MASTER SIGNAGE PROGRAM FOR THE COMMERCIAL BUILDING AT
1199 BROADWAY, ZONED C-1
David Kimmel, leasing agent representing Garbis Bezdjian, property
owner, is requesting a sign exception for a uniform master signage
program for the commercial building at 1199 Broadway, zoned C-1.
All master sign permits require Planning Commission approval (Code
Sec. 22.06.070).
Under the proposed master signage program each tenant space would
be allowed one identification sign totaling 9 SF except the corner
shop which would have two signs, one on the Broadway frontage and
one on the Laguna frontage. A 24 SF building identification sign
would be placed on the building at the corner of Broadway and
Laguna Avenue. None of the proposed signs would be lit.
A total of seven signs are proposed for the Broadway frontage (six
tenant signs plus one building identification sign) totaling 7$ SF,
and one 9 SF tenant sign for the Laguna frontage. Under the
present code, as a one tenant space the building would be allowed
165 SF of signage in three signs on Broadway and 50 SF of signage
in three signs on Laguna, compared to the 78 SF in seven signs on
Broadway and the 9 SF in one sign on Laguna proposed in the master
signage program. The Broadway frontage with six tenants as at
present could have as many as 18 signs totaling 300 SF, with an
additional three signs totaling 50 SF on the secondary frontage of
Laguna Avenue. Thus the program as proposed is within the allowed
signage limits of the present code.
Existing signage on the site has evolved over the years without the
benefit of sign permits and has been the issue of numerous code
enforcement attempts. The proposed master signage program is
intended to achieve a uniform and cohesive signage program for this
site.
Staff Review
City staff have reviewed the proposal. The Fire Marshal (May 4,
1988 memo), the City Engineer (May 2, 1988 memo) and the Chief
Building znspector (May 6, 1988 memo) had no comments.
Planning staff would note that included in your packet is a letter
from The Kimmel Company to the tenants of 1199 Broadway (March 24,
1988) which asks the tenants to choose between having a master
signage program or window signs. On April 7, 1988 the tenants
responded by choosing the master signage program for tenant
identification signs and no window signage. On April 18, 1988 the

tenants sent a subsequent letter to The Kimmel Company outlining
their requirements for signage which included approval by the city
of a master signage program as well as window signage.
Window signs are permitted as a part of permitted signage in the
sign code as long as they don't cover more than 50� of a window
area or exceed the permitted signage square footage for a site.
Property owner consent is required for any sign permit application.
Since the property owner is choosing not to include any window
signs as a part of the master signage program, window signs are not
included in this proposed master signage program. The only way
permanent window signs could be permitted in the future would be
through an amendment to the proposed master signage program.
Apvlicant's Comments
In the sign exception the applicant notes that 1199 Broadway is a
single building with a number of tenants and the sign code does not
adequately address signage for such a building.
Study Ouestions
At study on May 23, 1988 the Planning Commission asked a number of
questions (Planning Commission Minutes, May 23, 1988). Review of
the previous requests for signage on this site was primary among
the Commission�s questions. An application for a master signage
program for 1199 Broadway was originally filed on August 15, 1986.
The signage proposed at that time was the same as currently being
reviewed. This application was withdrawn at the request of Mr.
Kimmel, the leasing agent, in order for him to come to agreement
with the property owner regarding appropriate signage for the site.
On September 17, 1987 a new application was filed which, in
addition to the tenant identification and building identification
signs, also proposed between 20 SF and 34 SF of window signage for
each tenant space. This application was withdrawn by the property
owner who did not approve of the proposed window signage.
On April 20, 1988 a letter was received from the leasing agent�s
office requesting that the September 17, 1987 master signage
application be reactivated. Property owner consent was obtained
for this application with the specification that no window signage
be added without the property owner�s consent (Garbis Bezdjian
response dated April 18, 1988 to Terry Thornhill�s letter dated
April 14, 1988). The application being processed, if approved,
would allow no window signs without amendment to the master signage
permit.
Tenants will be allowed only that signage specified by the master
sign program. The property owner and his authorized
representatives will be required tv inform tenants of the permitted
signage. They will be ultimately responsible for implementation
and adherence to the adopted signage requirements. Because sign

code enforcement has been a problem on this site over the past
several years it should be required that the leasing agent and
property owner see that all existing signage is removed from the
site and signage consistent with the master signage program
installed within a fixed period of time.
The proposed tenant signs will be made of plywood and painted with
enamel. The signs will hang from two metal extension pipes which
will be bolted to the metal trim around the building.
Findincrs for a Sian Exception .
In order to grant a sign exception the Commission must find that
the following circumstances apply to the property (Code Sec.
22.06.110):
(a) any exception granted shall be subject to such conditions as
will assure that the adjustment thereby authorized shall not
constitute a grant of special privilege inconsistent with
the limitations upon other properties in the vicinity and
district in which the subject property is situate; and
(b) because of special circumstances applicable to the subject
property, including size, shape, topography, street
frontage, location or surrounding land use; the size or
height of the building on which the sign is to be located;
the classification of the street or highway on which the
sign is loca�ed or designed primarily to be viewed from, the
strict application of zoning regulations is found to deprive
subject property of privileges enjoyed by other properties
in the vicinity and under identical zone classification.
Planning Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action
should be clearly stated. At the public hearing the following
conditions should be considered:
1. that the signs shall be installed as shown on the plans
submitted to the Planning Department and date stamped April
15, 1987 and as individually described in the sign permit
application dated September 17, 1987 and that no window
signs shall be allowed;
2. that the property owner and his authorized representatives
shall be responsible for informing the tenants of the
permitted signage under the master signage program and
ensuring that the sign program is implemented within 30 days
of receiving a master signage permit;

The "Master Sign Program" does not seem to have had much success. After
two years there are still no signs identifying the businesses at 1199
Broadway.
Original front elevation plans show the cartouche signs of strip mall
design along the bottom rail of the double convex canopy in �ront of
each business. They were never completed; t.hese are the marquee signs
we have been waiting for over two years to see below the cano�y to
identify our businesses to the public under the "Master Sign Program."
A cause of the failure of the "Master Sign Program" seems to be the
omission of the obvious need for window signage. We can find no rational
motivert��r.can the Planning Department,for the lanc owner's disavowel of
window signs. They should not exclude the equally necessary marquee
signs. All together the signage would be under 50 square feet, and since
the signs identifying our businesses and services will be extant over
fourteen days, we require the �`written permission" of the land owner,
who for svhat ever reason, inconsiderately omitted window signage from
t�e fiiino of his 22.04.240, and has delayed thereby the implementation
of the marquee signs.
In his letter of August 8, 1987 he claims to give approval for the signs.
Understanding his attitude about windows, this must refer to the marquee
signs, which he enjoins you td"have the contractor work on as soon as
posible." This direction or subterfuge follows a letter requesting the
marquee sign�, sent to you January 15, 1987, signed by the tenants.
Your Addendum to Lease #7 stipulates that you shall maintain signs, and
#15, that you shall comply with City regulations including signs. Yet, you
asked for the tenants suggestion and decision on the matter of window
signs or marGuee signs. We chose the latte�,-�nc o.nly prcvision in the
land own��sr'.s.;��1Sf�-f,or..signs, and allowed you one week for Gity approval
with c�n�if^mation t0 the tenants, by 4/14/�4$, hopefully with confirmation
from the sign contractor as well, so we can have our marquee business signs.
For ihis necessity we request at this time, within ten days of receipt of
this l.etter, after waiting over two years for the "Master Sign Program" to

CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame
was called to order by Chairman Jacobs on Monday, May 23, 1988 at
7:32 P.M.

MINUTES - The minutes of the May 9, 1988 meeting were unanimously
approved.
AGENDA - Order of the agenda approved.
The Chair introduced County Supervisor Bill Schumacher who was in
the audience. Mr. Schumacher acknowledged the introduction and
commented on the importance of a Planning Commission to the
governmental process, to a city and to its citizens.
ITEMS FOR STUDY
1. SPECIAL PERMIT - SATELLITE DISH - 3 CALIFORNIA DRIVE
Requests: when was this dish installed, why was no permit required
at that time; discuss FCC preemption referred to in applicant�s
letter; will the dish be screened; method of fastening dish to the
roof; where can it be seen from. Item set for public hearing June
13, 1988.
2. SIGN EXCEPTION - MASTER SIGN PROGRAM - 1199 BROADWAY
Requests: effects of the building owner�s refusal to allow window
signs; history of the application since September, 1987 when it was
first received; detail on how the signs will be attached; has the
application changed since the conceptual proposal in September,
1987. Item set for public hearing June 13, 1988.
3. SPECIAL PERMIT AMENDMENT - 1730 ROLLINS ROAD
Requests: location of the new parking space; indicate on diagram
existing on-site parking, are all these spaces marked; comment from

mid portion of the building; discuss parking requirements with the
relocation of office space. Item set for public hearing June 13,

4. TWO 5PECIAL PERMITS FOR CONSTRUCTION OF A NEW GARAGE AT
728 CROSSWAY ROAD, ZONED R-1
Reference staff report, 5/23/88, with attachments. CP Monroe
reviewed details of the request, staff review, applicants� letter,
study meeting questions. Two conditions were suggested for
consideration at the public hearing.
During discussion it was noted no trees are marked on the plans,
will this construction affect the large tree on the neighbor�s
property; staff advised the proposed garage is too large to be
considered under the Minor Modification procedure; total garage and
storage area requested is 660 SF, storage area exceeds 10� of the
floor area of the house, when a second story is added to the house
within the next two years storage area in the garage will not
exceed 10� of the floor area of the house.
Chm. Jacobs opened the public hearing. Michael McCallion,
applicant, was present. He advised they plan to remove all trees
except the redwood tree on the side, they will put redwood siding
on the rear of the garage for the benefit of the neighbor and will
plant some trees behind the garage for privacy, any trees which are
removed will be replaced; they had not considered the effect of
construction on the redwood tree next door on the fence line but
had talked to the neighbor who had no objections to the garage,
they did not discuss the redwood tree; they plan to add to the
house in the near future and storage area in the garage will be
used to store supplies for this project; applicant confirmed he was
a contractor.
A petition in favor (included in the packet) signed by 16 people in
the area was noted. There were no audience comments and the public
hearing was closed. Staff explained the storage area is
partitioned off from the garage space, therefore the second special
permit is required.
C. H.Graham moved for approval of the two special permits and for
adoption of Commission Resolution Approving Special Permits with
the following conditions: (1) that the garage as built shall
conform to the plans submitted to the Planning Department and date
stamped April 21 and 22, 1988; and (2) that no part of the garage
shall ever be used for residential purposes nor shall any other
utility except electricity be extended to the garage.

A complaint was received regarding flags at 1199 Broadway. A site inspection
today revealed that Galleria De Farsh ha.s six flags being displayed above
their doorway. Per Code Section 22.34.110� only one flag of any particular
type, may be permitted per parcel; all other flags require Planning C�nission
review. A letter has been sent to this business, informurig them of the
limitations which apply to tYie display of flags. The picture belaw displays
the existing conditions at this location.

PLANNER REPORTS
- SPECIFIC PLANNING CONCERNS FOR FUTURE ACTION
Reference CP's memo of 7/31/86. Commission requested additional items
for study: parking requirements for condominiums and apartments;
concern about regulations for abandoned progerties and nonconforming
parking, alternatives otaer than a variance or buying another lot for
parking; possibility of making it easier to build an oversized garage,
thus getting more cars off the street. CE's suggestions were also
noted: paved access to required parking; single family residential
driveway width; regulations to keep required parking open to the users �
of a building and not leasing it out to others; hotel valet parking.
Staff noted the need to prioritize these items in view of available
staff time. CP will take this amended list of concerns to City Council
and request consideration be given to a joint meeting with the Planning
Commission.

the accessory structure had been there for many years, it is not a
habitable structure with reference to UBC regulations; the bathroom was
added without a building permit and attached to the accessory structure
within 3' of property line, if the special permit is not granted the
applicant will have to remove it; the accessory structure could be used
for storage.
With the statement that the city has codes which are basically laws,
this addition is not an asset to the community, it will affect the
neighborhood, the house seems large enough for this family, C. Jacobs
moved for denial of the special permit and for adoption of Commission
Resolution Denying Special Permit with the following conditions: (1)
that the illegal bathroom attached to the detached accessory structure
shall be removed within 30 days (October, 1986) and the structure
returned to the use for which it was originally designed, storage; and
(2) that neither of the two detached accessory structures on site shall
be used for residential purposes. Second C. Graham.
Comment on the motion: in favor of the motion, approval would be
precedent setting, there are regulations which have been developed as a
guideline for the city, this is a large lot and there are other
alternatives to gaining additional square footage such as an addition
to the house. Motion to deny approved on a 6-0 roll call vote. Appeal
procedures were advised.

4. SPECIAL PERMIT - TAKE-OUT FOOD SERVICE AND CATERING OPERATION -
1109 BURLINGAME AVENUE
Item withdrawn by the applicant.
5. SPECIAL PERMIT AMENDMENT TO ALLOW RELOCATION OF A SATELLITE
DISH ANTENNA AT THE MARRIOTT HOTEL, 1800 BAYSHORE HIGHWAY
Reference staff report, 9/8/86, with attachments. CP Monroe reviewed
details of the request, staff review, Planning staff comment,
applicant's letter, need for BCDC approval. Three conditions were
suggested for consideration at the public hearing.
Comment: landscape screening of the installation will still be
required. Chm. Giomi opened the public hearing. Applicant was
present. There were no audience comments and the public hearing was
closed.
With the statement this is merely an amendment to the placement of the
dish, a slight move, if BCDC approved it view corridors will be
maintained and with the understanding the original landscaping
requirements will be met, C. Jacobs moved for approval of this special
permit amendment and for adoption of Commission Resolution Approving
