SUBJECT: NO��S BAGELS AT 1152-1156 BIIRLINGAME AVENIIE, ZONED C-1 BIIRLINGAME
AVENIIE COMMERCIAL AREA, SIIBAREA A.
RECOMMENDATION:
The City Council should hold a public hearing and take action. Affirmative
action should be by resolution. The reasons for any action should be
clearly stated for the record. The conditions recommended by the Planning
Commission should be considered at the public hearing. (Action
alternatives and the findings required for a special permit are attached at
the end of the staff report.)
Conditions approved by the Planning Commission are:
1. that the project shall be built as shown on the plans submitted to the
Planning Department date stamped February l0, 1994 (floor plans) and
March 1, 1994 (basement plan);
2 that all deliveries to this business shall be made before 10:00 a.m.;
3. that adequate, well labeled trash receptacles shall be provided, and
that an employee shall have the responsibility of scouting for trash
hourly while the bakery is open and shall "scout" within a 100' radius
at the end of each business day; the bakery manager shall be
responsible for insuring trash receptacles are emptied and trash in
the area picked up before it becomes a nuisance;
4. that trash receptacles shall be placed at the front door and outside
the front door at a location approved by the City Engineer; the
business shall maintain and regularly empty the trash receptacles,
including those on the public right-of-way at all times and failure to
do so would result in review of this use.permit;
5. that plans submitted to the Building Department shall meet the
conditions of the Chief Building Inspector's memo dated 2/14/94;
6. that the basement area accessible to this tenant shall not exceed 300
SF as noted in the Fire Marshal's memo dated 2/17/94 and shall only be
used for storage in association with this business;

that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of Burlingame;
and
that the use shall be reviewed for conformance with these conditions
in nine months (December, 1994) or upon complaint thereafter.

Planninq Commission Action
At their meetz.ng on March 28, 1994 the Planning Commission held a public
hearing on th� request for Noah's Bagel's, a bagel bakery, to-sell bagels
to go. The b�;.siness will have no tables or chairs in side, so is not an
eating establishment. The Planning Commissioners voted 6-0-1 (C. Kelly
absent) to approve the special permit for take out. In their discussion
the Commissioners noted that this business should be a positive influence
on that end of Burlingame Avenue, that its presence will not increase
traffic because of its peak hours of operation and the support role it will
play with other early morning service businesses in the area. Opposition
was voiced by the owner of the House of Bagels because of the impact he
feared this business would have on his business.
BACKGROUND:
Bill Hughson, representing Noah's Bagels, is requesting a take out permit
in order to open a bagel bakery at 1152-1156 Burlingame Avenue, zoned C-1
Burlingame Avenue Commercial Area, Subarea A. The business location is
next door to Starbuck' s coffee, and will be one of three tenants in the
building. Noah's Bagels will take two exiting tenant spaces, 1187 SF and
300 SF of the basement area for storage.
The bakery would be open daily with a maximum of six employees on the site.
A maximum of ten customers are expected on site at one time. There would
be no indoor seating. Deliveries by corporate trucks would be made before
9 am and by others before 10 am. All deliveries would be made through the
front of the store since there is no rear entrance. Other information on
the operation and policies of this business presented by the applicant are
included in the Planning Commission staff report attached.
Staff have reviewed this application and found no construction issues that
cannot be addressed with the tenant improvements. The structure is not on
the Unreinforced Masonry Building list.

Mountain Blvd., Oakland. My firm is the manag-ing entity for this property. Noah's
Bagels is a tremendous traffic generator for this multi-tenant property. This store is the
result of thousand of dollars invested in their own tenant improvements. It is an extremely
attractive facility. They also pay the monthly rent in a prompt manner.
Noah's Bagels also occupies space in another property in Berkeley on Solano Avenue that
is partly owned by my partner. We value their tenancy very much, and would not hesitate
to pursue additional leasing opportunities with them.

Noah's has been open in the Marina District for almost two years. Frankly, this azea is
not known for acceptance of change — any change. Residents are more inclined to grouch
and carry on about the good old days. So they watched the refurbishing of the building
that would become Noah's with dark looks.
The glares turned fewer and fewer each day as they noticed this was not going to be
another chrome monstrosity; rather, it had the feel of a neighborhood place and looked like
it had always been here.
The Noah's folks added to their joy by hiring local people, keeping a spotless premises,
providing receptacles and urging their customers not to litter.
Further, Noah's became part of the community at once; joining in various charitable and
other community efforts; advertising in the community newspaper and., in general, being
good neighbors.
The only problems you will face is getting to their store, breathless from running, only to
find that someone just bought the very last of your favorite kind of bagel.

Recently I had heard a rumor that NOAH'S BAGELS may be going into
Loehm�nn's Plaza. and that's ezciting.
Body Options has two locations next to a Noah's Bagel shop:
one in the Mount Clair District of Oakland, and the other our flag
ship store and office on Chestnut Street in San Francisco. In both
instances our sales volume has increased dram�tically upon their
opening. They add a tremendous amount of traffic to our neighborhoods
and I might add that it's a good yuppie traffic. Not to mention th�t
the bagels are delicious.
I'm sure that you are well aware that Noah's Hagel have b�en
somewhat of a phenomenon in the area. A�d with what th�ir presence can
do for a locat:on. I urge you �a do Wh�t you cin to make the rumor of
Noah's Bagel moving into the Loehmann's Plaza a re�lity.

ACTION ALTERNATIVES
1. City Council may vote in favor of an applicant�s request.
If the action is a variance, use permit, fence exception or
sign exception, the Council must make the findings as
required by the code. Findings must be particular to the
given property and request. Actions on use permits should
be by resolution. A majority of the Council members seated
during the public hearing must agree in order to pass an
affirmative motion.
2. City Council may deny an applicant�s request. The reasons
for denial should be clearly stated for the record.
3. City Council may deny a request without prejudice. This
action should be used when the application made to the City
Council is not the same as that heard by the Planning
Commission; when a Planning Commission action has been
justifiably, with clear direction, denied without prejudice;
or when the proposed project raises questions or issues on
which the Council would like additional information or
additional design work before acting on a project:
Direction about additional information required to be given
to staff, applicant and Planning Commission should be made
very clear. Council should also direct whether any
subsequent hearing should be before the Council or the
Planning Commission.
SPECIAL PERMIT FINDINGS
(1) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(2) the proposed use will be located and conducted in a manner
in accord with the Burlingame general plan and the purposes
of this title;
(3) the planning commission may impose such reasonable
conditions or restrictions as it deems necessary to secure
the purposes of this title and to assure operation of the
use in a manner compatible with the aesthetics, mass, bulk
and character of existing and potential uses on adjoining
properties in the general vicinity.

the new center. We were very opposed to any fast food outlets.
we were successful in stopping MacDonalds from establishing a
stor� in the center. when we learned that Noah's Hagels

from their opperation and that an undesirable element might be

they ran. I was pleased to find a v�ry community ari�nt�d stare

3. THREE SPECIAL PERMITS AND PARKING VARIANCE AT 733 FARRINGDON LANE,
ZONED R-1 (JIHAD CHEDID, PROPERTY OWNER AND APPLICANT)
Requests: a letter stating the specifics for the variance, i.e., what is
unusual about this lot; what information about accessory structure was
disclosed at the time of the last purchase (1992).
Item set for Public Hearing April 11, 1994.
ITEMS FOR ACTION
Chairman Deal advised all applicants that since there are 5 Commissioners
present rather than the regular 7, a 4/5 vote is necessary to pass any
item. He asked if any applicant wished to continue their item to a future
meeting with a full commission, there being no requests, Chairman Deal
proceeded with the meeting.

Reference staff report, 3/28/94, with attachments. CP Monroe discussed the
request, reviewed criteria, Planning Department comments, and study meeting
questions. Eight conditions were suggested for consideration.
(Commissioner Galligan arrived at this time.)
Chm. Deal opened the public hearing. Dan Alper, one of the owners of
Noah's Bagels, Berkeley, was present to answer any questions. Sam Malouf,
1426 Burlingame Avenue, encouraged the Commission to issue this permit.
Larry Chassy, 3484 LaMesa Drive, San Carlos, and owner of the House of
Bagels spoke in opposition to the project because of its impact on his
business. Kathleen Payne, 1110 Laguna believes the Broadway area would
better benefit by the business because there is no bagel shop there.
There were no other comments and the public hearing was closed.
C. Jacobs observed the approval of this permit will be a positive influence
on Burlingame Avenue and the applicant has made it clear that they will
abide by the conditions, this will not increase the traffic, she then moved
to approve the application, by resolution, with the following conditions;
1) that the project shall be built as shown on the plans submitted to the
Planning Department date stamped February 10, 1994 (floor plans) and March
1, 1994 (basement plan); 2) that all deliveries to this business shall be
made before 10:00 a.m.; 3) that adequate, well labeled trash receptacles.

all times and failure to do so would result in review of this use permit;
5) that plans submitted to the Building Department shall meet the
conditions of the Chief Building Inspector's memo dated 2/14/94; 6) that
the basement area accessible to this tenant shall not exceed 300 SF as
noted in the Fire Marshal's memo dated 2/17/94 and shall only be used for
storage in association with this business; 7) that the project shall meet
all the requirements of the Uniform Building and Uniform Fire Codes as
amended by the City of Burlingame; and 8) that the use shall be reviewed
for conformance with these conditions in nine months (December, 1994) or
upon complaint thereafter.
Motion was seconded by C. Ellis and approved on a 6-0-1 (C. Kelly absent)
voice vote. Appeal procedures were advised.
It was specified, for the record, that Noah's is also a deli.
4. NEGATIVE DECLARATION AND SPECIAL PERMIT FOR SCHOOL DISTRICT OFFICES AT
1131 - 1141 VANCOUVER AVENUE, ZONED R-1 (BURLINGAME ELEMENTARY SCHOOL
DISTRICT, PROPERTY OWNER AND APPLICANT).
Reference staff report, 3/28/94, with attachments. CP Monroe discussed the
request, reviewed criteria, Planning Department comments, and study meeting
questions. If recommended to Council for approval, 7 conditions were
suggested. The Commission asked for clarification of to the distribution
of the parking; of the 27 spaces on site, 13 are for the district and 14
are for the tenants according to the School District proposal. The number
of parking spaces required for the new office area is based on square
footage. There was also a question pertaining to the condition of the ramp
used to access the rear parking area.
Chm. Deal opened the public hearing. Burlingame Elementary School
Superintendent Beuthel was present to answer any questions, he clarified
there are 2 separate sources of funds, Capital funds available for
construction and General funds available for program. Often the public
combines these in their mind, however the district is not allowed to
legally intermingle these funds. Three criteria have been examined in
arriving at the decision to use Roosevelt, 1) space; 2) construction
dollars; and 3) program. This option is the most effective of these
options considered. The district has been involved in strategic plarining
since 1991. The projected enrollment shows steady increase in students.
The district relies on the lease income to continue the current programs.
They would like to move the district office to Roosevelt in 1994; and to
move toward reopening Roosevelt as a district school in approximately 3
years. In Burlingame, the district office has been housed in a public

Summary: Applicant Bill Hughson, representing Noah's Bagels, is
requesting a special permit for a take-out bagel bakery at 1152-
1156 Burlingame Avenue, zoned C-1 Subarea A.
The project site is within a building which currently houses
Starbuck's and four other retail tenant spaces (one on Lorton, two
on Burlingame Avenue). Two of the tenant spaces on Burlingame
Avenue (both retail jewelry stores) would be combined to create the
1187 SF bakery at street level. There would be an additional 300
SF of basement storage used by the bakery.
The bakery would be open daily with a maximum of six employees on-
site. A maximum of ten customers are expected on site at any one
time. There would be no seating.
The only access to the building is thr`ough the front of the store.
The applicant expects approximately one delivery per day, either by
their own delivery vehicle or by those of private vendors. The
applicant has noted his own company deliveries would occur before
9:00 a.m.. He also noted outside vendors would be encouraged to
deliver before 9:00 a.m., and guaranteed outside vendor deliveries
would occur no later 10:00 a.m..
The applicant has provided additional information regarding the
business operation, including its standards and ethics, customers
expected mode of transportation, the company's trash and recycling
policy, community involvement, location of other stores, letters
from landlords, neighbors, other tenants and associations and a
sample menu (see attached).

Staff Comments:
The Chief Building Inspector noted the project must comply with the
Uniform Building Code as amended by the City. The Fire Marshal
noted that the basement area as shown on the original plans
submitted would require an additional exit. The architect
responded by submitting another basement plan which reduced the
usable basement area to 300 SF. The City Engineer had no comments.
Planning staff notes that first floor retail uses are exempt from
parking requirements in Subarea A.
Study Meetinq Questions:
Planning Commission reviewed this item at their regular meeting on
March 14, 1994 and asked why a special permit is required since the
use is like a bakery. Planning staff notes that any currently
proposed take-out businesses, including bakeries, require a special
permit for take-out. There were no other questions.
Correspondence:
The Planning Department received a letter in support of this
application from Sam Malouf (date stamped 3-21-94). Planning also
received a copy of a letter suggesting that the limitation of food
establishments (businesses which sell food and/or drink at retail
with tables and chairs) be extended to all food handling
establishments (date stamped 2-28-94). The letter was sent to the
City Clerk and was written by Harvey Chassy, owner of the House of
Bagels.
Required Findings for a Special Permit:
In order to grant a Special Permit the Planning Commission must
find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of
this title;
(c) the Planning Commission may impose such reasonable conditions
or restrictions as it deems necessary to secure the purposes
of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.
Planninq Commission Action:
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action
should be clearly stated. At the public hearing the following
conditions should be considered:

We believe that a Noah's Bagels bakery will enhance Burlingame Avenue's reputation as a premier
shopping street.
Our stores are clean, safe, and well-aperated bakeries. We spend a great deal of money to build
attractive, solid stores which enhance the ambiance of their strcet. We then hire local people to
work in our stores, train them carefully, and treat them fairly. Finally, we provide fresh,
wholesome, award-winning prcxiucts to the people living and working in the neighborhood
communities in which we operate. Noah's Bagels is a small, locally-owned business, and our
stores are managed in a highly conscientious, responsible, and professional manner. The owners
of the business take personal responsibility for the cleanliness and quality of our operations, and
are always available to address any questions or concerns that may be raised by any interested
parties.
Specifical ly:
a) Not detrimental or injurious to property or improvements in the vicinity:
This project will have no affect on noise, lighting, paving, landscaping, sunlight/shade, views
from neighboring properties, or ease of maintenance.
We have also found that our stores have minimal impact on traffic. This is because the vast
majority of our customers are local residents who stop by on their �vay to cvork, people �vho work
nearby the store and who stop by to pick up a sandwich for lunch, or neighborhood residents �vho
come down to the store to buy a dozen bagels for their family. Most of these customers either
come by foot or were in the neighborhood for some other purpose. Further, the vast majority of
our business occurs during the hours before noon. Friends in Burlingame tell us that this is
typically the quietest traffic time on Burlingame Avenue, so that any additional traffic the store
does generate should have minimal impact.
b) Not detrimental or injurious to public health:
This project will not introduce any hazardous materials to the neighborhood, nor will it have any
impact on air quality, water suppiy, or pests.
Noah's Bagels is e�tremely careful to contain any garbage created by our operations, and has a
very aggressive recycling and trash control program. The primary components of this program
are as follows:
Written guidelines (see E�hibit A attached) for trash control which each store is required
to follow.
Clearly-marked recycling bins for glass and aluminum.
A communications program to enlist the assistance of our customers in our recycling and
trash control program. This program includes colorful "Protect Our Planet" stickers as
well as signs which urge customers to recycle and to dispose of trash properly.
Community leadership where appropriate. At the Noah's Bagels bakery on Chestnut
Street in San Francisco, �ve took the lead in putting together a consortium of businesses
which as a group are hiring an ARC (Association for Retarded Citizens) member to keep
the street clean on busy weekends. Noah's Bagels took responsibility for hiring,
training, supervising, and paying the individual. The program has been very successful
at both keeping the street cican and increasing the amount of materials which are
recycled.
c) Not detrimental or injurious to public safety:
This project will not affect police or fire protection, nor will the proposed use create a nuisance or
need for police or fire protection services. Noah's Bagels stores are clean, safe, and well-managed
bakeries that cater to the local resident and business population.
All of our stores are equipped with sprinkler systems and fire alarm systems. However, none of
our stores have ever experienced any safety, fire, or security-related problems.
d) Not detrimental or injurious to general welfare:
It is part of Noah's Bagels' Mission Statement to be "an active and positive force in the
communities where we do business."
One example is our commitment lo community service. This commitment takes many fornls,
including donations of all of our day-old bagels to organizations which serve the needy, such as
Food Runners, The Center for AIDS Services, St.Vincent dePaul, and B'nai Brith Youth;
donations of both cash and bagels to organizations such as Broadway Children's School,
American Red Cross, Children's Community Center, and Student Environmental Action Coalition;
participation in local business associations in each neighborhood where we do business; and
providing good, fair jobs and excellent job training to local young people. In fact, for the
company's fourth anniversary last August, «e donated 100°Io of our profits for the day to three
charities -- La Casa de las Madres, Berkeley/Oakland Support Services, and Children Now. A
partial list of organizations to which we have donated food or money in the past 12 months is
included as Exhibit B.
Another example is that Noah's Bagels bakeries have always been concerned citizens when it
comes to recycling and controlling litter. All of our bakeries have recycling bins which are well-
marked and well-used by our customers. We have always been careful to keep the sidewalks in
front of our stores clean. In addition, we have developed an aggressive campaign to ensure that
we are a leader in promoting recycling and trash control so that �ve can be the best possible
neighborhood citizen in all the areas where we do business.
Further, Noah's Bagels is committed to bringing the best quality products we possibly can to the
citizens of Burlingame. All of our products are 100°Io natural and authentically New York style.
We make most of our products ourselves, including our 14 flavors of freshly-baked bagels and 8
varieties of whipped cream cheeses with natural flavorings. Some products, however, are made
best back in New York, and we air freight our smoked fish products and our specialty pastry
products several times each week from the highest quality smokehouses and bakeries in Ne�v
York.
Finally, we have attached some letters which we have received from landlords, neighboring
businesses, and business associations which describe their impressions of our operations. (See
Exhibit C.) As you will see by looking through these letters, Noah's Bagels tries very hard to be a
good tenant, a good neighbor, and a good citizen.
e) Not detrimental or injurious to public convenience:
All of our stores conform to the strictest standards of Title 2� and the Americans with Disabilities
Act. We try very hard to ensure that our stores are accessible, comfortable, and easy to use for
both handicapped and elderly customers.
2. This proposed use will be located and conducted in accordance with the
Burlingame General Plan and Zoning Ordinance because:
The site which we would like to occupy is listed in the General Plan designation as`Yetail and
service commercial," and the zoning for this site is C-1 Burlingame Avenue District, Sub-Area A.
Our proposed use for this site will be retail to retail, which is consistent with the General Plan.
Our reading of the Commercial District Development Standards provided to us by the City of
Burlingame Planning Department is that "drive-in and take-out services" are allowed in Subarea A
with a Conditional Use Permit. We believe that the proposed Noah's Bagels bakery conforms
with the definition of a"take-out service" because the bakery will not contain any customer
seating, and consumption on-premises will not be allowed.
3. This project will be compatible with the aesthetics, mass, bulk and character
of the existing and potential uses on adjoining properties in the general
vicinity because:
The proposed project consists only of an upgrade to an existing space, and will make no structural
modifications to the building. We would like to make certain modifications to the existing building
which we believe will improve its aesthetic congruence with the quality orientation of Burlingame
Avenue and Burlingame in general. Please refer both to the design sketches included in this
application and to the photograph of a typical Noah's Bagels store included as Fxhibit D, in this
case our store located on Chestnut Street in San Francisco.
We do not believe that a Noah's Bagels bakery will change the character of the neighborhood.
First, our bakeries are in keeping with the high-quality nature of Burlingame Avenue businesses.
Second, the Avenue already has a couple of high-end general bakeries which are highly compatible
with our business. We share a quality orientation, yet there is very little overlap in products
offered. Third, our proposed bakery is adjacent to Starbucks. Several of our existing stores are
within one block of Starbucks stores -- including the ones in Palo Alto, Redwood City, and
Chestnut Street in San Francisco. Both Starbucks and we find that our businesses are highly
compatible. Finally, several communities which are similar to Burlingame in their high-quality
orientation have provided warm welcomes to Noah's Bagels bakeries, including University
Avenue in Palo Alto and Mountain Boulevard in Montclair Village. We feel that our operation
would be a good match with and a good addition to your city.

NOAH'S BAGELS
TRASH AND RECYCLING POLICY
1. Noah's Bagels will encourage customers to use the recycling bins provided and request that
they use the waste recepticles provided for their trash. We will do this through ensuring that
we provide adequate recepticles, by ensuring that they are well-labeled, and by using the new
"Protect Our Planet" stickers and (where appropriate) banners.
2. Bakery operating procedures will include the designation of a"trash scout" during each shift.
This individual will be assigned the responsibility of checking the area outside the bakery for
trash at least once every hour that the bakery is open. This wtll ensure that the area in front of
the bakery will be free of litter and that no trash left near the bakery blows into the adjoining
neighborhood.
3. At closing time, the "trash scout" will be responsible for a final check for any trash with a 50
foot radius of the bakery. In addition, if the scout notices Noah's trash outside that radius, he
or she will be expected to pick it up.
4. The bakery manager's written job description will include responsibility for monitoring the
"trash scout's" performance.
5. The bakery manager will also be expected to respond personally to any complaints from
neighborhood residents with regard to Noah's trash.
6. Neighborhood residents will also be provided with the telephone number for Noah's Bagels'
headquarters in Berkeley, and we, as owners, will take personal responsibility for each
bakery's conformance with these standards. Repeated complaints to headquarters will result in
disciplinary action for the bakery manager.

As a retail merchant on Burlingame Avenue I want to encourage the
City Council of Burlingame to support Mr. Bill Hughson of Noah's
Bagels, Emeryville request for a Take Out Special Permit for the
locatior� of their retail business on Bur/ingame A venue.
It is my belief that business competition is healthy for the whole of
any business community, and that the citizens of the community are
well served. Similar businesses actually support each other by being
a strong destination for the type of product that the consumer wishes

When the City of Burlingame passed a moratorium on the
establishment of newly located restaurants, this sound principle
was predicated upon the fact there was too large a concentration
of eating places in the city.
We feel that such an action should be further extended to all
food-handling establishments.
To further dilute the markets of specialty food shops can only do
economic harm to shops that have done a true and proud service to
the Burlingame, and immediate surrounding communities. This can
certainly be attested to by the continued loyalty of the area,
which has sustained these businesses.
Your urgent consideration in this matter would be greatly
appreciated by we, members of the Burlingame business community.

RESOLUTION APPROVING NEGATIVE DECLARATION
CATEGORICAL EXEMPTION AND SPECIAL PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application
has been made for a Special Permit for take-out for a bagel bakery at
1152-1156 Burlingame Avenue; APN 029-153-120; propertv owner: Gurdial S
Johal, Tr., #5 Santa Gina Hillsborouqh CA; and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on March 28, 1994 , at which time it reviewed and
considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and
categorical exemption Section 15301, Class 1(a) Interior or exterior
alterations involving such things as interior partitions, plumbing and
electrical conveyances is hereby approved.
2. Said special permit is approved subject to the conditions set
forth in Exhibit "A" attached hereto. Findings for such Special Permit
are as set forth in the minutes and recording of said meeting.
3: It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.

Conditions of approval, categorical exemption and special permit
1152-1156 Burlingame Avenue
effective April 4, 1994
1. that the project shall be built as shown on the plans submitted to
the Planning Department date stamped February 10, 1994 (floor plans)
and March 1, 1994 (basement plan);
2. that all deliveries to this business shall be made before 10:00
a.m.;
3. that adequate, well labeled trash receptacles shall be provided, and
that an employee shall have the responsibility of scouting for trash
hourly while the bakery is open and shall "scout" within a 100'
radius at the end of each business day; the bakery manager shall be
responsible for insuring trash receptacles are emptied and trash in
the area picked up before it becomes a nuisance;
4. that trash receptacles shall be placed at the front door and outside
the front door at a location approved by the City Engineer; the
business shall maintain and regularly empty the trash receptacles,
including those on the public right-of-way at all times and failure
to do so would result in review of this use permit;
5. that plans submitted to the Building Department shall meet the
conditions of the Chief Building Inspector's memo dated 2/14/94;
6. that the basement area accessible to this tenant shall not exceed
300 SF as noted in the Fire Marshal's memo dated 2/17/94 and shall
only be used for storage in association with this business;
7. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of Burlingame
and
8. that the use shall be reviewed for conformance with these conditions
in nine months (December, 1994) or upon complaint thereafter.

Class 1(a) Interior or exterior alterations involving such things
as interior partitions, plumbing, and electrical conveyances.
Summary: Applicant Bill Hughson, representing Noah's Bagels, is
requesting a special permit for a take-out bagel bakery at 1152-
1156 Burlingame Avenue, zoned C-1 Subarea A.
The project site is within a building which currently houses
Starbuck's and three other retail tenant spaces. Two of the tenant
spaces on Burlingame Avenue (retail jewelery and clothing stores)
would be combined to create the 1187 SF bakery at street level.
There would be an additional 300 SF of basement storage used by the
bakery.
The bakery would be open daily with a maximum of six employees on-
site. A maximum of ten customers are expected on site at any one
time. There would be no seating.
The only access to the building is through the front of the store.
The applicant expects approximately one delivery per day, either by
their own delivery vehicle or by those of private vendors. The
applicant has noted his own company deliveries would occur before
9:00 a.m.. He also noted outside vendors would be encouraged to
deliver before 9:00 a.m., and guaranteed outside vendor deliveries
would occur no later 10:00 a.m..
The applicant has provided additional information regarding the
business operation, including its standards and ethics, customers
expected mode of transportation, the company's trash and recycling
policy, community involvement, location of other stores, letters
from landlords, neighbors, other tenants and associations and a
sample menu (see attached).
SPECIAL PERXIT FOR TARE-OUT

Staff Comments:
The Chief Building Inspector noted the project must comply with the
Uniform Building Code as amended by the City. The Fire Marshal
noted that the basement area as shown on the original plans
submitted would require an additional exit. The architect
responded by submitting another basement plan which reduced the
usable basement area to 300 SF. The City Engineer had no comments.
Planning staff notes that first floor retail uses are exempt from
parking requirements in Subarea A..
