Chairman Sine announced the withdra���al of this application by Charles
D. Denily. A letter w�.s read from Mr. Denny addressed to t'ne City
Planner stating that it w?s �aith regret that he h�d decidPd to �aithdr�w
his application due to public opini�n agains�:. re-zoning this tiroperty
and the length of �ime involvPd to complete the transaction. He than)ced

ation qiven. Chairman Sine commented that one of the local ne�.�snane-rs
under date of P�Iay 26 nad announced that this request for variance had

Chairman Sine announced a public hearinq on the above variance application
by Arcizie Offield and a letter r.=as read fr.om the applican�, sta�ing
in T�-rie�, tha� the second floor at this address had fo� many years
been apartments; that in 1956 t���o apartm�r_ts had been remodeled ini.o
offices, and it was �his area tha� �vas contemplated b2ing -remodelec,,
since for the past �Z yea-rs these walk-up offices had been ex�remely
hax3 to rent, and prospec�s are not encouraging; and that apartment
usage �.�ould not be inapp-rapria�e to the area.

The City Planner reported that while the buildina was originally
se� up for apartments, in the time intervening, zoning requirements
have changed. A variance �vill be required to return the space to
apartment usage. He noted that walk-up offices are very difficult to
rent over stores, and he could no objections to aparLments, even though
it does pose some probierns; that the building does e�ist and certainly
some use should be made of it.
There was no response to Chairman Sine`s request for aud�_ence comment,
and che public hearing was declared closed. During the period of
Comntission discussion, Commission�r Norberg, since he had c�rawn the
original plans, asked the City Attorney's opinion reg�.rding a
conflict of interest if he vo�.:ed. The City Attorney felt that since
the Comnussioner himself had made the disclosure, the ].enc;th of time
involved.should dispel any conflict. Commissioner Norberg th�n
stated that in his opinion there were no objections, since there already
are apartments in the building now.
Commissioner Jaco'ps felt that the city would be a lot better off
with the building rented and occupied, and Commissioner Taylor Yiad
no objections. Commissioner Kindiq questioned the City Planner about
fire pro�.ectioii in this area, and was informed that it is adequate,
although a ntotiori to approve the variance should be condi�ional to
conformance �vith the fire and building. Commi.ssioner Ki.ndi.� then commented
that if the rear doors were lef� unlocked, he had no objections.
Commissioner Cistulli had no comment, �•�hile Chai.rman Sine conli�r«n�ed
