Previous Use: retail clothes and accessories Proposed Use: party store with the sale of ice cream, cotton candy, popcorn, snow cones, candy, balloons, cards, and gifts Allowable Use: take out services associated with a retail use Summary: The applicant is proposing a party store with retail sales of ice cream, cotton candy, popcorn, snow cones, candy, balloons, cards, and gifts. With approximately 4,000 SF the business will be located in one half of the old Woolworth store on Burlingame Avenue. The other half of the building is leased to a retail luggage store. Take out food sales require a special permit in the C-1 zoning district. The retail store will be open Monday through Saturday 9:00 A.M. to 7:00 P.M. and Sunday 10:00 A.M. to 5:00 P.M.. They anticipate a maximum of three employees today, with a projection of six employees in five years. A maximum of 75 customers are expected during the weekends with a projection of 125 in five years. The maximum number of customers and employees on site at any one time is thirty (30). No parking is required for first floor retail in Subarea A of the C-1 zoning district. Parking is available along the street and in the public parking lots along Donnelly, Primrose, and Lorton Avenues. The container shall be purchased and maintained by the applicant. Also the store'shall clean up debris within 50' of the store front. The Fire Marshal (August 3, 1994 memo) and Chief Building Inspector (August 9, 1994 memo) had no comments. Required Findinqs for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planninq Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: Conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped July 20, 1994 Store Floor Plan (8Z" X 14") and August 2, 1994 Sheet 1, General Structure Floor Plan (11" X 17"); 2. that the conditions of the City Engineers' August 8, 1994 memo shall be met; 3. that the business will be open 9:00 A.M. to 7:00 P.M. Monday through Saturday and 10:00 P.M. to 5:00 P.M. Sunday with a maximum of six employees at any one time; 4. that the applicant shall provide and maintain at least daily, more often if necessary, a trash receptacle at the door along Burlingame Avenue, or at locations approved by the City Engineer and Fire Department; 5. that the applicant shall remove once a day or more frequently, all take out debris in front of the store and within 50' of the store; and 2 , :r , ' . Monday through Saturday and 10:00 P.M. to 5:00 P.M.
