Action alternatives are: uphold the Planning Commission's denial, reverse the Planning Commission's denial or grant a part of the applicant's request. At the hearing the following condition should be considered: 1. that the sign be installed and maintained according to the plans submitted and dated May 25, 1983 (staff) and July 12, 1983 (applicant). To grant a sign exception the Council must find that circumstances relating to the particular property exist justifying the exception. BACKGROUND: The applicant is requesting a sign exception to allow 71 SF of signage (maximum 50 SF) and to allow a 5'-5" high sign on a canopy (8" maximum allowed), Code Sections 22.14. 020 and 22.28.040). It should be pointed out that because of the ribbon and bow motif on the face of the canopy the entire face of the canopy has been defined as a sign, thus the 71 SF total. The sign was placed on the canopy without a permit. The Planning Commission reviewed this request at their August 22, 1983 meeting. The Commission denied the sign exception request 5-1 with Commissioner Taylor dissenting and Commissioner Cistulli absent (Planning Commission minutes August 22, 1983). The Commissioners' discussion of the item included concern about publicizing the existence of the Sign Code and the fact that sign regulations exist almost everywhere; concern that not only is what is on the canopy oversized, it is three dimensional; concern about the size and amount of lettering on the canopy; and the inability of the Commissioners to find any circumstances relating to the property which jus�ify exceptions to the Sign Code. Exceptional Circumstances To grant a sign exception there must be exceptional circumstances relating to the specific property. These circumstances are identified as follows (Code Sec. 22.06.110): a. any exception granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situate; and b. because of special circumstances applicable to the subject prop��ty, including size, shape, topography, street frontage, location or sur�ounding land use; the size or height of the building on which tr� s�gn is to be located; the classi�fication of the street or highway �ii which the sign is located or designed primarily to be viewed from, ihe -2 - strict application of zoning regulations is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The exceptional circumstance used by the applicant was that the name of the business is ambiguous and potential customers are unclear as to the type of service offered; therefore it needs to �e stated specifically in the signage. Physically this building and its location on Burlingame Avenue are not unique, e.g., significantly different from the other business frontages on the street. Lynae Folks, owner of The Personal Touch at 1211 Burlingame Avenue, told Commission she was not aware at the time the awning was painted and put up on their new location that there was a city ordinance which covered such signage. Danny Parodi, the co-owner of this business, advised they have owned the business for five or six years and the new awning gave them the identification they needed. Ap�licant presented a letter in further justification of this signaae. There were no audience comments and the oublic hearing was closed. Discussion: previous Commission concern about hovr to make new businesses aH�are of the Sign Code; most cities have sian codes and most businesses expect sign regulations; this awning is not only excessive signage but is three dimensional which makes it look even larger; the concern is not the awning but what is on the awning. The applicant discussed signage of nearby businesses, stating she did not feel this awning ���as inconsistent with other properties. Further Commission comments: have no objection to the bow design or the name of the business but do object to the large amount of copy material on this awning sign; cannot find circumstances to justify granting an exception for this property; this is excessive signage. Graham recognized Michael Kaindl, Dixon/Kaindl Associates who asked to speak in rebuttal. His corrunents: not asking for a variance for one stall, merely that this stall be considered for a compact car; area is zoned for condominiums, this is not the first condo in that block; we have designed an attractive project which looks residential, and the owners are trying to provide affordable housing. On roll call vote the application was denied 5-1, C. Garcia dissenting, C. Cistulli absent. Appeal procedures were advised. 6. REQUEST FOR AMENDMENT OF MASTER SIGN PERMIT AT 1200 HOWARD AVENUE, BY KING YEE CP Monroe reviewed this request to amend the master sign program approved by Commission in January, 1983. Two conditions were suggested for consideration at the public hearing. CP advised that total signage on the Post Office frontage under the Master Sign Permit was, and would remain, three signs for 23 SF of signage. She added later in the meeting that any other ground signs requested on the Lorton or Howard Avenue frontages would have to come to Commission for a Master Sign Permit amendment. Chm. Graham opened the public hearing. King Yee, applicant and property owner, addressed Commission: the "Nothing But Nails" window sign could not be easily seen and they asked for a ground sign on the side of the building facing the Post Office. City staff have reviewed this request. The Chief Building Inspector (July 26, 1983 memo), the City Engineer (July 12, 1983 memo) and the Fire Marshal (July 28, 1983 memo) had no comment. The applicant, in her sign exception request (July 12, 1983), is justifying her exception on the basis that the services offered by the business are unique and it is critical to the business that it be printed on the awning so that the public is aware of the service. Many people have complimented them on their sign. The signs improve the appearance of the building. She feels that loss of the sign would result in loss of business. Planning staff would point out that in the case of this sign, particularly the ribbon and bow motif, the entire awning face becomes a sign; hence the 71 SF. The applicant's submittal indicates the individual letter sizes. They range from 5" to 14". This sign is present on the site. Before acting on this sign exception, the Planning Commission should hold a public hearing. BACKGROUND: Following the Planning Commission's denial of her sign exception request for a 72 SF sign on an awning at 1211 Burlingame Avenue, the applicant appealed to the City Council (August 24, 1983 letter). At the meeting of September 7, 1983 Council set the appeal hearing date for September 19, 1983. Ms. Folks was notified of the date and submitted the attached letter requesting a continuation of her appeal hearing because she will be out of town on a business trip.
