SUBJECT: SIGN EXCEPTION FOR AN AWNING SIGN FOR ALL ON BOARD AT 1219 BURLINGAME AVENUE
The applicant, Farro Essalat, is requesting a sign exception for an oversized sign on
an awning at 1219 Burlingame Avenue. Code Sec. 22.28.040 limits advertising on an
awning or a canopy to a space not exceeding 8" in height. The sign on this awning/
canopy is 18" in height. The code allows 50 SF of signage on this site; the proposal.
is 5 SF, well within the allowed square footage.
Staff reviewed this request. The City Engineer, Chief Building Inspector and Fire
Marshal (August 29, 1983 memo) had no comments.
The applicant submitted a letter (July 29, 1983) explaining that they were not aware
that a permit had not been applied for by the man they hired to do the sign. They feel
that the sign is understated and that the offending item is the "F" in "Cafe" which
connects the two rows of 6" letters; and as a result the variation to the code is minor
and should be allowed. They are reluctant to change the sign because it has been in
place for some time and people have come to identify the cafe by it. Also, repainting
the sign would damage the new awning and leave marks on it. Therefore, they would like
the Commission to grant the exception.
Planning staff would point out that under the current code (Code Sec. 22.28.040) the
applicant could not stack rows of 6" letters on an awning/canopy. The code states
"sign ... shall be limited to a space not exceeding 8" in height on the sides and
front of the awning or canopy." Thus if one stacks two or three rows of 6" letters,
one has a sign space which is 12" to 18" high and exceeds the 8" in height limitation
for an awning/canopy.
To grant a sign exception the Commission must find exceptional circumstances which apply
specifically to this property. The exceptional circumstances are as follows (Code Sec.
22.06.110):
a. Any exception granted shall be subject to such conditions as will assure
that the adjustment thereby authorized shall not constitute a grant of
special privilege inconsistent with the limitations upon other properties
in the vicinity and district in which the subject property is situate; and
b. Because of special circumstances applicable to the subject property,
including size, shape, topography, street frontage, location or surrounding
land use; the size or height of the building on which the sign is to be
located; the classification of the street or highway on which the sign is
located or designed primarily to be viewed from, the strict application
of zoning regulations is found to deprive subject property of privileges
enjoyed by other properties in the vicinity and under identical zone
classification.
In summary, exceptional circumstances which could be considered for this site might
include that the amount of signage on the site is well under that allowed by the Sign
Code; that since the entrance to this property is set back from the street, signage
on the awning is more justif5ed because signage on the face of the building within
the 8-10' height from the ground would be difficult for pedestrians approaching on the
sidewalk to see.

The Planning Commission should hold a public hearing. To grant a sign exception the
Commission must identify exceptional circumstances existing on this property. At the
public hearing the following condition should be considered:
1. that the signage on the site be limited to that shown in the plan
date stamped August 1, 1983 and that the sign be maintained according
to that plan.

Re: Sign Exception Application
We contractecl out the sign as a package to a P/Ir. Victor
Shapona who claimed he had done many such signs on Bur-
lingar:le Avenue, understanding that he would take care of
an,y permits and ordinances appertaining to such signs, and
it was a surprise to us to receive a notice stating other-
wise. The main problem seems to be with the "F" of the
"Cafe" connecting through to the "N" on the line below and
giving the impression of a longer "F". The sign, as it
exists, is understated and subtle and does not jar with
any other signs and awnings in the vicinity of the Cafe,
and we feel that although unknowingly it does not comply
to the ordinance, the slight difference could be construed
as artistic license and an exception could be approved.
Furthermore, the sign has now become associated with the
Cafe and changing it could damage the image which has been
built up. Trying to paint out the sign would damage the
new awning and leave marks, s�oiling the present quality
of the sign and awning which by general consensus of opin-
ion is an attractive addition to Burlingame Ave. There-
fore, we would appreciate your favorable consideration of
this application for a sign excention.
