Categorically Exempt per Section: 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Applicant and Property Owner: Avtar Johal Designer: Ashley Canty General Plan: Shopping and Service Previous Use: Retail furniture store (currently vacant) Proposed Use: Full service food establishment Allowable Use: Food establishment with approval of a Conditional Use Permit APN: 029-153-120 Lot Area: 3792 SF Zoning: C-1, Subarea A History: On June 21, 2010, the City Council adopted Ordinance 1849, which allows up to five additional food establishments at any location within Subarea A of the Burlingame Avenue Commercial Area, so long as the food establishment is limited to only a food establishment use classified as full service, limited food service or bar, upon approval of a Conditional Use Permit. This ordinance change was adopted on June 21, 2010, and became effective on July 21, 2010. The applicant is requesting a Conditional Use Permit for a new full service food establishment. This is the third application for a new food establishment in the Burlingame Avenue Commercial Area since the ordinance was adopted. Previous approvals under this ordinance include: 1) a limited service food establishment (frozen yogurt) at 1118 Burlingame Avenue; and 2) a bar at 305 California Drive. Planning staff would also note that the fourth and fifth applications are currently being processed; these applications are for full service food establishments at 249 Primrose Road and 1395 Burlingame Avenue. Summary: The applicant is proposing to operate a new full service food establishment (pizzeria) at 1152 Burlingame Avenue, zoned C-1, Subarea A of the Burlingame Avenue Commercial Area. Currently, the tenant space is vacant, but was most recently occupied by a retail furniture store (Design Within Reach). The tenant space measures approximately 3,276 SF with 1,638 SF on the ground floor and 1,638 SF in the basement. The existing basement will used by the food establishment for storage. The food establishment will contain customer seating (with a food bar), restrooms, a kitchen and food storage. The full service food establishment will have approximately 986 SF of seating area in tables, booths and a food service bar. There will be no alcohol sales. With this application there will be a minor alteration to the existing storefront. The entry at the right side of the front farade will need to be redesigned in order to comply with exiting and disabled-accessible requirements. The existing glass door and frameless window at this entry will be replaced with a new glass door and window to match the style of the existing window system. In addition, the height of the existing awning will be reduced from 5'-6" to 4'-0" (see Proposed Restaurant Street Elevation, sheet A0.2, for proposed exterior alterations). This project is subject to Commercial Design Review because it includes changes to the front farade of a storefront located in Subarea A of the Burlingame Avenue Commercial Area. The following applications are required: ■ Commercial Design Review for changes to the front faCade of an existing commercial storefront in Subarea A of the Burlingame Avenue Commercial Area (CS 25.57.010, c); and ■ Conditional Use Permit for a new full service food establishment in the Subarea A of the Burlingame Avenue Commercial Area with 986 SF of on-site seating area. Commercial Design Review and Conditional Use Permit 1152 Burlingame Avenue A full service food establishment is defined as a business which sells food prepared indoors on the premise with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service food establishment include most or all of the following: served by waiters to seated customers and where payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher; and food is served on ceramic plates with metal flafinrare and cloth napkins. The proposed food establishment meets most of these operating criteria. The full service food establishment will be a pizzeria serving pizza, pasta's, calzone's, sandwiches, salads and other similar foods (refer to the applicanYs letter dated December 6, 2010 for a full description of the proposed business). When the business opens, there will be 10 full-time and 6 part-time employees on weekdays and weekends. In five years, the number of employees is expected to increase to 14 full-time and 10 part-time employees. At opening, the applicant projects a total of 200 customers per day on weekdays and 335 customers per day on weekends. In the future, the applicant anticipates a total of 220 customers per day on weekdays and 350 customers per day on weekends. A maximum of 70 people are expected on site at any one time, including the owner, employees and customers. The food establishment will be open seven days a week, from 7:00 a.m. to 10:00 p.m. Personal and retail services on the first floor in the Burlingame Avenue Commercial Area are exempt from vehicle parking requirements as set forth in code section 25.36.040 (d). In the Burlingame Avenue Commercial Area, a food establishment is considered to be a retail use for parking purposes. Study Meeting: At the December 13, 2010, Planning Commission study meeting, the Commission discussed the application with the applicant and designer and had no suggested changes; the Commission voted to place this item on the Consent Calendar at the next available Planning Commission meeting (December 13, 2010 Planning Commission Minutes). -2- Commercial Design Review and Conditional Use Permit 1152 Burlingame Avenue Design Review Criteria: The criteria for Commercial Design Review as established in Ordinance No. 1652 adopted by the Council on April 16, 2001 are outlined as follows: 1. Support of the pattern of diverse architectural styles that characterize the city's commercial areas; 2. Respect and promotion of pedestrian activity by placement of buildings to maximize commercial use of the street frontage, off-street public spaces, and by locating parking so that it does not dominate street frontages; 3. On visually prominent and gateway sites, whether the design fits the site and is compatible with the surrounding development; 4. Compatibility of the architecture with the mass, bulk, scale, and existing materials of existing development and compatibility with transitions where changes in land use occur nearby; 5. Architectural design consistency by using a single architectural style on the site that is consistent among primary elements of the structure, restores or retains existing or significant original architectural features, and is compatible in mass and bulk with other structure in the immediate area; and 6. Provision of site features such as fencing, landscaping, and pedestrian circulation that enriches the existing opportunities of the commercial neighborhood. Findings for Design Review: Based on the findings stated in the attached minutes of the Planning Commission's December 13, 2010, Design Review Study meeting; that no changes are proposed to the mass and bulk of the existing building, which is currently consistent with the mass and bulk of other structures in the immediate area; that the minor alteration to the existing storefront which includes redesigning the entry at the right side of the front fa�ade, is needed in order to complywith exiting and disabled-accessible requirements and that the existing glass door and frameless window at this entry will be replaced with a new glass door and window to match the style of the existing window system; the project is found to be compatible with the requirements of the City's six Commercial Design Review Guidelines. Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit for a full service food establishment, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Findings for This Conditional Use Permit: On June 21, 2010, the City Council adopted Ordinance 1849, which allows up to five additional food establishments at any location within Subarea A of the Burlingame Avenue Commercial Area, so long as the food establishment is limited to only a food establishment use classified as full service, limited food service or bar, upon approval of a Conditional Use Permit, and this business meets those criteria; the business will operate within the limits established by that ordinance; the use will not be detrimental to -3- Commercial Design Review and Conditional Use Permit 1152 Burlingame Avenue the city's objective of promoting pedestrian oriented retail activity in this commercial area and therefore will be in compliance with the general plan forthe area; and since the business shall be required to complywith all the city regulations including providing trash receptacles and litter maintenance in the surrounding area, signage, meeting building code requirements, and adhering to Counry health requirements, the operation will be compatible with public's health and safety as well as with the character of the commercial area. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons forany action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped December 6, 2010, sheets A0.0 through A0.2; 2. that this business location to be occupied by a full service food establishment, with 986 SF of seating area, may change its food establishment classification only to a limited food service food establishment or bar upon approval of a conditional use permit amendment for the establishment, and the criteria for the new classification shall be met in order for a change to be approved; 3. that the 986 SF area of on-site seating of the full service food establishment shall be enlarged or extended to any other areas within the tenant space only by an amendment to this conditional use permit; 4. that the existing basement shall only used by the food establishment for storage; use of the basement for any use other than storage shall require an amendment to this conditional use permit; 5. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with the streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and at any additional locations as approved by the City Engineer and Fire Department; 6. that the business shall provide litter control and sidewalk cleaning along all frontages of the business and within fifty (50) feet of all frontages of the business; 7. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; 8. that there shall be no food sales allowed at this location from a window orfrom any opening within 10' of the property line; 9. that if this site is changed from any food establishment use to any retail or other use, a food establishment shall not be replaced on this site and this conditional use permit shall become void; 10. that any seating on the sidewalk outside shall conform to the requirements of any encroachment permit issued by the city; 11. that the conditions of the Chief Building Official's November 25, October 5 and August 10, 2010 memos, the City Engineer's September 15, 2010 memo, the Fire Marshal's August 9, 2010 memo, the Parks Supervisors August 10, 2010 memo and the NPDES Coordinator's August 9, 2010 memo shall be met; -4- Commercial Design Review and Conditional Use Permit 1152 Burlingame Avenue 12. that the project shall meet all the requirements of the California Building Code and California Fire Code, 2010 edition, as amended by the City of Burlingame, and that failure to comply with these conditions or any change to the business or use on the site which would affect any of these conditions shall require an amendment to this use permit; 13. that any changes to the size or envelope of building, which would include changing or adding exterior walls or parapet walls, shall require an amendment to this permit; 14. that any changes to building materials, exterior finishes, windows, architectural features, roof height or pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review (FYI or amendment to be determined by Planning staf�; 15. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 16. that prior to issuance of a building permit for construction of the project, the project construction plans shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved plans throughout the construction process. Compliance with all conditions of approval is required; the conditions of approval shall not be modified or changed without the approval of the Planning Commission, or City Council on appeal; 17. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 18. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION: 19. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the properry owner or contractor shall provide the certification under penalty of perjury. Certifications shall be submitted to the Building Department; and 20. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans. Noted that the latest project plans remove the wine display area and replace it with booth seating. Want to evaluate the business after it opens to determine if alcohol sales are necessary. The design will be reminiscent of a restaurant from another era. The design will feature classic materials with contemporary accents in the architecture. Our restaurant will offer a warm and vibrant "center of town" for Burlingame residents and visitors. The restaurant will be highlighted with a wood fired oven and a welcoming atmosphere. There will be no ideal age preference for any patrons; instead our focus is centered on providing all those that share an appreciation for fine food at affordable prices. The process in which the food will be served is dependent on a numerical system with assigned tables, where customers are assigned a table and given a number for the appropriate server to know where to take the meals. The pizza will be based on authentic Italian style, with a great gourmet feel, thin crust, and the freshest ingredients. Along with Pizza as the main focus, we will offer a variety of anti pasti/appetizer favorites that include: bruschetta, soups, salads, and assorted meats and cheeses. Our custom and elaborate pizza combinations will offer a unique taste, and a well balanced range of different toppings for all palates. This ordinance change was adopted on June 21, 2010, and became effective on July 21, 2010. The applicant is requesting a Conditional Use Permit for a new full service food establishment. This is the third application for a new food establishment in the Burlingame Avenue Commercial Area since the ordinance was adopted. Previous approvals under this ordinance include: 1) a limited service food establishment (frozen yogurt) at 1118 Burlingame Avenue; and 2) a bar at 305 California Drive. Planning staff would also note that the fourth and fifth applications are currently being processed; these applications are for full service food establishments at 249 Primrose Road and 1395 Burlingame Avenue. Summary: The applicant is proposing to operate a new full service food establishment (pizzeria) at 1152 Burlingame Avenue, zoned C-1, Subarea A of the Burlingame Avenue Commercial Area. Currently, the tenant space is vacant, but was most recently occupied by a retail furniture store (Design Within Reach). The tenant space measures approximately 3,276 SF with 1,638 SF on the ground floor and 1,638 SF in the basement. The existing basement will used by the food establishment for storage. The food establishment will contain customer seating (with a food bar), restrooms, a kitchen and food storage. The full service food establishment will have approximately 986 SF of seating area in tables, booths and a food service bar. There will be no alcohol sales. VVith this application there will be a minor alteration to the existing storefront. The entry at the right side of the front fa�ade v:�ill need io be redesigned in order to comply with exiting and disabled-accessible requirements. The existing glass door and frameless window at th�s entry will be replaced with a new glass door and window to match the style or the existing window system. In addition, the height of the existing awning will be reduced from 5'-6" to 4'-0" (see Proposed Restaurant Street Elevation, sheet A0.2, for proposed exterior alterations). This project is subject to Commercial Design Review because it includes changes to the front fa�ade of a storefront located in Subarea A of the Burlingame Avenue Commercial Area. Commercial Design Review and Conditional Use Permit 9152 Burlingame Avenue A full service food establishment is defined as a business which sells food prepared indoors on the premise with a full menu and provides an indoor seating area of at least 250 SF. Operating criteria for a full service food establishment include most or all of the following: served by waiters to seated customers and where payment is made at the end of the meal; presence of a full commercial kitchen and commercial dishwasher; and food is served on ceramic plates with metal flaiware and cloth napkins. The proposed food establishment meets most of these operating criteria. The full service food establishment will be a pizzeria serving pizza, pasta's, calzone's, sandwiches, salads and other similar foods (refer to the applicant's letter dated December 6, 2010 for a full description of the proposed business). When the business opens, there will be 10 full-time and 6 part-time employees on weekdays and weekends. In five years, the number of employees is expected to increase to 14 full-time and 10 part-time employees. At opening, the applicant projects a total of 200 customers per day on weekdays and 335 customers per day on weekends. In the future, the applicant anticipates a total of 220 customers per day on weekdays and 350 customers per day on weekends. A maximum of 70 people are expected on site at any one time, including the owner, employees and customers.
