property is located within 100 feet of this property. The Minor Modification has been requested to allow for an addition that will extend an existing first floor wall that does not meet the required setback based on Municipal Code Section 25.55.010 (a) (8). Any noticed property owner may call this item up for review. If you would like to request that this project be reviewed, which includes a public hearing, you should submit a written request to the Community Development Director within seven days of the postmark on this letter, March 19, 2014. Unless review of the application is requested, the Minor Modification shall be approved based upon the following findings: that the location of the proposed 128 SF first floor addition is behind the existing house so that it will not alter the character of the neighborhood and will not have a detrimental impact on the character of the adjacent properties; 2. that the original house was built with a 3'-0" right side setback which does not meet current code requirements and that the proposed wall will be an extension of an existing wall and does not represent a greater impact on the adjacent property than the existing side setback; 3. that the proposed addition complies with lot coverage, floor area ratio, height, and all other development requirements and therefore is compatible with the aesthetics, mass and character of the property and of adjacent properties and the neighborhood; and 4. that the construction will meet the requirements of the California Building and Fire Codes, 2013 Edition as amended by the City of Burlingame, and therefore will not be detrimental to public health, safety, or welfare.
