All other zoning code requirements have been met. Staff Review City staff have reviewed this application and had no comments. Applicant's Letter The applicant notes in his special permit application that he has few customers that visit his office. Most of his time is spent in phone calls and paperwork with outside visits to customers' homes or place of business. The property owner notes in his December 6, 1991 letter that this operation has little impact on the area since there are few customer visits and there is only one additional part time employee who works at night from 5 P.M. to 8 P.M.. Study Meeting At the February 24, 1992 Planning Commission study meeting the commission asked if this business is currently in operation and for how long. The applicant responds in his February 28, 1992 letter that he has been at this address since November, 1991 when he attempted to make a Special Permit application but had difficul- ty locating floor plans for the second story of the building. The Fire Department indicates that the existing conditions on the second floor provide sufficient exiting for this building. This is a financial institution as described under definitions in Code Section 25.08.264. A mortgage broker coordinates loan applications for real estate and by law requires a real estate � 2 license. However since the primary business activity is managing finances, not buying and selling property, they are classed in our code with financial institutions. In this case, a use permit is required whether we call this a financial institution or a real estate business. Findings for a Special Permit In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. Reasons for any action should be clearly stated for the record. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submit- ted to the Planning Department and date stamped February 6, 1992 Floor Plan (8�" X 11"); 2. that Burlingame Mortgage shall operate from 9 A.M. to 8 P.M. Yes, the business, Burlingame Mortgage, is currently in operation. FEB 2 �i 1992 CITY OF BURLINGAME PlANNING DEPT Question: How long has the business been in operation? Burlingame Mortgage has been in operation since November l, 1991. I was in contact with the planning commision prior to my signing the lease in late October. The delay in my application being submitted was due to my attempt to secure the original floor plan drawings for the second floor of 1229 Burlingame Avenue, where the business is located. The owner of the building believed the floor plans might eventually turn up; unfortunately, they never did. The information I initially recieved from the planning department was that the drawings had to be to scale, and it was suggested that I may have to incur the expense of hiring a professional architect for the purpose of re- drawing the floor plan. Considering the expense involved, I thought a more prudent course of action would be to wait for the originals to surface, which, as already noted above, has yet to happen. My mortgage brokerage business consists entirely of paperwork and telephone calls. There is very little foot traffic to my office as I am the sole proprietor. Ninety percent of the time, my clients never come to my office Qven once because I do the loan application at their home or place of busine�s. I have only one clerical assistant who works four days a week, from 5pm to 8pm. 2. Discuss how the proposed use will be located and conducted in a manner in accord with the Burlingame General Plan and Zoning Ordinance. Business is located within a C-1 district under chapter 25.36.032. Its operation is permitted as a"conditional use" according to specifications under subarea A„ category (e) which reads "Real Estate and financial institutions above the first floor only, Discuss how the proposed project will be compatible with the aesthetics, mass, bulk and character of the existing neighborhood and potential uses on adjoining properties in the general vicinity. Per Code Section 25.52.020 (3), the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of Title 25 (Zoning) in the operation of the use. As mentioned above, my business causes an absolute minimal amount of disturbance in terms of noise, parking congestion, and foot traffic. 3.
