Applicant: Jeff Haywood, Peets Coffee and Tea APN: 029-204-270 Property Owner: Tybab Partners LLC Lot Area: 8,100 SF Architect: Elise Sola, The Charles Doerr Group Zoning: C-1, Sub Area A General Plan: Shopping and Service Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301 - Existing facilities, Class 1(a) of the CEQA Guidelines, which states that interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances are exempt from environmental review. History: In November of 2007, a fire occurred on the second story of the building at the southeast corner of Burlingame Avenue and Park Road and a majority of the building has been vacant since that time. Since the fire, the property owner has obtained several building permits to repair the fire damage and has begun a six year retrofit that includes a full sprinkler system in the building. This corner unit (1241 Burlingame Avenue) is currently vacant but was previously occupied by a retail jewelry store (MacGeraghty's Jewerly). Only one food establishment is allocated to this parcel. Currently, Sakae Sushi, is operating as a food establishment at 240 Park Road, which is located on the same parcel as 1241 Burlingame Avenue. In order for the proposed limited food service to receive the final on its building permit, Sakae Sushi must be permanently closed as a food establishment on this parcel. Project Description: The applicant is proposing to remodel and expand the corner unit on the ground floor of an existing two-story commercial building at 1241 Burlingame Avenue, zoned C-1, Subarea A, Burlingame Avenue Commercial Area. The parcel is located at the southeast corner of Burlingame Avenue and Park Road. The applicant, Peet's Coffee and Tea, is currently located 1309 Burlingame Avenue and has indicated that the existing store location would be closing at the same time that the new location is opening. This project is subject to Commercial Design Review per CS 25.57.010 c. FaCade changes are proposed on both Burlingame Avenue and Park Road. The remodel includes expansion of the corner unit at 1241 Burlingame Avenue into a portion of the next door unit at 1235 Burlingame Avenue. It also includes relocation of the entry door system and window system for 1235 Burlingame Avenue along the Burlingame Avenue frontage. A new dark bronze aluminum/glass door is proposed along the Park Road frontage. Lastly, the existing awning will be removed and the existing "fluted metal" behind the awning will be exposed. At this time, no changes are proposed to the second story of the building. As part of the project, the applicant is proposing to replace an existing full service food establishment (on the same parcel but in a different building) with one new limited food service. A Conditional Use Permit Amendment is required to change the food establishment classification from full service food establishment (Sakae Sushi at 240 Park Road) to limited food service and for an increase in the seating area (CS 25.36.042 d, 1). The limited food service will have approximately 360 SF of seating area, where the previous full service food establishment (on the same parcel but in another building) had 250 SF of on-site seating. A limited food service is defined as a business which sells food which is ready to eat such as sandwiches, frozen deserts or beverages served in edible, plastic or disposable containers. Operating criteria to define a limited food service include some or all of the following: no commercial kitchen; no commercial dishwasher; take out food service only; and an indoor seating area of less than two hundred-fifty (250) square feet (CS 25.08.268-4). The applicant, Peet's Coffee and Tea, a limited food service, would operate within the following conditions: the business will be open seven days a week, from 5:30 a.m. to 9:00 p.m., with a maximum of 3 full-time employees Commercial Design Review and Conditional Use Permit Amendment 1241 Burlingame Avenue and 9 part-time employees on site at any one time. A maximum of 30 people are expected on site at any one time, including the owner, employees and customers. The change in tenants is not considered a change in use because it is going from a retail use to another retail use. All retail spaces on the ground floor located in Subarea A of the Burlingame Avenue Commercial Area, including food establishments, are exempt from on-site parking requirements per CS 25.36.040 d, 3). There are no on-site parking spaces existing or proposed. All other zoning code requirements have been met. Planning staff would note that this application to relocate and change the classification of an existing food establishment on the same parcel does not increase the total number of food establishments in the Burlingame Avenue Commercial Area, Subarea A. Design Review Study Meeting: At the Planning Commission Design Review Study meeting on February 23, 2009, the Commission had a few questions and comments regarding this project and voted to place the item on the Consent Calendarwhen all information has been submitted and reviewed bythe Planning Division (February 23, 2009 Planning Commission Minutes). The applicant submitted revised plans and a response letter to the Planning Division on February 25th and 26th, 2009, to address the Planning Commission's questions and concerns. The revised plans include a chain link fence with slats and a roof as the trash enclosure, one additional street tree along Park Road, a new plaster soffit over the second entrance to the building along Park Road to match the existing soffit over the main entry at the corner of Burlingame Avenue and Park Road and two new portable planters to flank the second entrance along Park Road. The response letter from the applicant identifies all changes made to the plans. Please refer to the copy of the February 23, 2009, Planning Commission minutes included in the staff report for the list of Planning Commission questions and comments. Staff would note that the applicant shall work with the Engineering Division towards finalizing the design for the trash enclosure when plans are submitted for a building permit. Staff would also note that the Engineering Division will not require an additional trash receptacle for this business because of its proximity to an existing receptacle located at the corner of Burlingame Avenue and Park Road. y� Commercial Design Review and Conditional Use Permit Amendment 1241 Burlingame Avenue Design Review Criteria: The criteria for Commercial Design Review as established in Ordinance No. 1652 adopted by the Council on April 16, 2001 are outlined as follows: 1. Support of the pattern of diverse architectural styles that characterize the city's commercial areas; 2. Respect and promotion of pedestrian activity by placement of buildings to maximize commercial use of the street frontage, off-street public spaces, and by locating parking so that it does not dominate street frontages; 3. On visually prominent and gateway sites, whether the design fits the site and is compatible with the surrounding development; 4. Compatibility of the architecture with the mass, bulk, scale, and existing materials of existing development and compatibility with transitions where changes in land use occur nearby; 5. Architectural design consistency by using a single architectural style on the site that is consistent among primary elements of the structure, restores or retains existing or significant original architectural features, and is compatible in mass and bulk with other structure in the immediate area; and 6. Provision of site features such as fencing, landscaping, and pedestrian circulation that enriches the existing opportunities of the commercial neighborhood. Findings for Design Review: Based on the findings stated in the attached minutes of the Planning Commission's February 23, 2009, Design Review Study meeting; that no changes are proposed to the mass and bulk of the existing building, which is currently consistent with the mass and bulk of other structures in the immediate area; that the existing window systems and awning along the Burlingame Avenue frontage will be reused and enhanced to keep a similar appearance along this frontage; and that two new street trees, a new entry door and a new awning are proposed along the Park Road frontage to enhance the appearance along this frontage; for these reasons the project is found to be compatible with the requirements of the City's six Commercial Design Review Guidelines. Conditional Use Permit Criteria: In order to grant a Conditional Use Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Findings for Conditional Use Permit Amendment: Since the current regulations limit the number of food establishments to those in Subarea A as of November 1999 as approved by City Council Resolution No. 111- 1999 on October 18, 1999, and this business meets those criteria; the business will operate within the limits established by that ordinance; the use will not be detrimental to the city's objective of promoting pedestrian oriented retail activity in this commercial area because it is within the city approved number at an existing location and therefore will be in compliance with the general plan for the area; since this project will not change the number of food establishments in the Burlingame Avenue Commercial Area it contributes to the City's goal of enhancing the pedestrian retail character of Burlingame Avenue; and since the business shall be required to comply with all the city regulations including providing trash receptacles and litter maintenance in the surrounding -3- Commercial Design Review and Conditional Use Permit Amendment 1241 Burlingame Avenue surrounding area, signage, meeting building code requirements, as well as adhering to County health requirements, the operation will be compatible with the public's health and safety as well as with the character of the existing commercial area. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped February 25, 2009, sheets CS-1, SP-1, SP-2 and P-1 through P-5; 2. that this business location occupied by a limited food service, with 360 SF of on-site seating may change its food establishment classification only to a full service restaurant or bar upon approval of a Conditional Use Permit Amendment for the establishment change; the criteria for the new classification shall be met in order for a change to be approved; 3. that the 360 SF area of on-site seating of the limited food service shall only be enlarged or extended to any other areas within the tenant space by an amendment to this Conditional Use Permit; 4. that any changes to the size or envelope of building, which would include changing or adding exterior walls or parapet walls, shall require an amendment to this permit; 5. that any changes to building materials, exterior finishes, windows, architectural features, roof height or pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review (FYI or amendment to be determined by Planning staff); 6. that this limited food service may be open seven days a week, from 5:30 a.m. to 9:00 p.m., with a maximum of 12 employees on site at any one time, including the business owner and manager; 7. that this food establishment shall provide trash receptacles as approved by the city consistent with the streetscape improvements and maintain all trash receptacles at the entrances to the building and at any additional locations as approved by the City Engineer and Fire Department; 8. that the business shall provide litter control along all frontages of the business and within fifty (50) feet of all frontages of the business; 9. that an amendment to this Conditional Use Permit shall be required for delivery of prepared food from this premise; 10. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 11. that if this site is changed from any food establishment use to any retail or other use this Conditional Use Permit shall become void and a food establishment shall not be replaced on this site; 12. that seating on the sidewalk outside the food establishment shall require an encroachment permit and shall conform to the requirements of any encroachment permit issued by the city; 13. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this Conditional Use Permit; 14. that the conditions of the Chief Building Official's January 30, 2009, memo, the City Engineer's February �� Commercial Design Review and Conditional Use Permit Amendment 1241 Burlingame Avenue 10, 2009, memo, the City ArborisYs February 11, 2009 memo, the Fire Marshal's February 9, 2009, memo, and the NPDES Coordinator's February 3, 2009, memo shall be met; 15. that automatic irrigation shall be provided to all proposed street trees in the City's right of way along Park Road; 16. that all proposed planters located within the public right-of-way shall be revised to meet Public Works standards, shall require an encroachment permit from the Public Works Engineering Division, shall be maintained by the business owner, and shall be able to be moved inside the store at the end of each business day so that they do not create a safety and liability issue for pedestrians using the sidewalk; 17, that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 18. that prior to issuance of a building permit for construction of the project, the project construction plans shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved plans throughout the construction process. Compliance with all conditions of approval is required; the conditions of approval shall not be modified or changed without the approval of the Planning Commission, or City Council on appeal; 19. that the project shall comply with the Construction arid Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 20. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; 21. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2007 Edition, as amended by the City of Burlingame; THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION: 22. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the property owner or contractor shall provide the certification under penalty of perjury. Certifications shall be submitted to the Building Department; and 23. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans. Community Development Director Meeker briefly presented the project description. There were no questions of staff. Chair Cauchi opened the public comment period. Clarified that Sakae restaurant must be closed to permit Peet's to open. Asked for an explanation why there is a limitation to one restaurant on this site (Meeker/Brooks — explained that the restrictions on properties containing restaurants were set when Sub-Area A was created). Jeff Haywood, 1400 Park Avenue, Emeryville; and Terry Horn, 405 Primrose Road; represented the applicant. Indicated that PeeYs is trying to minimize changes to the building farade. Commission comments: ■ Asked about the difference in the size of the seating area between the Sakae restaurant space and the proposed Peet's (Haywood — roughly an increase of 100 square feet). ■ W hat will be done with trash receptacles (Haywood — trash area will be at rear of property within the purview of the property owner; at the same location as the area used by Sakae). ■ Asked if people will arrive at the corner entry and leave out the side door (Haywood — that is the design intent). ■ People may want to enter from the side given the location of the parking lot; perhaps provide a treatment above the side door to make it more inviting, consider repeating the treatment from the main entry. ■ Consider a window on the Park Road fa�ade. ■ Outdoor seating is good idea; has nice exposure to the sun; will be popular ■ Install enough electrical outlets for computer users within the tenant space. ■ Asked if there is room for an additional tree along Park Road (Haywood — there are a lot of other items along the sidewalk in the area; may be difficult to achieve; want to keep the corner clear to provide view of signage). ■ Will the existing soffit under the awning be attractive and maintainable (Haywood — appears to be workable; intend to restore it as original feature). ■ How will trash in the outdoor seating area be monitored (Haywood — signage, outdoor receptacles, staff training. Brooks — Public Works may require a receptacle in the outdoor seating area). ■ Asked if Sakae is being forced to leave (Horn — Have moved to a location on California Drive. Noted that the applicant would like consideration for the trash enclosure to be constructed of a material other than cinder block to provide more flexibility as needs change). Will be a good move; the back door is a good idea given the location of the parking. Should have something for trash outside of the business for the convenience of the customer. There were no other comments from the floor and the public hearing was closed. CommissionerAuran made a motion to place the item on the Consent Calendar when complete. This motion was seconded by Commissioner Yie. Discussion of motion: Provided direction to staff to work with applicant to ensure greater flexibility in the design for the trash enclosure. If the side door becomes more elegant, or another tree is added, concerns about the Park Road elevation are alleviated. Chair Cauchi called for a vote on the motion to place this item on the Consent Calendar when plans have been revised as directed. Explain why the proposed use at the proposed location will nof be detrimental or injurious to property or improvements in the vicinity or fo public healfh, safety, general welfare or convenience. How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlight/shade, views from neighboring properties, ease of maintenance. Why will the structure or use within the structure not aff�ct the public's health, safety or general welfare? Public health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water supply safety, and thing which have the potential to affect public health (i.e., underground storage tanks, storage of chemicals, situations which encourage the spread of rodents, insects or communicable diseases). Public safety. How will the structure or use within the structure affect police or fire protection? Will alarm systems or sprinklers be installed? Is the proposal accessible to particular segments of the public such as the elderly or handicapped? 2. How will the proposed use be located and conducted in accordance with the Burlingame Genera/ Plan and Zoning Ordinance? Ask the Planning Department for the general plan designation and zoning district for the proposed project site. Also, ask for an explanation of each. Once you have this information, you can compare your proposal with the stated designated use and zoning, then explain why this proposal would fit accordingly. 3. How will the proposed project be compafible with the aesthetics, mass, bu/k and characfer of the existing and pofential uses on adjoining properties in the general vicinity? How does the proposed structure or use compare aesthetically with existing neighborhood? If it does not affect aesthetics, state why. Rev 06.2007 CUP.2007.FRM w City of Burlingame Conditional Use Permit Application 1.) The proposed use will not be detrimental to public health. Peet's Coffee will be proposing a new trash enclosure area solely for our use. We will also be recycling most material we use. We have no hazardous materials on site whatsoever. We will have a grease trap installed in our space and a backwater valve installed at the point of the sewer connection as required. The proposed use will not be detrimental to public safety. The space is fully sprinklered and alarm systems will be installed. Peet's intends to follow all code requirements in terms of occupancy and egress from our space as well. Peet's takes great pride in maintaining very clean stores and we will maintain a very clean outside seating area as well. This proposal will be good for the community and adjacent tenants as well. This project will be consistent with the city's policy and goals for development. New Peet's Coffee and Tea locations consistently improve the pedestrian flow and general retail attraction wherever we are located. The proposed use will not be detrimental to public convenience as our current location is two storefronts down from our new proposed location. This store will be closing at the same time we open the new location. So the affects on parking should not change from what they currently are. 2.) The proposed use will be located and conducted in accordance with the Burlingame General Plan and Zoning Ordinance. 3.) The proposed use will not affect the aesthetics of the existing neighborhood as we will be maintaining and reusing most of the existing construction that we are building into. There will be no change to the structure except the removal of the existing awning. We will also be cleaning up and repainting any areas that require this. Although not shown on the plans we anticipate that, if exterior changes to the building are required to provide a code-compliant accessible entry, those changes to the exterior will be brought forward with this submittal. Currently, Sakae Sushi, is operating as a food establishment at 240 Park Road, which is located on the same parcel as 1241 Burlingame Avenue. In order for the proposed limited food service to receive the final on its building permit, Sakae Sushi must be permanently closed as a food establishment on this parcel. Project Description: The applicant is proposing to remodel and expand the corner unit on the ground floor of an existing two-story commercial building at 1241 Burlingame Avenue, zoned C-1, Subarea A, Burlingame Avenue Commercial Area. The parcel is located at the southeast corner of Burlingame Avenue and Park Road. The applicant, PeeYs Coffee and Tea, is currently located 1309 Burlingame Avenue and has indicated that the existing store location would be closing at the same time that the new location is opening. This project is subject to Commercial Design Review per CS 25.57.010 c. Fa�ade changes are proposed on both Burlingame Avenue and Park Road. The remodel includes expansion of the corner unit at 1241 Burlingame Avenue into a portion of the next door unit at 1235 Burlingame Avenue. It also includes relocation of the entry door system and window system for 1235 Burlingame Avenue along the Burlingame Avenue frontage. A new dark bronze aluminum/glass door is proposed along the Park Road frontage. Lastly, the existing awning will be removed and the existing "fluted metal" behind the awning will be exposed. At this time, no changes are proposed to the second story of the building. As part of the project, the applicant is proposing to replace an existing full service food establishment (on the same parcel but in a different building) with one new limited food service. A Conditional Use Permit Amendment is required to change the food establishment classification from full service food establishment (Sakae Sushi at 240 Park Road) to limited food service and for an increase in the seating area (CS 25.36.042 d, 1). This project will be consistent with the city's policy and goals for development. New Peet's Coffee and Tea locations consistently improve the pedestrian flow and general retail attraction wherever we are located.
