Summary: The applicant is requesting a special permit to conduct educational diagnostic and
tutoring sessions for children, adolescents and adults with learning disabilities from 1229
Burlingame Avenue, Suite #18. Code section 25.36.032, ld states that schools/classes in the
C-1 subazea A must get a special permit, may only locate above the first floor and should
operate outside of regular retail hours.
The applicant will be administering diagnostic tests for the determination of learning disabilities
in order to identify the most appropriate method of teaching her students. The teaching sessions
will be one on one with occasional testing of two people at the same time. The days and hours
of operation are Monday through Friday 3:00 P.M. to 7:00 P.M. and occasional morning for
testing. The hours between 8:00 A.M. and 5:00 P.M. are considered to be within normal
business hours.
The previous use of this site was ofiice. The present proposed use is classiiied as ofiice with
class/instructional use. No additional parking is required for the proposed use. The site is
presently non-conforming in pazking since no parking is provided on site.

There are no changes proposed to the structure.

Meets all other zoning code requirements.
Staff Comments: The Chief Building Ofiicial, Fire Marshal and the City Engineer had no
comments.

SPECIAL PERMIT
1229 BURLINGAME AVE.
Required Findings for a Special Permit:
In order to grant a Special Permit the Planning Commission must find that the following
conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public
health, safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the
Burlingame general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it
deems necessary to secure the purposes of this title and to assure operation of the use in
a manner compatible with the aesthetics, mass, bulk and character of existing and
potential uses on adjoining properties in the general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Reasons
for any action should be clearly stated for the record. At the public hearing the following
condition should be considered:
Conditions:
1. that the 165 SF± in Suite #18 shall be used as set forth in the documents dated March
12, 1995 and any future tenant improvement shall be reviewed by the Planning
Department prior to applying for a Building permit;
2. that the days and hours of operation shall not exceed Monday through Friday 8:00 A.M.
to 7:00 P.M. with testing in the mornings and on Saturdays;
3. that this business shall be a sole proprietor operation and any addition of
employees/partners operating from this site shall require an amendment to this special
permit;
4. that no more than one student shall be taught during an single session and no more than
two students shall be tested in a single session, a 15 minute break sha11 be provided
between sessions; and
5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire
Codes as amended by the City of Burlingame.

Neighboring properties will not be affected by my business because the nature
of my services do not negatively impact air quality or in anyway hinder or
infringe on public health. Public safety is not an issue because the usage
within this structure will not create a nu�ance or need for police or fire
protection. There is no nsed to utilize or store flammable or hazardous
materials. There is a social benefit to this business, in that individuals
will hopefully be encouraged to develop their academic skills - and in becominq
literate and competent, be able to beneficial3y contri�ute to society. This
is a convenient location because there is easy access to a public parking
lot (when it is necessary), and there is also convenient access for curb side
drop off. It is an appropriate location for the type of clients I will see.

This site will be used for Educational Therapy services. This will include
the evaluation and remediation of young children, adolescents and adults with
specific learning disabilities. This type of service-orientated business is
in compliance under the label of "tutoring/education" with the Burlingame
General Plan and Zoning Ordinance.

The proposed use of this site will only improve the aesthetics of this
building which has been a commerical office building for nearly 50 years.
There will be no structural change to the building. I do not feel this
business will negatively impact the character of the neighborhood in anyway.
The flow of clients is very minimal, thus the traffic and parking will not
be influenced. Presenting the business to this location will hopefully
positively influence the neighborhood, in that a nurturing service-orientated

An educational. t:herapist works �n the educational domain with individ-
ual clients who ?xhibit specific learning disabiiities and learning
style chai.lenges. (Please r�fer t� enclosed �roc:.zure "Association of
Educ«tional Therapists" of which I am a Professional t4ember). These
services are �usually rendered a�ter school, some .i.nitial testina �.
sessions are scheduler� during school hours.
The nature of these sessions are a on�-on-or.e forvnat. Smaii qroup in-
struction is a possibility, with the maximu�n number af c�ients at one
time being two. (This is �n option I h�ve n�ver employed in my owra
work ethics.y
This wor.k may encompass a vast range of a�e� from elementary scnooi
through adult age c�ients.
In the future 3 see my business hopefu�ly expanding to inc�ude more
testing and remediation. I hope tG someday �collaborate my work and

the field of �earning disabilities.
T'esting usual�y entails �wo (3 hour} sessions admin.istering a coqnitiv�:
and academic battery of tests. Tt�Pse tests are scored and a report is
written which reflects zne learnirig style findings. Once this infar-
mation is ascertained a remecaiatinn pl�n is �e�igned wnich will ulti-
mately enable the clier�t �o �e tauaht to ;zis/h�r strengths with the
intent of remediating any inh�erent �veaknesses.
Tn.e duration of r�medi3tion is �nti:rely up to t��e inciividual ne�d.
Generally an initial seme�ter commitment �s establi�hed, at the end
of this time a re-evaluation review is set up to consider cflntinuing
remediation services.
I am seeing as special ec�ucation legislation and se.rvices change, and
the demands o� society incrsase, the role of an edu�ation�� therapist
is gaining respecatable notoriety.

*(Specific) learning disability means a disorder in one ot more
of the basic psychological processes involved in understand-
ing or in using language, spoken or written, which may
manifest itself in an imperfect ability to listen, think, speak,
read, write, spell or to do mathematical calculation. The term
includes such conditions as perceptual handicaps, brain injury,
minimal brain dysfunction, dyslexia and developmental apha-
sia.
