Since there was no appeal to or suspension by the City Council, the March 9, 2009, Planning
Commission approval of your application for Commercial Design Review and Conditional Use Permit
Amendment became effective March 19, 2009. This application was for fa�ade changes to an
existing commercial building and for a change in the classification of a food establishment at 1241
Burlingame Avenue, zoned C-1, Burlingame Avenue Commercial Area, Sub-Area A.
The March 9, 2009 minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped February 25, 2009, sheets CS-1, SP-1, SP-2 and P-1 through P-5;
2. that the canopy over the Park Road entry to the space shall be designed to included the
"fluting" feature that is a feature on the canopy over the primary entry at the corner of the
space; additionally, the door at this location (on Park Road) shall be reversed to swing into
the space in a manner that permits customers to easy enter the main area of the space, if
allowed per the Building Code.
3. that this business location occupied by a limited food service, with 360 SF of on-site seating
may change its food establishment classification only to a full service restaurant or bar upon
approval of a Conditional Use Permit Amendment for the establishment change; the criteria
for the new classification shall be met in order for a change to be approved;
4. that the 360 SF area of on-site seating of the limited food service shall only be enlarged or
extended to any other areas within the tenant space by an amendment to this Conditional
Use Permit;
5. that any changes to the size or envelope of building, which would include changing or
adding exterior walls or parapet walls, shall require an amendment to this permit;
6. that any changes to building materials, exterior finishes, windows, architectural features,
roof height or pitch, and amount or type of hardscape materials shall be subject to Planning
Division or Planning Commission review (FYI or amendment to be determined by Planning
staff);

that this limited food service may be open seven days a week, from 5:30 a.m. to 9:00 p.m.,
with a maximum of 12 employees on site at any one time, including the business owner and
manager;
that this food establishment shall provide trash receptacles as approved by the city

consistent with the streetscape improvements and maintain all trash receptacles at the
entrances to the building and at any additional locations as approved by the City Engineer
and Fire Department;
9. that the business shall provide litter control along all frontages of the business and within
fifty (50) feet of all frontages of the business;
10. that an amendment to this Conditional Use Permit shall be required for delivery of prepared
food from this premise;
11. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
12. that if this site is changed from any food establishment use to any retail or other use this
Conditional Use Permit shall become void and a food establishment shall not be replaced
on this site;
13. that seating on the sidewalk outside the food establishment shall require an encroachment
permit and shall conform to the requirements of any encroachment permit issued by the
city;
14. that any changes to the floor area, use, hours of operation, or number of employees which
exceeds the maximums as stated in these conditions shall require an amendment to this
Conditional Use Permit;
15. that the conditions of the Chief Building Official's January 30, 2009, memo, the City
Engineer's February 10, 2009, memo, the City Arborist's February 11, 2009 memo, the Fire
Marshal's February 9, 2009, memo, and the NPDES Coordinator's February 3, 2009, memo
shall be met;
16. that automatic irrigation shall be provided to all proposed street trees in the City's right of
way along Park Road;
17. that all proposed planters located within the public right-of-way shall be revised to meet
Public Works standards, shall require an encroachment permit from the Public Works
Engineering Division, shall be maintained by the business owner, and shall be able to be
moved inside the store at the end of each business day so that they do not create a safety
and liability issue for pedestrians using the sidewalk;
18. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;
19. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall not
be modified or changed without the approval of the Planning Commission, or City Council
on appeal;
20. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full

demolition of a structure, interior or exterior, shall require a demolition permit;
21. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
22. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2007 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
23. that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is no
licensed professional involved in the project, the property owner or contractor shall provide
the certification under penalty of perjury. Cer�ifications shall be submitted to the R�ilding
Department; and
24. that prior to final inspection, Planning Department staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has been
built according to the approved Planning and Building plans.
Reimbursement of the Design Review deposit will be processed and will be mailed to the property
owner under separate cover.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is
made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

1) On the plans specify that this project will comply with the 2007 California Building Codes (CBC).
2) Anyone who is doing business in the City must have a current City of Burlingame business
license.
3) Provide fully dimensioned plans.
4) Provide existing and proposed elevations.
5) Show the distances from all exterior walls to property lines or to assumed property lines
6) Show the dimensions to adjacent structures.
7) Provide a complete demolition plan that indicates the existing walls, walls to be demolished, new
walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building Permit
is issued for the project.
8) Comply with the 2005 California Energy Efficiency Standards for low-rise residential / non-
residential buildings. Go to http�//www.enerqv.ca.qov/titie�4 fior publications and details.
9) On the plans show that all openings in exterior walls, both protected and unprotected, will comply
with Table 704.8. Provide a table or chart that specifies 1) the openings allowed and; 2) the size
and percentage of the openings proposed.
10) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable lot coverage. Consult the Planning Department for details
if your project entails landings more than 30" in height.
11) Provide handrails at all stairs where there are four or more risers.
12) Provide lighting at all exterior landings.
13) On your plans provide a table that includes the following:
a. Occupancy group for each area of the building
b. Type of construction
c. Allowable area
d. Proposed area
e. Allowable height
f. Proposed height
g. Proposed fire separation distances
h. Exterior wall and opening protection
i. Allowable
ii. Proposed
i. Indicate sprinklered or non-sprinklered
14) Illustrate compliance with the minimum plumbing fixture requirements described in the 2001
International Building Code, Appendix Chapter 29, Table A-29-A.
15) Separate toilet facilities are required for each sex, except:
a. Residential occupancies
b. Occupancies serving ten or fewer people may have a toilet facility for use by more than
one person at a time, shall be permitted for use by both sexes.
c. Business and Mercantile occupancies with 1500 square feet or less may have a toilet
facility for use by no more than one person at a time, shall be permitted for use by both
sexes. CPC 412.3
16) Show compliance with all accessibility regulations found in the 2007 CBC for existing buildings
including:
a. Accessible paths of travel
b. A level landing must be provided on each side oi the door at ail required entrances and
exits.
c. Accessible countertops
d. Accessible bathrooms
e. Accessible parking
Note 1: The entry on Park Road although not a required exit must comply with all accessibility
requirements including provisions for a minimum 60" level landing on the exterior side of the door.
Note 2: In the pre-application meeting we discussed accessibility at the main entry door. Although not
shown on the plans we anticipate that, if exterior changes to the building are required to provide a
code-compliant accessible entry, those changes to the exterior will be brought forward with this
submittal. Changes made to the exterior after the permit has been issued will require Planning
Commission approval and could delay occupancy and business opening.
17) Provide an exit plan showing the paths of travel
18) All NEW non-residential buildings must comply with the requirements of AB-2176 Sec. 42911 (c)
[2003 — 2004 Montanez) as follows:
a. Space for recycling must be a part of the project design in new buildings.
b. A building permit will not be issued unless details are shown on the project plans
incorporating adequate storage for collecting and loading recycled materials.
19) Sewer connection fees if applicable, must be paid prior to issuing the building permit.

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution from construction
activities. Project proponent shall ensure all contractors implement Best
Management Practices (BMPs) during construction.
Include a list of BMPs and an erosion and sediment control measures plan, as
project notes, when submitting plans for a building permit. Please see attached
