Date: Jul 24, 2009 William Meeker, Community Development Director RESOLUTION APPROVING CATEGORICAL EXEMPTION, DESIGN REVIEW, SIDE SETBACK VARIANCE AND LOT COVERAGE VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for Desiqn Review, Floor Area Ratio Variance and Special Permits for Declining Height Envelope and Basement for a first and second story addition to a sinqle family dwelling and new basement at 1208 Bernal Avenue, zoned R-1, Brad and Roxann Loose, property owners, APN: 026-172-190; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 13, 2009, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section: 15301 (e)(1) of the CEQA Guidelines, which states that additions to existing structures are exempt from environmental review, provided the addition will not result in an increase of more than 50% of the floor area of the structures before the addition, is hereby approved. 2. Said Design Review, Floor Area Variance and Special Permits are approved subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Design Review, Floor Area Ratio Variance and Special Permits are set forth in the staff report, minutes, and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. C irman I, �����'��J E� ���--- , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 13`h dav of Julv, 2009 by the following vote: 1208 BERNAL AVENUE - RESO 52-2009 AYES: Auran, Brownrigg, Cauchi, Terrones, NOES: NONE ABSENT: Lindstrom ABSTAIN: Vistica RECUSED: Yie � ; � � Secretary EXHIBIT "A" Conditions of approval and Special Permits. 1208 Bernal Avenue Effective July 23, 2009 for Categorical Exemption, Design Review, Floor Area Ratio Variance that the project shall be built as shown on the plans submitted to the Planning Division date stamped July 1, 2009, sheets A1.1 through A3.4 and L1.0; 2 3 that if the applicant chooses to propose a clay tile roof instead of the metal roof with solar panels as proposed, the item shall be brought back to the Commission as an FYI item; that if the structure is demolished or the envelope changed at a later date the Floor Area Ratio Variance, as well as any other exceptions to the code granted here, will become void; 4. that any changes to building materials, exterior finishes, windows, architectural features, roof height or pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review (FYI or amendment to be determined by Planning staff); 5. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), shall require an amendment to this permit; 6. that the conditions of the Chief Building Official's April 29, June 29 and June 9, 2009 memos, the City Engineer's May 12, 2009 memo, the Fire Marshal's May 4, 2009 memo and the NPDES Coordinator's May 5, 2009 memo shall be met; 7. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 8. that prior to issuance of a building permit for construction of the project, the project construction plans shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved plans throughout the construction process. This building must comply with the 2007 California Building Code for new structures. 7) Due to the extensive nature of this construction project the Certificate of Occupancy will be rescinded once construction begins. A new Certifi�ate of Occupancy will be issued after the project has been finaled. No occupancy of the building is to occur until a new Certificate of Occupancy has been issued. 8) Show the distances from ail exterior walls to property lines or to assumed property lines 9) Provide a complete demolition plan that indicates the existing walls, walls to be demolished, new walls, and a legend.
