This application was to allow an exception for height at 1320 Castillo Avenue, zoned R-1. The October 24, 1994 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped September 22, 1994 (site plan and fence elevation) and the overall height of the rear 50 linear feet of fence, as measured from highest adjacent grade, shall not exceed 8'-0" and that the solid portion of the other 20 linear feet of new fence shall not exceed 6' - 0" in height as measured from the highest adjacent grade; /� 2. �that within 90 days, application for a retroactive 0� ;��(;� � building permit shall be made for the deck in order to r� � J meet the requirements of the Chief Building Official's V`� ��� September 26, 1994 memo; �l� 3. ��.��� 4. that application shall be made to the Building Department for a permit to build the fence; and that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City of Burlingame. Applicant/Property Owner: Stephan G. & Patricia P. Trent Lot Dimensions and Area: 50 x 120, 6000 SF APN: 027-271-090 General Plan: Low Density Residential Adjacent Development: Single Family Residential Zoning: R-1 CEQA Status: Article 19. Categorically Exempt per Section: 15303 - New construction or conversion of small structures Class 3(e) - Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. Summary: Applicants/property owners Stephan and Patricia Trent are requesting a fence exception to build a solid wood fence, 8'-0" in height, as measured from the highest adjacent grade, along 50' of the side property line at 1320 Castillo Avenue, zoned R-1. The property slopes downwards towards the rear. The back of the house has two stories. A 130 SF second story deck extends from the rear of the house, 8'-10" above grade. The overall project includes the replacement of 70 linear feet of fence along the side property line. Twenty feet (20') of the new fence would be 6'-0" in height (as measured from highest adjacent grade) which is within code requirements. The remaining SO linear feet would be 8'-0" in height. This exceeds the maximum height allowed, which is 6'-0" of solid fence plus 1'-0" of lattice. Staff Comments: The Building Official noted that a retroactive building permit is needed for the deck (there is no record of permit). The City Engineer and Fire Marshal had no comments. Findings for a Fence Exception: In order to grant a fence exception the applicant must show and the Planning Commission must find the following exist (CS 25.78.040): 1. that there are exceptional circumstances; 2. that there is no public hazard; 3. that neighboring properties will not be materially damaged; & 4. that the regulations cause unnecessary hardship upon the petitioner. 1 FENC� S%CEPTTON I320 CAST7IlA AVENUS Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should include findings made for the variance requested. Reasons for any action should be clearly stated. Please write neatly in ink or type. 1. Describe the exceptional circumstances or conditions applicable to your property which do not apply to other properties in the area. Our house is on a descending grade from the street levei, so that the back of the house is split level. The deck off of the back of our home is raised and provides the main access to our back yard, by stairs leading from the deck. We regularly use this back deck area for eating and entertaining. The deck overlooks our neighbors entire back yard allowing no privacy for our neighbor or us. By mutual agreement with our neighbor, we determined that the existing 70' fence is in poor condition and should be replaced. We decided that ideally a"good neighbor" style fence with the rear 50' at an 8' hei ght, and the remaining 2 0' at a 6' height would providE privacy and additionally hide our storage shed from our neighbor's view. Z. Explain why the application request will not create a public hazard and will not be detrimental to public health, safety and general welfare. Entry and exit to the back yards will not be affected, this section of the fence does not have a gate. 3. Explain why the granting of the application will not materially damage neighboring properties. The neighboring properties do not have a view of this section. There is a large shady tree that hides the fence from the rear neighbors behind the easement. Because of the grade of the property and location of the higher section of the proposed fence towards the rear of the yard, it is not easily visible from the street. 4. Discuss why the regulations cause unnecessary hardship for the property owner. Due to the descending slope of the property and location of our existing deck, we have a"crow's nest" view of our neighbor's back yard. Additionally, our large dog is usually on the deck and barks whenever she sees someone in our neighbor's yard, setting off a chain reaction of barking dogs throughout the area. Reference staff report, Planning Department consideration. 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, comments, and study meeting questions. Four conditions were suggested fot Chm. Galligan opened the public hearing. Patricia Trent, the applicant, was present to respond to questions. She thinks the deck is 15 to 20 years old, it was already in place when she bought the house a year and a half ago. She checked with the previous owner and it was there when he purchased the house. The applicant and her neighbor do not want the deck area secluded for security reasons by placing a screening fence on the deck. There were no other public comments and the public hearing was closed. C. Jacobs noted the slope of this lot and explained that replacing this fence will be an improvement. She then moved approval of this application with the following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department date stamped September 22, 1994 (site plan and fence elevation) and the overall height of the rear SO linear feet of fence, as measured from highest adjacent grade, shall not exceed 8'-0" and that the solid portion of the other 201inear feet of new fence shall not exceed 6'-0" in height as measured from the highest adjacent grade; 2) that within 90 days, application for a retroactive building permit shall be made for the deck in order to meet the requirements of the Chief Building Official's September 26, 1994 memo; 3) that application shall be made to the Building Department for a permit to build the fence; and 4) that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. 7.
