At this Meeting there was held a second hearing on the application of Leo W. Meyer
dated January 11, 1949, for a variance relating to Lots 8 and 9, Block 17, Town of Burlingame
Mr. Meyer, the owner of the lots, was present and urged that a variance be granted for use of
a parking lot, which he said would be of particular benefit to commuters and other long-time
parking customers; he would not plan to operate the lot at night time. Homer Stack and mem-
bers of his family, who own a lot across the street on Myrtle Road, appeared and protested
the action seeking a variance in this area which is zoned for residential apartment use, and
Mr. Stack said that he believed the existence of a commercial parking lot, with cars going it
and out across the street from his property, would be detrimental. In the discussion which
ensued, the arguments tended to be based on the need for parking facilities in that area or
the lack of such need. The Planning Commission pointed out that it is not necessary to dis-
cuss the need for additional parking space which is generally recognized in downtown Burlings
but the Planning Commission is opposed to variances and a preponderance of the property owner
in the neighborhood evidently are opposed in this instance. There was presented at the Meet-
ing a protest signed by twenty-five persons. R. D. Falk, 222 Myrtle Road, appeared and pro-
tested. Commissioner Brown made a motion that the petition be denied, which was seconded by
Commissioner Stivers. On roll call the vote was as follows:

At the request of the City Council the Planning Commission reviewed its communica-
tion October 15, 1948 relative to rezoning the strip of land in the creek area in the vicinit
of Howard avenue and E1 Camino Real. In order to clarify that communication, the following
was adopted as being added thereto:
"l. That a permit be granted to use commercially the first 189.67 feet northerly from
El Camino Real, measured along the Easterly side of the 20 foot strip. This area
represents the extension of the existing service station use across the creek. On
this portion there is to be no thoroughfare for vehicular traffic leaving or enter-
ing E1 Camino Real; and no building shall be constructed on this portion of the
area unless Lot 10-C adjoining the creek area on the West shall be zoned for commer.

2. That the balance of the area be rezoned to commercial subject to the following limi.
tations: In this area there shall be no building upon the Westerly 10 feet of 20
foot strip adjacent to Lot 10-C unless the said Lot 10-C shall be zoned for com-

mercial use.
3. The creek area shall be enclosed with a concrete culvert, the design of which steal:
meet with the approval of the City Engineer. Any building construction within the
20 foot strip shall be based on foundations separate from the culvert structure.
4. No sanitary plumbing or piping shall discharge into the creek. Storm water may be
drained into the creek."
The City Engineer presented a Record of Survey Nap of that certain 1.7925 acre trap
of land, etc. at Hillside Drive and Adeline Drive on which he advised the Planning Commissioi
"The owner's engineer had advised us that he proposes to build a six inch sewer line
connecting with the intercepter sewer running parallel with Mills Creek, which wou:
adequately serve the four parcels proposed. Water service is available along the
two adjoining streets of Hillside Drive and Adeline Drive.
It is recommended that the record of survey map be approved subject to constructioi
of sanitary sewer mentioned above. The area of each of the parcels suggested is it
excess of 10,000 square feet."
It was regularly moved and unanimously voted that the Planning Commission recommends approval
of the map subject to dedication of sewer easement as shown on the plan and profile accompan3
ing the map, and a bond or deposit of the estimated cost of the sewer to insure its construc-
tion.
City Building Inspector Watson was present and reported that he had no plans to be
presented at this Meeting of the Commission.
