Applicant: Laurent Pellet, Maison Alyzee APN: 029-152-120 Architect: Hayes Group Architects Lot Area: 2,875 SF Property Owner: Green Banker LLC Zoning: BAC General Plan: Burlingame Downtown Specific Plan: Burlingame Avenue Commercial District Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301 - Existing facilities, Class 1(a) of the CEQA Guidelines, which states that interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances are exempt from environmental review. Previous Use: The North Face, retail clothing store (currently vacant) Proposed Use: Maison Alyzee, full service food establishment Allowable Use: Full service food establishment with approval of a Conditional Use Permit Summary: The applicant, Laurent Pellet, owner of Maison Alyzee, is requesting approval of a Conditional Use Permit to operate a full service food establishment at 1208 Burlingame Avenue, zoned BAC. Planning staff would like to note that in 2012, the restriction on the number of full service food establishments was removed allowing new full service food establishments in any location within the BAC District upon approval of a Conditional Use Permit. The subject tenant space is currently vacant, but was last occupied by The North Face, a retail clothing store. The food establishment will contain customer seating, a kitchen, a display case, storage areas and restrooms. The proposed food establishment will have approximately 255 SF of indoor customer seating. The proposed tenant space measures approximately 1,975 SF in area. The proposed restaurant would serve breakfast/brunch, lunch, and afternoon meals. In his letter dated September 16, 2021, the applicant notes that Maison Alyzee offers a full menu with teas, Italian and French style coffees, savory items, salads, sandwiches, as well as viennoiseries (baked goods), pastries, and desserts. Please refer to the applicant's letter for a detailed description of the proposed food establishment. There is a Maison Alyzee currently located on Castro Street in downtown Mountain View. A full service food establishment is defined as a business which sells food prepared indoors on the premise with a full menu and provides an indoor seating area of at least two hundred fifty (250) square feet. Operating criteria to define a full service food establishment include most or all of the following: served by waiters to seated customers and where payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher; and food is served on ceramic plates with metal flatware and cloth napkins. Planning staff determined that the proposed food establishment meets most of these operating criteria. The proposed food establishment would operate weekdays from daily from 8:00 am to 6:00 pm. When the business opens, there will be up to four full-time employees and one part-time employee. The number of employees is expected to increase slightly in five years (see Commercial Application). At opening, the applicant expects approximately 105 customers per day on weekdays and 160 customers per day on weekends. Conditional Use Permit The following application is required: 1208 Burlingame Avenue ■ Conditional Use Permit for a new full service food service food establishment in an existing commercial building located within the BAC Zoning District (C.S. 25.32.070 (b) (2)). With this application, there are no changes proposed to the front fa�ade of the existing building (other than repainting and new signage), therefore this project is not subject to Commercial Design Review. Retail, personal service and food establishment uses located on the first floor within the parking sector of the Burlingame Downtown Specific Plan are exempt from vehicle parking requirements as set forth in code section 25.70.090 (a). Seating Area: n/a 255 SF at least 250 SF Off-Street Parking: 0 spaces no change no additional parking required for food establishment if located on first floor within parking sector Staff Comments: The Planning Division would note that this application was brought directly to the Planning Commission as a Regular Action Item since there is no restriction on the number of full service food establishments and there areno changes proposed to the building fa�ade. However, if the Commission feels there is a need for more discussion, this item may be placed on a future action calendar for a second review and/or public hearing with direction to the applicant. Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit for a full service food establishment, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. � Conditional Use Permii 1208 Burlingame Avenue Suggested Findings for a Conditional Use Permit: That the proposed full service food establishment use will not be detrimental to the city's objective of promoting pedestrian oriented retail activity in this commercial area and therefore will be in compliance with the general plan for the area; and that since the business shall be required to comply with all the city regulations including providing trash receptacles and litter maintenance in the surrounding area, signage, meeting building code requirements, and adhering to County health requirements, the operation will be compatible with the public's health and safety as well as with the character of the commercial area. For these reasons, the project may be found to be compatible with the requirements of the City's three conditional use permit criteria. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped September 17, sheets A0.1, A0.5 through A0.7, and A2.1; 2. that this business location to be occupied by a full service food establishment, with 255 SF of on-site customer seating area, may not change its food establishment classification; 3. that the 255 SF area of on-site seating of the full service food establishment shall be enlarged or extended to any other areas within the tenant space only by an amendment to this conditional use permit; 4. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and at any additional locations as approved by the City Engineer and Fire Department; 5. that the business shall provide litter control and sidewalk cleaning along all frontages of the business and within fifty (50) feet of all frontages of the business; 6. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; 7. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 8. that any seating on the sidewalk outside shall conform to the requirements of any encroachment permit issued by the city; and 9. that the project shall meet all the requirements of the California Building Code and California Fire Code, in effect at time of building permit submittal, as amended by the City of Burlingame, and that failure to comply with these conditions or any change to the business or use on the site which would affect any of these conditions shall require an amendment to this use permit. Public Health: Under the present COVID situation, Maison Alyzee complies fully or even more compared to the guidance provided by CDC or the Health Departments. We do comply with all Orders or Guidance strictly. In addition, for instance, we do clean our transaction screens (POS) for every customer prior to usage as prevention. We do clean the tables prior and after every customer seating. We do provide hand sanitizers at all our counters, entrance and tables. All employees wear masks permanently. We recommend our employees to get vaccinated and promoted it. At present all our employees in Mountain View are vaccinated. Our bathroom is fully cleaned and sanitized every 30 mn. As for sanitation, air quality we do follow all requirements and guidance as defined by the County and the City of Burlingame. Public Safetv: Maison Alyzee is very low key profile organization: Our Company's 3 core values are "Humility", "Respect" and "Sharing": this applies within the "house" for all our team members and for all our stakeholders and customers. We want to contribute positively to the local Community by bringing unique pastry and savory products. All our ingredients are the most highest quality and organic. All our desserts and pastries, viennoiseries are very low in sugar to be more healthy but also as we focus on the original ingredients for our customers' palates. In 3 years in Mountain View we did have a single incident with outside party, stakeholder or customer. Our customers community has been tremendously supportive of Maison Alyzee during the peak time of the pandemic. We are a very safe organization and team. There is no large oven, or no large baking activity on the Burlingame site, no burner. Our baking is done in our Mountain View location. General Welfare: we believe that Maison Alyzee will become a leading member of the Burlingame community. The owner will work on the Burlingame site and we are extremely sensitive to provide a very high quality service: We believe we not only provide delicious desserts, savory or pastries but we want to bring a"unique high French Parisian experience" to Burlingame citizens and the local community. Our ingredients mostly imported from France, Switzerland or Italy are the best for French fine pastries: Isigny AOP butter, Valrhona chocolate, original vanilla beans, Suiss cheese, .... Maison Alyzee Boutique are very high-end design and with an extensive sense of beautiful and aesthetics. We only use high-end material for furniture, design & construction (oak wood table with enamel insert, Spanish tiles, refined lighting, ... ) and our Boutique could be your Home or kitchen. We want Maison Alyzee to be the second Home of our Customers. Our counters are in white Carrara marble, we use bronze material, and our tables are with oak and enamel custom made if France for Maison Alyzee. We keep a very elegant look, style and design.
