Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15303 (e), which states that construction and location of limited
numbers of new, small facilities or structures including accessory (appurtenant) structures including garages,
carports, patios, swimming pools and fences is exempt from environmental review.
Project Description: The site currently contains an existing two-story story house (1,828 SF) and a detached
one-car garage (221 SF). The applicant is proposing to enlarge the existing detached garage by 120 SF
towards the rear of the lot. The detached garage would increase in size from 221 SF (12'-2" x 18'-2") to 341 SF
(12'-2" x 28'-0"). The applicant is requesting approval of a Conditional Use Permit to install a toilet and sink in an
enclosed room within the detached garage.
With this application, the floor area ratio will increase from 2,715 SF (0.45 FAR) to 2,835 SF (0.47 FAR) where
3,361 SF (0.56 FAR) is the maximum allowed. The proposed project is 526 SF below the maximum allowed
FAR and is therefore within 15% of the maximum allowed FAR.
Two off-street parking spaces (1 covered and 1 uncovered) are provided and required for the existing four-
bedroom house. With this application, there is no increase in the number of bedrooms in the main dwelling. The
existing detached garage is nonconforming in covered parking space length (17'-2" clear interior dimensions
provided where 18'-0" is the minimum allowed for existing conditions). With this application, the interior clear
dimensions of the covered parking space length will be increased to 21'-7 3/8" to comply with current code
standards for new construction (20'-0" minimum required). All other zoning code requirements have been met.
The applicant is requesting the following applications:

Staff Comments: Planning staff would note that since this request for Conditional Use Permit is limited to
enlarging an existing detached garage, the application was placed directly on the action calendar. If the
Commission feels there is a need for more discussion, this item may be placed on a future action calendar for a
second review and/or public hearing with direction to the applicant.

Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;

(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped
September 24, 2014, sheets A-1.0, A-1.1 and A-4.0, and that any changes to footprint or floor area of the
accessory structure shall require an amendment to this permit;
2. that if the accessory structure is demolished or the envelope changed at a later date the Conditional Use
Permit, as well as any other exceptions to the code granted here, will become void;
3. that the conditions of the Building Division's September 24, 2014 and August 29, 2014 memos, the
Engineering Division's September 10, 2014 memo, the Parks Division's September 2, 2014 memo and
the Stormwater Division's September 4, 2014 memo shall be met;
4. that any grading or earth moving on the site shall not occur until a building permit has been issued and
such site work shall be required to comply with all the regulations of the Bay Area Air Quality
Management District;
5. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit; and
6. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame.

We have submitted an application to the Planning Commission to approve a renovation of our garage,
which includes additional square footage and a half bath addition.
We have very little storage in our home and feel that a larger garage will provide us with the additional
space needed to store typical garage equipment. We have 3 children who are entering their teen years
and are very active outdoors. We are also requesting approval of a half bath. Our current home has a
master bath connected to our master bedroom and a guest bath located in the center of our home. The
additional garage half bath will provide restroom facilities to our growing kids who are often outdoors.

The Planning Commission is required by law to make findings as defined by the City's Ordinance (Code

Proposed garage renovation includes that addition of a half bath. The proposed design locates the bath
at the southwest corner of the structure with windows facing into the subject property yard, only. There
will be no adverse impact on the health, safey, and general welfare. Furthermore, the soundness of the
structural design will increase due to the updated and code compliant structural reconfiguration for the
structure.
How will the proposed use be located and conducted in accordance with the Burlingame
General Plan and Zoning Ordinance?
The proposed bathroom will be located within the structure and exterior openings will be oriented
internally per the site configuration. The impact will be consistent with the residential zoning of the
properry.
How will the proposed project be compatible with the aesthetics, `nass, bulk and character of
the existing and potential uses on adjoining properties in the general vicinity?
The proposed garage renovation eactends the e�sting structure towards the rear property line that is
fenced and screened with mature vegetation. In addition, the rear property line abutts an utility
easement that further buffers the proposed structure from all rear property line neighbors. The
neighboring property to the east already contains a shed structure in the adjacent rear property corner
such that the impact of the expansion will be negligable. The height of the structure at its ridgeline will
be 2'-5" above the existing ridge. This additional height is due to a low roofed extruded dormer that
maintains the low profile of the existing garage and matches the primary roof pitch of the main
residence

9) This project will be considered a New Building because, according to the City of
Burlingame Municipal code, "when additions, alterations or repairs within any twelve-
month period exceed fifty percent of the current replacement value of an existing
building or structure, as determined by the building official, such building or structure
shall be made in its entirety to conform with the requirements for new buildings or
structures." This building must comply with the 2013 California Building Code for new
structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be submitted to,
and approved by, the Building Division prior fo the implementation of any work not
specifically shown on the plans. Significant delays can occur if changes made in the
field, without City approval, necessitate further review by City departments or the
Planning Commission. Inspections cannot be scheduled and will not be performed for
work that is not shown on the Approved plans.

NOTE: A condition of this project approval is that the Demolition Permit will
not be issued and, and no work can begin (including the removal of a�

NOTE: A written response to the items noted here and plans that specifically address
items 1, 2, 3, 4, 5, 11, 12, 14, 15, and 16 must be re-submitted before this project can

WHEREAS, a Categorical Exemption has been prepared and application has been made for a
Conditional Use Permit for a toilet in a detached qaraqe at 1205 Bernal Avenue, Zoned R-1. Lori Potter,

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on October
14. 2014, at which time it reviewed and considered the staff report and all other written materials and

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15303 (e), which states that construction and location of limited
numbers of new, small facilities or structures including accessory (appurtenant) structures
including garages, carports, patios, swimming pools and fences is exempt from environmental
review, is hereby approved.
2. Said Conditional Use Permit is approved subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Conditional Use Permit are set forth in the staff report,

I understand that the structure needs to comply with 2013 California Green Building
Code Resdential Checklist, that part I am unclear on is that given that we do not
intend to heat or cool this half-bath Qust a water closet with sink) should we just mark
all of the energy efficiency categories as n/a? Or is there some sort of crazy
requirement that requires this 1/2 bath to be conditioned space?
