Ordinance: In October 1999, the City Council adopted Ordinance 1619 which makes all food
establishments in the Burlingame Avenue commercial area, Subarea A, and the Broadway commercial
area conditional uses. The City Council also adopted Resolution 111-1999, which includes a Food
Establishment by Type Table establishing the location, type and seating area for each food establishment
in each commercial area. Some of the existing food establishments within these areas already have
conditional use permits for take-out, delivery services and/or expansions. The ordinance requires that
these establishments obtain amendments to their existing conditional use permits to reflect the
requirements of the new ordinance.
In order to facilitate for merchants and property owners the transition to the new requirements and to
provide them with an opportunity to clarify their establishment's operation, the City has initiated the
conditional use permit application at no cost to the owner or merchant.
Summary: In August 1996, the Planning Commission approved a conditional use permit for a 33 %
increase in floor area and take-out food for an existing food establishment business, Copenhagen Bakery,
at 1216 Burlingame Avenue (September 4, 1996 approval letter and August 12, 1996 P.C. Minutes).
Since Copenhagen Bakery currently has a conditional use permit for an expansion and take-out food,
this application is for an amendment to the existing conditional use permit as required by Ordinance
1619. The Food Establishment Table by Type defined the food establishment located at 1216
Burlingame Avenue as follows:

The current food establishment located at 1216 Burlingame Avenue, Copenhagen Bakery, is classified
as Full Service with 980 SF of on-site seating. In the July 1998 survey for Copenhagen Bakery, it was
noted that at this premise food is ordered and paid for before consumption and that food is served on
ceramic plates with metal flatware. The applicant noted that for dinner, food is paid for after
consumption. During the public hearings on the ordinance and implementing tables, the information
on the survey gathered by Planning staff was not disputed by the merchant or property owner.

Staff Comments: The City Engineer and Chief Building Official reviewed the ordinance and
classifications and had no comments. The Fire Marshal forwarded to staff a copy of an enforcement
letter (dated December 14, 1999) in which he notified the current property owner and merchant that
they have not connected the on-site fire sprinkler system to the water supply in the adjacent public right-
of-way. He notes that if this connection is not made by February 1, 2000, the Fire Department will
require the merchant to vacate the 1875 SF in the basement and 1875 SF on the first floor which was
granted in the expansion approved by conditional use permit on September 3, 1996. A review of the
plans for this site indicate that vacating the additional area approved by the Commission in September
1996 would reduce the seating area on this site from 980 SF to 248 SF. Such a change would result in
a reclassification of this food establishment since a full service food establishment requires a minimum
of 250 SF. The appropriate classification for a bakery would be Limited Food Service which allows
a maximum of 250 SF of seating area. It should be noted that as of January 5, 2000, all building
permits had expired for this site and no applications for permits to connect the fire sprinkler system
have been made. An encroachment permit for work in the public right of way is also required.
Based on these safety concerns, the conditions on this application should be modified so that if the
sprinkler system is not connected by February 1, 2000, and the expansion area is required to be vacated,
the food establishment classification shall automatically change to Limited Food Service Food
Establishment and the seating area be defined as 248 SF. This would mean that when the property
owner and merchant decide to connect the sprinkler system to the water service, they would have to
apply for an amendment to their conditional use permit so that the Planning Commission could review
the impact of the enlarged seating area and change in classification in the context of the parking and
other issues which affect the area at that time.

Criteria for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general
plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining
properties in the general vicinity.
Findings for This Conditional Use Permit: Since the current regulations limit the number of food
establishments to those in the area as of November 1999 and then as approved by City Council
Resolution No. 111-1999 on October 18, 1999, and this business meets those criteria and the business
will operate within the limits established by that ordinance, the use will not be detrimental to the city's
objective of promoting pedestrian oriented retail activity in this commercial area and will be in
compliance with the general plan for the area; and since the business shall be required to comply with
all the city regulations including providing trash receptacles and litter maintenance in the surrounding
area, signage, meeting building code requirements, and adhering to County health requirements, the
operation will be compatible with the character of the commercial area.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action should be clearly stated for the record.
At the public hearing the following conditions should be considered (conditions from the previous
conditional use permit are in italics, changes to these are shown in standard type face):
1. that if the on-site fire sprinkler system is not properly connected to the water supply to the
satisfaction of the City Engineer and Fire Marshal by February 1, 2000, this business location
presently occupied by a full service establishment, with 980 SF of on-site seating, shall have its
food establishment designation changed to Limited Food Service Food Establishment with a seating
area of 248 SF; with either designation this site may change its food establishment classification
only to a full service, limited food service or bar upon approval of a conditional use permit for
the establishment;
2. that the 980 SF area of on-site seating of the full service food establishment may be enlarged only
by an amendment to this conditional use permit;
3. that an amendment to this conditional use permit shall be required for delivery of prepared food
from this premise;
4. that there shall be no food sales allowed at this location from a window or from any opening within
10' of the property line;

5. that if this site is changed from any food establishment use to any other retail use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
6. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped June 24, 1996, Sheets 1, 2, A-1 and A-2 with the change that the door at the rear from
the site into the parking be relocated so that it leaves the parking space unobstructed;
7. that the conditions of the Fire Marshal's June 24 and July 15, 1996 memos and the Chief Building
Inspector's July 15, 1996 memo shall be met;
8. that a maximum of 3625 SF of the basement area shall be used for food assembly, the remaining
1875 SF shall be used for storage only;
9. that the hours of operation for the business shall not exceed the hours of 6 a. m. to 10 p. m. daily,
with a maximum number of employees of 17, including the manager on site, on site at one time;
10. that seating on site, inside, shall not exceed 110 and seating outside shall conform to the
requirements of any encroachment permit issued by the city;
11. that the applicant shall purchase and maintain at least once a day, more often if necessary, two
trash receptacles placed on the sidewalk outside the building at a location approved by the City
Engineer; these two trash receptacles shall be of the type approved by the city as a part of the
streetscape plan adopted by the City Council and shall be installed no later than January 1, 1997;
12. that all deliveries to this business shall be made from the Donnelly Avenue side of the premise;
13. that the applicant shall remove once a day or more frequently if the City determines it to be
necessary, all debris on the sidewalk, on sidewalk tables fronting this premise, in the gutter and
in planters within 50 feet of the store; and
14. that the project shall meet all the requirements of the California Building and Fire Codes 1995
Edition as amended by the City and that any lack of compliance with these conditions or change
to the business or use on the site which results in a change which would affect any one or more of
these conditions shall require an amendment to this use permit.

Dear Mr. Nielsen,
Since there was no appeal to or suspension by the City Council, the August 12, 1996 Planning
Commission approval of your special permit and take-out permit became effective September
3, 1996. This application was to allow expansion of a food establishment and take-out for the
bakery and cafe at 1210-1216 Burlingame Avenue, zoned C-1, Subarea A.
The August 12, 1996 minutes of the Planning Commission state your application was approved
with the following amended conditions:
1. that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped June 24, 1996, Sheets l, 2, A-1 and A-2 with the
change that the door at the rear from the site into the parking be relocated so that
it leaves the parking space unobstructed;
2 that the conditions of the Fire Marshal's June 24 and July 15, 1996 memos and
the Chief Building Inspector's July 15, 1996 memo shall be met;
3. that a maximum of 3625 SF of the basement area shall be used for a food
assembly, the remaining 1875 SF shall be used for storage only;

Reference staff report, 8.12.96 with attachments. CP Monroe discussed the request, reviewed
criteria, Planning Department comments, and study meeting questions. Nine conditions were
suggesteti. Commissioners asked if the occupancy numbers had been reviewed by the Fire
Department, yes; why is the future seating shown as a range; why were phasing plans not submitted
for coordinating.this expansion with the seismic retrofit. Staff explained that phasing plans were
not requested since at no time during the retrofit would the limits in terms of seating, use areas,
or employees being requested here be exceeded.
Chairman Ellis opened the public hearing. Ralph Nielson, 1210-1216 Burlingame Avenue, the
applicant, spoke. He noted that this is their twentieth year at this location; the expansion was
prompted by the retrofit, they had the choice of paying more for less space after tl�e retrofit or to ,
expand after the retrofit with the opportunity to have more flexibility during the retrofit construction
period; the seating numbers are flexible at this time since they have not done a final layout; their
objective is the improve the bakery witt� additional space for better display, get a real lcitchen for
the cafe and get better seating. Difference between high and low is 40 seats over existing that is
a lot of seating; additional seating will benefit people already in city who will go elsewhere to eat
if th�re are no seats in the cafe, therefore they accommodate people already in the area. The
maximum number of seats will be 110, �if the applicant wishes the number may be fewer, not more.
Applicant noted that any plans for the use of the bakery's parlflng spaces at the rear will have to
meet with the approval of the landlord; applicant would like to designate two of these for
customer's picking up items. The business does not intend to supply small bakeries elsewhere.
Wayne Lassiter, 1208 Burlingame, spoke noting that he has no objection to the retrofit, in fact it
benefits him. However, he notes that parking on this site obstructs a private easement at the rear
of his property. His property fronts on Burlingame Avenue. The City Attorney noted that this is
a private matter, not involving the city or this application. There were no further comments and
the public hearing was closed.
The commission discussed the application: the Chief Building Official noted the need to realign
the parking space for the door swing, it would be better to move the door away from tfie parking
space; no problem with the expansion, this business has been at this location a long time unfortunate
for it to go someplace else; many restaurants the same size have more than 110 seats, this would
be one of the smaller on this block; the parking spaces at the back are hard to find, difficult to use,
not a good place for customers to use, prefer available for deliveries or on site tenants.
Commissioner Deal moved to approve the two special permits �for food establishment expansion and
take out, by resolution, with the conditions amending condition one to show that the door at the rear
should be relocated in order to leave the parldng space unobstructed and amending condition six

to state that the applicant shall supply two trash containers along the sidewalk. The conditions as
revised follow: 1) that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped June 24, 1996, Sheets 1, 2, A-1 and A-2 with the change that the
door at the rear from the site into the parking be relocated so that it leaves the parking spaces
unobstructed; 2) that the conditions of the Fire Marshal's June 24 and 7uly 15, 1996 memos and
the Chief Building Inspector's 7uly 15, 1996 memo shall be met; 3) that a maximum of 3625 SF
of the basement azea shall be used for a food assembly, the remaining 1875 SF shall be used for

In discussion following the motion and its second, the Commissioners noted that it would be
appropriate to designate the number of approved trash containers the applicant would be required
to provide on the street, two was suggested, the maker of the motion and the second agreed to
amend condition 6 to reflect this; there was further discuss of the phasing of the project, staff noted
that after the expansion area was retrofitted, the cafe portion of the existing business would be
moved in to the newly retrofitted area while they worked on the existing cafe azea. Thus, at no
time during the retrofit process would the business exceetl the limits of this request; moreover it
can operate throughout the construction.
The motion was seconded by Commissioner Galligan and approved on a voice vote 7-0. Appeal
procedures were advised.

PERMIT AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
conditional use nermit amendment for an existin� food establishment classified as a Full Service Food
Establishment at 1216 Burlineame Avenue. zoned C-1 Subarea A, Burlin�ame Avenue Commercial Area,
APN: 029-152-330: Archie L Offield Jr 310 Pepper Avenue, Burlingame, CA 94010, propertv owner;
WI�REAS, said matters were heard by the Planning Commission of the City of Burlingame on
�anuary 10, 2000, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERNIlNED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
Article 19. 15301 - Existing Facilities, Class 1, operation of existing private structures involving negligible
or no expansion of use beyond that previously existing is hereby approved.
2. Said conditional use permit amendment is approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the of�icial records
of the County of San Mateo.

1. that if the on-site fire sprinkler system is not properly connected to the water supply to the
satisfaction of the City Engineer and Fire Marshal by February 1, 2000, this business
location presently occupied by a full service establishment, with 980 SF of on-site seating,
shall have its food establishment designation changed to Limited Food Service Food
Establishment with a seating area of 248 SF; with either designation this site may change
its food establishment classification only to a full service, limited food service or bar upon
approval of a conditional use permit for the establishment;
2. that the 980 SF area of on-site seating of the full service food establishment may be enlarged
only by an amendment to this conditional use permit;
3. that an amendment to this conditional use permit shall be required for delivery of prepared
food from this premise; ,
4. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
5. that if this site is changed from any food establishment use to any other retail use, a food
establishment shall not be replaced on this site and this conditional use permit shall become
void;
6. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped June 24, 1996, Sheets 1, 2, A-1 and A-2 with the change that the door at
the rear from the site into the parking be relocated so that it leaves the parking space
unobstructed;
7. that the conditions of the Fire Marshal's June 24 and July 15, 1996 memos and the Chief
Building Inspector's July 15, 1996 memo shall be met;
8. that a maximum of 3625 SF of the basement area shall be used for food assembly, the
remaining 1875 SF shall be used for storage only;
9. that the hours of operation for the business shall not exceed the hours of 6 a.m. to 10 p.m.
daily, with a maximum number of employees of 17, including the manager on site, on site
at one time;
10. that seating on site, inside, shall not exceed 110 and seating outside shall conform to the
requirements of any encroachment permit issued by the city;

11. that the applicant shall purchase and maintain at least once a day, more often if necessary,
two trash receptacles placed on the sidewalk outside the building at a location approved by
the City Engineer; these two trash receptacles shall be of the type approved by the city as
a part of the streetscape plan adopted by the City Council and shall be installed no later than
January 1, 1997;
12. that all deliveries to this business shall be made from the Donnelly Avenue side of the
premise;
13. that the applicant shall remove once a day or more frequently if the City determines it to be
necessary, all debris on the sidewalk, on sidewalk tables fronting this premise, in the gutter
and in planters within 50 feet of the store; and
14. that the project shall meet all the requirements of the California Building and Fire Codes
1995 Edition as amended by the City and that any lack of compliance with these conditions
or change to the business or use on the site which results in a change which would affect any
one or more of these conditions shall require an amendment to this use permit.
