Since there was no appeal to or suspension by the City Council, the November 10, 2008, Planning
Commission approval of your application for Commercial Design Review became effective
November 20, 2008. This application was for changes to the front fa�ade of an existing commercial
building at 1223 Burlingame Avenue, zoned C-1, Sub-Area A, Burlingame Avenue Commercial Area.
The November 10, 2008 minutes of the Planning Commission state your application was approved
with the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped October 14, 2008, Sheet A0.0, and date stamped October 31, 2008, Sheets A1.0
and, A2.0; any changes to the exterior materials shall require review by the Planning
Commission;
2. that the conditions of the Chief Building Official's
2008 memos, the City Engineer's September 24
September 22, 2008, memo shall be met;
September 23, 2008 and October 14,
, 2008 memo, and the Fire Marshal's
3. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;
4. that any changes to the size or envelope of building, which would include changing or
adding exterior walls or parapet walls, moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
5. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall not
be modified or changed without the approval of the Planning Commission, or City Council
on appeal;
6. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full

demolition of a structure, interior or exterior, shall require a demolition permit;
7. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
8. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2007 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING
INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
9. that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is no
licensed professional involved in the project, the property owner or contractor shall provide
the certification under penalty of perjury. Certifications shall be submitted to the Building
Department;
10. that prior to final inspection, Planning Department staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has been
built according to the approved Planning and Building plans.
Reimbursement of the Design Review deposit will be processed and will be mailed to the property
owner under separate cover.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is
made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

1. Replace all displaced/damaged sidewalk, driveway, curb and gutter. Work
shall conform to Streetscape Master Plan where applicable.
2. An encroachment permit for pedestrian protection is required for the work
proposed to the storefront.
3. Construction is prohibited along Burlingame Avenue befinreen Thanksgiving
and New Year's Day.

1) On the plans specify that this project will comply with the 2007 California Building
Codes (CBC).
2) Prior to applying for a Building Permit the applicant must either confirm that the
address is 1223 Burlingame Avenue or obtain a change of address from the
Engineering Department. Note: The correct address must be referenced on all
pages of the plans.
3) Provide a title block on the plans that includes the name of the owner(s) and the
name, address, and phone number of the project designer. The architect must
wet-stamp and sign all plans.
4) Anyane who is doing business in the City must have a current City of Burlingame
business license.
5) Provide fully dimensioned plans.
6) Provide existing and proposed elevations.
7) Show the distances from all exterior walls to property lines or to assumed
property lines
8) Doors and/or windows cannot project into the public right of way CBC 3202.2.
Amend the plans to show that doors and windows in their fully open positi�n do
not encroach into the public right of way.
9) Provide a complete demolition plan that indicates the existing walls, walls to be
demolished, new walls, and a legend. NOTE: The Demolition Permit will not
be issued until a Building Permit is issued for the project.
10)Comply with the 2005 California Energy Efficiency Standards for low-rise
residential / non-residential buildings. Go to http�//www.enerqv.ca.qov/title24 for
publications and details.
11)Provide guardrails at all landings. NOTE: All landings more than 30" in height at
any point are considered in calculating the allowable lot coverage. Consult the
Planning Department for details if your project entails landings more than 30" in
height.
12)Provide handrails at all stairs where there are four or more risers.
13)Provide lighting at all exterior landings.
14)Show compliance with all accessibility regulations found in the 2007 CBC for
existing buildings including:
a. Accessible entry
b. Accessible paths of travel
c. Accessible countertops
d. Accessible bathrooms
e. A level landing must be provided on each side of the door at all required
entrances and exits.
15)Provide an exit plan showing the paths of travel
16)NOTE: A written response to the items noted here and plans that
specifically address items 1, 2, 3, 8, 14 a through 14 e must be re-submitted
before this project can move forward for Planning Commission action.
