Cochran 1229 Burlingame Ave., #15 Burlingame, CA 94010 Dear Ms. Cochran: Since there was no appeal to or suspension by the City Council, the March 14, 1994 Planning Commission approval of your Special Permit and Parking Variance applications became effective March 21, 1994. This application was to allow singing classes at 1229 Burlingame Avenue, Suite 15, zoned C-1, Subarea A. The March 14, 1994 minutes of the Planning Coaimission state your application was approved with the following conditions: 1. that the use shall occupy 570 SF as shown on the plans sub;c« �L�� tc t?�e p 1 a nninq Department date stamped November 10 , 1993; 2. that the days and hours of operation shall never exceed 3 week days, between 2:00 P.M. and 8:00 P.M., there shall be no classes on Saturday; 3. that no more than one student shall be taught during a single lesson, with a 15 minute break between lessons and the total number of lessons shall not exceed eight (8) students in a single day; 4. that any changes to the days and h�urs of operation or the number of students taught in one day shall require an amendment to this special permit; and 5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered b�i the Planning Commission if application is made before the end of the first year. SPECIAL PERMIT AND PARKING VARIANCE FOR SINGING CLASSES 1229 BURLINGAME AVENUE, SUITE 15, ZONED C-1 SUBAREA A, BURLINGAME AVENUE COMMERCIAL AREA (BRUCE KIRKBRIDE, PROPERTY OWNER AND MARIE B. COCHRAN, APPLICANT). Reference staff report, 3/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration at the public hearing. Chm. Deal opened the public hearing. Marie Cochran, applicant, 5541 Corte Sonora, Pleasanton, addressed the Commission. There were no other comments and the public hearing was closed. Commissioners commented: that the use has existed at this site for some time without complaints; that there is nothing exceptional about the property to justify not meeting the requirements, no unreasonable loss shown if outside business hours, an office which is permitted could go in. C. He noted in finding exceptional 'rcumstances that the house slab and grade construction and thus slig ly lower than neighbors re lting in less privacy from street; floor p n is reversed with bedroom at front so privacy is an issue. There is 5 o street right-of-way etween the inner edge of the sidewalk and the pro erty line so at its osest point the fence is 15' from the sidewalk. There were no other comm nts and the public hea 'ng was closed. C. Jacobs noted that thi is an exceptional circu tance due to the angle of the road, it is not a typical lot and c eates an optical illusion, also because of he placement of the house the back yard is in the front of the house cr ating a greater need for rivacy, she then moved to approve the applic ion, with the following onditions: 1) that the project shall confor to the plans submitted o the Planning Department date stamped Februar 10, 1994; 2) that app ication for a retroactive building permit shall be made to the Buildi Department within 30 days of action on this app ication; and 3) that he project hall meet all the Uniform Building a d Uniform Fire Code re irements s amended by the City of Burlingame. � Mo ion was seconded by C. TWO SP_�CIAL PERMITS FOR AN EXISTING CCESSORY STRUCTURE AT 1545 BERNAL AV�NUE, ZONED R-1 (PAUL R. Paul and V�rginia Malone, applicants, 1545 Be al Avenue, clarified there is only�one trellis on the property, built u er the July building permit at th front of the pump house. There is n.`plumbing in the pump house and could not possibly be used as a living sznit. A firewall was installed, with the July permit, to address a fire eparation issue and eliminated previous windows in the side walls crea 'ng a need for natural light inside the structure. Privacy is not an i sue because the windows are 9 feet or more above the ground. There were no other comments and t e public hearing was closed. C. Mink noted that this application ill not impact the neighborhood and included the comments made in the staff report and in the testimony, he then moved to approve th� application, by resolution, with the following amended and added condztions: 1) that the project Page -3- �
