The previous restaurant uses had ninety (90) seats. No structural changes are proposed for the building, only interior remodeling and a new awning. All zoning code requirements have been met. Minutes July 13. 1992). Brook McCurdy states in her letter, date stamped July 20, 1992, that she was under the impression that because the previous use had 90 seats that Starbucks Coffee Co. would have the option to to utilize up to 90 seats if neccessary as the coffee shop expanded its business. Now Starbucks is asking to have 30 seats at 13 small tables and 12 stools at the bar-like counters for a total of 42 seats. The original proposal was for a total of 24 seats. Findings for Special Permit In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use , at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame General Plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action The Planning Commission should hold a public hearing . Affirmative action should be taken by resolution and reasons for any action clearly stated. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submit- ted to the Planning Department and date stamped ,Tune 10, 1992, sheets A-1, A-2, A-2.1, A-3 and July 20, 1992, sheet A-5 with a total of 42 seats; and 2. that the basement cannot be used as part of the business operation; and 3. that the project shall meet Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Because of this on- site consumption of food (pastries) and coffee drinks, we are considered a restaurant in Burlingame. We intend to remodel an existing space classified as restaurant. And due to the nature of our food and beverage services provided, of which the intent is for customers to consume on the premises, people do occasionally take a cup of coffee out from the store. For example, a person might, in the morning on the way to work, stop in for a cup of coffee to take with them while driving to work. The bulk of our take out service consists of one person taking one (1) cup of coffee to go. All of our "to go" containers are recyclable and we strive to keep packaging to a minimum, thus creating a minimum of trash. We therefore feel that our application for a conditional use permit for take- out will not impact our neighbors or the surrounding public area. The minimal amount of off-site consumption is still take-out, per the City of Burlingame's definition however, and is a part of our business. Consequently, we implore your commission to approve our application. 2. Our proposed use is located in an existing space that is classified as restaurant use. Starbucks Coffee Company's principle business activity is the sale of whole bean coffee and the related coffee making equipment and supplies. We do, however, sell coffee beverages and a few pastries. All pastries are made off-site by a local pastry vendor, therefore, even though we are classified by code in the city of Burlingame as a restaurant, we feel that because the bulk of our business is in fact straight retail we will be reducing the impact on the area due to the need for less actual parking required than is already allocated for our space with its classification as restaurant. 3. The proposed project is a tenant improvement of an existing building and will have negligible impact on the mass and bulk of the existing neighborhood. The proposed awning replaces the existing swooped brown awning, enhancing the aesthetics and character of the general vicinity with its clean lines, unifying the building facade. The proposed use, a specialty retailer of whole bean coffees enhances the neighborhood character of the area, providing both a valuable service and a pleasant gathering point for the neighborhood. �, u T v �/�r '��. RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for take-out for an existing restaurant use at 1160 Burlinaame Avenue (APN 029-153-120) (propertv owner: Gurdial S Johal 5 Santa Gina Hillsborough CA 94010 ); and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 27, 1992 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a categorical exemption Sec. 15301 Class 1(a) Interior or exterior alterations, is hereby approved. 2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting. 3.
