The following con�ditions were recommended by the Planning Commission: 1. that as installed, no portion of the receive only 8' satellite dish antenna, shall rise more than 7' above the surface of the roof at 1201 Broadway; 2. that the 8' wall proposed to enclose the satellite dish antenna shall be a maximum of 16' square and shall be painted a light gray color; 3. 'that the satellite dish shall be painted with a non— reflective paint and the nonreflective surface shall be maintained by the property owner; 4. that the satellite dish and enclosure wall shall be located on the roof as shown on the plans submitted to the Planning Department and date stamped September 2, 1987 and September 30, 1987; and �. installation of the dish antenna and wall shall meet all the requirements of the UBC as amended by the City of Burlingame and a building permit shall be obtained prior to commencing installation. Action Alternatives: l. The City Council may uphold the Planning Commission and approve the placement of an 8' rooftop satellite dish antenna at 1201 Broadway. This action should be taken by resolution so that the conditions of the permit can be recorded with the deed. 2. The City Council may reverse the Planning Commission and deny the special use permit for a rooftop dish antenna. The reasons for such action should be clearly stated. 3. The City Council may deny, without prejudice, the req uest for a rooftop dish antenna. However, this alternative should only be persued if more information is needed to make a decision or if the project presented is different from that considered by the Planning Commission. Council should give clear direction to the applicant, Planning Commission and staff about what is needed for resubmittal. �� Backqround: Gil Beyrouti, representing Village Host Pizza Restaurant, is requesting a special permit to place an 8' satellite dish antenna on the roof of the building at 1201 Broadway, Zoned C-1 (Code Sec. 18.18.020-b) The dish antenna will receive signals only. The 8' dish will be set so that it rises 7' above the surface of the roof and 2.5'above the parapet wall. To keep the dish from being seen, it will be set toward the center of the roof and enclosed by an 8' wall, 16' square. The wall will be made of painted plywood and will be fastened to the roof. The applicant (Sept. 2, 1987 letter) stated that they looked at several different size dish antennas. The 8' size was the smallest they could use and still get an acceptable clarity of picture and range of stations. He wants the dish so that patrons of his. restaurant can enjoy the special stations offered, particularly, simulcast sports events. Planninq Commission Action: On October 13, 1987 the Planning Commission held a public hearing and voted 5-0 (Cers. Garcia and H. Graham absent) to approve the use permit. There was no one speaking in opposition to this application at the public hearing. Commissioners discussion included why the proposed location within the roof area was chosen (parapet height varies, fu.rthest from the lowest parapet); percentage of roof coverage allowed (5 percent); and whether the size of the enclosure could be made smaller (rotation of the antenna precludes making enclosure smal.ler ) . Graham, Harrison, Jacobs Absent: Commissioners Garcia, N. Graham Staff Present: Margaret Monroe, City Planner; Jerome Coleman, City Attorney; Frank Erbacher, City Engineer MINUTES - The minutes of the September 28, 1987 meeting were unanimously approved. AGENDA - Item #5 continued to the meeting of October 26, 1987 at the request of the applicant. Order of the agenda was then approved. ITEMS FOR ACTION . 1. SPECIAL PERMIT FOR AN 8' DIAMETER ROOFTOP SATELITE DISH ANTENNA AT 1201 BROADWAY, ZONED C-1 Reference staff report; 10/13/87, with attachments. CP Monroe reviewed details of -- the request, staff review, applicant's letter, planning staff site inspection which revealed that barrier wall will be visible from across the street on Broadway �oing �east, and roof diagram submitted by applicant. Five conditions were suggested for consideration at the-public hearing. Chm. Giomi opened the public hearing. Gil Beyrouti, applicant, was present. He stated there would not be any problem in meeting the suggested conditions. The location of the dish was chosen because of the depth of the parapet wall at this location. Towards the rear of the building the roof line rises and there is not as much parapet wall to shield the dish from view. Some discussion ensued between commission and staff regarding percent of roof which may be covered by structures and the possibility of this proposal setting a p r ec edent C.P. Monroe noted that code allows up to 5 percent of the roof area to be covered by structures and it did not appear that the barrier wall would be exceeding this limitation. In response to a commissioner's_question, CP. Monroe noted that besides 14�0 Chapin other roof- top dish antennas have been approved in the M-1 zoning district and some in the C-4 district. A commissioner asked if the area of the barrier wall could be made smaller. Applicant responded he�had no problem with making the wall smaller, its only ourpose is to shield the dish from view. It was noted, however, that the dish will rotate and reducing the area within the barrier wall would inhibit the dish's ability to receive signals. C. The proposed antenna will rise about 2.5' above the existing parapet wall. However the applicant is proposing to place the dish within an 8' high enclosing wall 16' square which will extend above the existing building parapet shielding the dish from view. The wall will be built of painted plywood and anchored to the roof with metal braces. The wall will be white. The dish will be placed by a vent roughly in the center of the roof. Staff Review City staff have reviewed this antenna request. The Fire �iarshal (September 17, 1987 memo), Chief Building Inspector (September 21, 1987 memo) �nd City Engineer (September 21, 1987 memo) had no comments. Planning staff would note that the applicant is proposing to enclose the dish which will rise above the roof 7' by a 16' square plywood structure so that the dish cannot be seen. The 8' wall as it rises 2.5' above the building parapet may be visible from some locations. Section 18.18.020-b of the municipal code regulating satellite dish antenna in commercial zones simply requires a use permit which includes public review. � �pplicants' Letter In their letter of September 2, 1987 they state that they would like to install a receive only satellite dish antenna for TV reception in the restaurant. Since there is no place to put the dish on the ground, the applicant proposes to place it on the roof. They would have preferred a 10' dish but compromised on an 8' dish which is physically smaller. The 8' dish will not have as clear reception as a 10' but will be bettQr than a 6' dish. In fact a smaller dish would have such poor reception that the applicant would not be interested in it. Study Questions The Planning Commission reviewed this request at study on September 28, 1987 (Planning Commission Minutes, September 28, 1987). The proposed 8' wall surrounding the dish will be ma3e of plywood and painted white. The purpose of the wall is to shield the rooftop dish antenna from view. The wall will be built in a 16' square with the antenna placed in the middle. The applicant :zas supplied a roof plan showing the location of the proposed antenna and the wall surrounding it. Owner's consent to the application for a satellite antenna was received on September 28, 1987 and is on file. -2- Planninq Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. TfiE OUTSIDE PORTION OF TfiE SYSTEM CONSISTS OF THE SATELLITE ANTENNA, THE MOUNT, ACTUATOR ARM AND MOTOR, ELECTRONIC EQUIPMENT, THE BASE, AND THE BARRIER, ALL WEIGHING LESS THAN FIVE HUN- HUNDRED FIFTY-FIVE (555) POUNDS. AFTER A CAREFULL ANALYSIS AND CONSIDERING CITY REQUIREMENTS, LACK OF ENOUGH GROUND SPACE, LANDLORD DESIRES, A ROOF TYPE INSTALLATION WAS THE ONLY CHOICE AVAII�IBLE TO OUR CUSTOMER AND US. OUR CUSTOMER WANTED A TEN FOOT DISH BECAUSE IT GIVES HIM SUPERIOR RECEPTION ON THE SATELLITE CHANNELS WANTED. THERE IS NO OTHER MEANS OF RECEIVING THE TYPE OF PRO- GRAMING OUR CUSTOMER DESIRES. A SIX FOOT DISH WOULD BE TO SMALL FOR ANY MEANING- FUL TYPE OF VIEWING ESPTCIALLY ON THE WEAKER SATELLITES THAT ARE OUT THERE. THERE ARE ABOUT 20 SATELLITES IN ORBIT FOR TELEVISION RECEPTION SOME SATELLITES ARE STRONG AND SOME ARE WEAK. TfiE LARGER THE DISH THE STRONGER THE SIGNAL. HAVING THE BEST ELECTRONICS WILL MARGINALLY IMPROVE PICTURE QUALITY. Giomi opened the public hearing. Joe Putnam, representing several major auto dealers in the audience, addressed Commission. He stated the dealers would like an opportunity to study the proposed revisions further, noted how the auto dealership business has changed and expanded in recent years and requested an informal study session with the Planning Commission in approximately 60 days. There were no further audience comments and the hearing was closed. Following some discussion about the need for a response from the auto dealers to Commission's proposed revisions and timing and manner of an informal meeting, C. Jacobs moved to table this item until a response is received from the auto dealers at which time staff will schedule a study me�ting. Second C. H.Graham. C.
