Dear Ms. ,
Since there was no appeal to or suspension by the City Council, the February 28, 2000 Planning
Commission approval of your conditional use permit application became effective March 11, 2000.
This application was for an existing food establishment in the Broadway commercial area at 1201
Broadway, zoned C-1, Broadway Commercial Area.
The February 28, 2000 minutes of the Planning Commission state your application was approved
with the following conditions:
1. that this b�siness location, occupied by a specialty shop with 1500 SF of on-site seating, may
be replaced by another specialty shop at the same location within the same or less leased
square footage subject to the conditions of this conditional use permit, or shall be allowed to
change to a different type of food establishment with a new conditional use permit; that if this
specialty shop foad establishment is changed to any other type of food establishment
classification; tlus. site shail not return to specialty shop use; `tixe"criteria for the new
classification sha11 be met in order for a change to be approved
2. that the 1,500 SF area of on-site seating of the specialty shop food establishment may be
enlarged or extended to any other areas within the tenant space only by an amendment to this
conditional use perniit;
that this food establishment shall provide trash receptacles as approved by the city consistent
with the streetscape improvements and maintain all trash receptacles at the entrances to the
building and at any additional locations approved by the City Engineer and Fire Department;
4. that the applicant shall provide daily litter control along all frontages of the business and
within fifty (50) feet of all frontages of the business;

5. that there shall be no food sales allowed from this location from a window or from any
opening within 10' of the property line;
6. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become
void;
7. that the business may be from 11:00 a.m. to 12:00 a.m., open seven days a week, with a
maximum of five employees on site at any one time;
that an enclosed and ventilated gazbage storage area shall be identified at the rear of the site
and that garbage cans shall be kept in the storage area until such time garbage is picked up and
upon pick-up cans sha11 immediately be returned to the storage area

9. that the project shall provide adequate filtering and venting to avoid dissemination of odors on
neighboring properties and a grease trap(s) shall be provided as approved by the City Engineer;
10. that the office areas on the second floor shall not be separately leased; and
11. that any changes to the site shall meet all the requirements in effect at the time of the
California Building and Fire Codes, and as amended by the City of Burlingame.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.
