Adjacent Development: Retail Sales & Office Use Previous Use: Proposed Use: Allowable Use: Food Broker/Distributor Real Estate Office Real Estate use above the first floor requires a conditional use permit Summary: The applicant is requesting a conditional use permit to allow a real estate use at 1204 Burlingame Avenue, second floor-suite #6, zoned C-1, subarea A. A conditional use permit is required for a real estate office above the first floor in the C-1, subarea A zoning district. The existing building is composed of two retail tenant spaces, the Luggage Center and Gymboree, on the ground floor with offices on the second floor. There are seven tenants who occupy the office space on the second floor. The uses include landscaping office, employment agency, financial consultants, psychologist office, and law office. There are no more than two employees that work in each suite. Five (including the proposed real estate use) of the seven spaces have only one employee. The subject property has 100% lot coverage, and is non- conforming with no on-site parking. The applicant is proposing to operate a real estate service company in suite #6, which is 468 SF in area. The business would specialize in corporate relocation and would have only one employee. Most of the business would be conducted off-site at the properties that are for sale, the clients' homes, or at the title company. The hours of operation would be from 9:00 a.m. to 5:00 p.m. Monday through Friday, with occasional weekend work by appointment only. It is estimated that there would be three clients visiting the site per week, with an increase to four visiting clients per week in two years, and five clients per week in five years. There is a maximum of three people expected on-site at any given time. The previous tenant was a food broker/distributor office which had three employees. This use was classified as an office in terms of parking. The proposed real estate use is also considered an office use, with no increase in lease space, therefore the parking remains non-conforming with no additional parking required. There are no interior or exterior alterations to the building proposed with this application. 1 Conditional Use Perinit 1204 Burlingame Avenue Proposed Existing Allowed/Req'd. November 26, 2001 Study Meeting: At the November 26, 2001 Planning Commission study meeting, the Commission noted that there did not seem to be any major issues with the proposal and placed this item on the consent calendar. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Findings: Based on the fact that this business would only have one employee, that most of the work would be off-site, with few clients meetings on-site, and there would be fewer people employed at the site than previously, the proposed use is found to be compatible with the required findings for a conditional use permit. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 2 Conditioital Use Permit Conditions: 1204 Burlingame Avenue that the real estate office use shall be limited to 468 SF at 1204 Burlingame Avenue, second floor, suite #6, as shown on the plans submitted to the Planning Department and date stamped November 9, 2001, site plan and floor plan; 2. that the real estate office shall have regular business hours from 9:00 a.m. to 5:00 p.m. Monday through Friday, with weekend use to be limited to two times per month; 3. that the maximum number of employees in this tenant space, suite number 6-second floor, shall be limited to l; 4. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlighbshade, views from neighboring properties, ease of maintenance. Why will the structure or use within the structure not affect the public's health, safety or general welfare? Public ITealth includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water supply safety, and thing which have the potential to affect public health (i.e., underground storage tanks, storage of chemicals, situations which encourage the spread of rodents, insects or communicable diseases). Could the structure or use within the structure create a nuisance or need for police services (i.e., noise, unruly gatherings, loitering, traffic) or fire services (i.e., storage or use of flammable or hazardous materials, or potentially dangerous activities lik� welding, woodwork, engine removal). How will the pYoposed use be located and conducted in accordance with the Burlingame General Plan and Zoning Ordinance? Ask the Planning Department for the general plan designation and zoning district for the proposed project site. Also, ask for an explanation of each. Once you have this information, you can compare your proposal with the stated designated use and zoning, then explain why this proposal would fit accordingly. 3. How will the proposed project be compatible with the aesthetics, mass, bulk afad character of the existing and potential uses on adjoining properties in the general vicinity? How does the proposed structure or use compare aesthetically with existing neighborhood? If it does not affect aesthetics, state why. If changes to the structure are proposed, was the addition designed to match existing architecture, pattern of development on adjacent properties in the neighborhood? If a use will affect the way a neighborhood or area looks, such as a long term airport parking lot, compare your proposal to other uses in the area and explain why it fits. How does the proposed structure compare to neighboring structures in terms of mass or bulk? If there is no change to the structure, say so. If a new structure is proposed, compare its size, appearance, orientation, etc. with other structures in the neighborhood or area. How will the structure or use within the structure change the character of the neighborhood? Think of characte: as the image or tone established by size, density of development and general pattern of land use. Will there be more traffic or less parking available resulting from this use? If you don't feel the character of the neighborhood will change, state why. How will the proposed project be compatible with existing and potential uses in the general vicinity? A conditional usc permit is required for a real estate office above the first floor in the C-1, subarea A zoning district. The existing building is composed of two retail tenant spaces, the Luggage Center and Gymboree, on the ground floor with offices on the second floor. There are seven tenants who occupy the office space on the second floor. The uses include landscaping office, employment agency, financial consultants, psychologist office, and law office. There are no more than two employees that work in each suite. Five (including the proposed real estate use) of the seven spaces have only one employee. The subject property has 100% lot coverage, and is non- conforming with no on-site parking. The applicant is proposing to operate a real estate service company in suite #6, which is 468 SF in area. The business would specialize in corporate relocation and would have only one employee. Most of the business would be conducted off-site at the properties that are for sale, the clients' homes, or at the title company. The hours of operation would be from 9:00 a.m. to 5:00 p.m. Monday through Friday, with occasional weekend work by appointment only. It is estimated that there would be three clients visiting the site per week, with an increase to four visiting clients per week in two years, and five clients per week in iive years. There is a maximum of three people expected on-site at any given time. The previous tenant was a food broker/distributor office which had three employees. This use was classified as an office in terms of parking. The proposed real estate use is also considered an office use, with no increase in lease space, therefore the parking remains non-conforming with no additional parking required.
