History: On June 12, 2006, the Planning Commission approved a Conditional Use Permit Amendment to
change the classification of an existing food establishment from a specialty shop to a full service food
establishment and to increase the seating area from 385 SF to 875 SF at 1125 Burlingame Avenue. Over the
years, there have been several full service food establishments which have operated at this location; the space
is currently vacant.
With this application, the applicant is requesting a Conditional Use Permit Amendment to increase the hours of
operation and maximum number of employees on site at any one time.
Summary: The subject building is located at the corner of Burlingame Avenue and Lorton Avenue. The
applicant is proposing to replace an existing full service food establishment which recently closed at 1125
Burlingame Avenue, zoned BAC. The proposed restaurant, a Japanese fusion sushi bar, will be open for lunch
and dinner. The applicant currently operates a similar restaurant, iSushi, in Castro Valley. The food
establishment would contain customer seating, a kitchen, back of house area and restrooms. The proposed
food establishment will have approximately 538 SF of customer seating. The food establishment measures
approximately 2,644 SF in area (1,913 SF on the ground floor and a 731 SF basement). The existing basement
(731 SF) will used by the food establishment for storage.
This application includes changes to the exterior facades of the building along Burlingame Avenue and Lorton
Avenue. The applicant is proposing to create an open patio at the front of the space, similar to Crepevine at
1310 Burlingame Avenue and Urban Bistro at 270 Lorton Avenue (see Floor Plan on sheet A2.01). The existing
wood doors, wood frame operable windows and clerestory windows, fabric awnings and tile wainscoting along
both facades would be removed and replaced with the new storefront. The existing stucco siding, tile roofing,
wood eave brackets, gutter, scuppers and downspouts would remain. The proposed fa�ade along Burlingame
Avenue includes a new open patio, metal canopy and black aluminum frame sliding door system beyond the
patio. Along the Lorton Avenue fa�ade, the applicant is proposing an aluminum railing for the open patios,
black aluminum frame windows and door, a metal canopy, one-inch extruded concrete wainscoting and
perforated fabric on the existing awning frames.
Commercial Design Review and Conditional Use Permit Amendment 1125 Burlingame Avenue
A full service food establishment is defined as a business which sells food prepared indoors on the premise with
a full menu and provides an indoor seating area of at least two hundred fifty (250) square feet. Such businesses
may provide for the sale of alcoholic beverages as an accessory and secondary use. Operating criteria to define
a full service food establishment include most or all of the following: served by waiters to seated customers and
where payment is made at the end of the meal; presence of a full commercial kitchen and commercial
dishwasher; and food is served on ceramic plates with metal flatware and cloth napkins. The proposed food
establishment meets most of these operating criteria. Please refer to the applicant's letters, both dated January
10, 2014, for a description of the proposed business operation.
The proposed food establishment will be open seven days a week, from 10:00 a.m. to 10:00 p.m. on Sunday
through Thursday and from 10:00 a.m. to 12:00 a.m. on Friday and Saturday. The applicant is applying for a
Conditional Use Permit Amendment to increase the hours of operation on Friday and Saturday (previous
approval allowed the business to be open seven days a week from 10:00 a.m. to 10:00 p.m.)
When the business opens, the applicant anticipates having 11 full-time and 7 part-time employees before and
after 5 p.m. In five years, the number of employees is expected to increase to 12 full-time and 8 part-time. The
applicant is applying for a Conditional Use Permit Amendment to increase the maximum number of employees
on site at any one time (previous approval allowed 11 full-time and 3 part-time employees). At opening, the
applicant projects 120-180 customers per day on weekdays and 180-240 customers per day on weekends.
Food establishments located on the first floor within the parking sector of the Burlingame Downtown Specific
Plan shall be exempt from providing off-street parking (CS 25.70.090 (a)). Therefore, no additional off-street
parking is required for the proposed food establishment. The following applications are required:
■ Commercial Design Review for changes to the front fa�ade of an existing commercial storefront in the
BAC Zoning District (CS 25.32.045);
■ Conditional Use Permit Amendment to increase the hours of operation (from 10:00 a.m. to 10:00 p.m. on
Friday and Saturday to 10:00 a.m. to 12:00 a.m. on Friday and Saturday); and
■ Conditional Use Permit Amendment to increase the maximum number of employees on site at any one
time from 11 full-time and 3 part-time to 12 full-time and 8 part-time).

Study Meeting: At the Planning Commission Design Review Study meeting on February 10, 2014, the
Commission noted that the proposed open patio design concept reflects a desired design approach for
restaurants in the Downtown. With regards to materials, it asked the applicant to add a note on the plans
clarifying the material of the horizontal band on the Lorton and Burlingame Avenue facades below the sign
(February 10, 2014, Planning Commission Minutes). Please also refer to the attached meeting minutes for a
summary of Planning Commission discussion of the application.
The revised plans, date stamped February 13, 2014, note that the horizontal band will be a light band for the wall
signs and will contain an aluminum finish.
Design Review Criteria: The criteria for Commercial Design Review as established in Ordinance No. 1652
adopted by the Council on April 16, 2001 are outlined as follows:
1. Support of the pattern of diverse architectural styles that characterize the city's commercial areas;
2. Respect and promotion of pedestrian activity by placement of buildings to maximize commercial use of
the street frontage, off-street public spaces, and by locating parking so that it does not dominate street
frontages;

3. On visually prominent and gateway sites, whether the design fits the site and is compatible with the
surrounding development;
4. Compatibility of the architecture with the mass, bulk, scale, and existing materials of existing
development and compatibility with transitions where changes in land use occur nearby;
5. Architectural design consistency by using a single architectural style on the site that is consistent among
primary elements of the structure, restores or retains existing or significant original architectural features,
and is compatible in mass and bulk with other structure in the immediate area; and
6. Provision of site features such as fencing, landscaping, and pedestrian circulation that enriches the
existing opportunities of the commercial neighborhood.
Required Findings for a Conditional Use Permit: In order to grant an Amendment to a Conditional Use
Permit for a full service food establishment, the Planning Commission must find that the following conditions
exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or
convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action:
The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be
considered:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
February 13, 2014, sheets A0.01 through A3.02;
2. that this business location occupied by a full service food establishment, with 538 SF of on-site seating
may change its food establishment classification only to a limited food service or bar upon approval of a
conditional use permit for the establishment change; the criteria for the new classification shall be met in
order for a change to be approved;
3. that the 538 SF area of on-site seating of the full service food establishment shall only be enlarged or
extended to any other areas within the tenant space by an amendment to this conditional use permit;
4. this full service food establishment may be open Sunday through Thursday, from 10:00 a.m. to 10:00
p.m. and Friday and Saturday, from 10:00 a.m. to 12:00 a.m., with a maximum of 12 full-time employees
and eight part-time employees on site at any one time, including the business owner and manager;

5. that this food establishment shall provide trash receptacles as approved by the city consistent with the
streetscape improvements and maintain all trash receptacles at the entrances to the building and at any
additional locations as approved by the City Engineer and Fire Department;
6. that the business shall provide litter control along all frontages of the business and within fifty (50) feet of
all frontages of the business;
7. that an amendment to this conditional use permit shall be required for delivery of prepared food from
this premise;
8. that there shall be no food sales allowed at this location from a window or from any opening within 10' of
the property line;
9. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
10. that seating on the sidewalk outside the food establishment shall require an encroachment permit and
shall conform to the requirements of any encroachment permit issued by the city;
11. that the conditions of the Building Division's December 9, 2013, January 14, 2014 and January 23, 2014
memos, the Parks Division's December 11, 2013 memo, the Engineering Division's December 17, 2013
memo, the Fire Division's December 16, 2013 memo and the Stormwater Division's December 11, 2013
memo shall be met;
12. that the project shall meet all the requirements of the California Building Code and California Fire Code,
2013 edition, as amended by the City of Burlingame, and that failure to comply with these conditions or
any change to the business or use on the site which would affect any of these conditions shall require an
amendment to this use permit;
13. that any changes to the size or envelope of building, which would include changing or adding exterior
walls or parapet walls, shall require an amendment to this permit;
14. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staf�;
15. that demolition or removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
16. that prior to issuance of a building permit for construction of the project, the project construction plans
shall be modified to include a cover sheet listing all conditions of approval adopted by the Planning
Commission, or City Council on appeal; which shall remain a part of all sets of approved plans
throughout the construction process. Compliance with all conditions of approval is required; the
conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
17. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;

18. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management
and Discharge Control Ordinance;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:
19. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window locations
and bays are built as shown on the approved plans; if there is no licensed professional involved in the
project, the property owner or contractor shall provide the certification under penalty of perjury.
Certifications shall be submitted to the Building Department; and
20. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural
details (trim materials, window type, etc.) to verify that the project has been built according to the
approved Planning and Building plans.

I have been asked by my client Stanley Chan to prepare this letter in response to the Planning
Division's Comments regarding Mr. Chan's application for Commercial Design Review related
to 1 l25 Burlingame Avenue, plans dated December 6, 2013.
1. Food Establishment Use (Code &25.32.070): The planned business will be a full service
restaurant establishment serving food from a full menu. It is also intended that the restaurant
will serve alcoholic beverages as an accessory and secondary use. The restaurant shall have
more than 250 sq. ft. of indoor seating. Waiters will serve food to seated customers. Customers
will pay for their meal at the end of their meal. The restaurant will have a full commercial
kitchen and a commercial dishwasher on premises. Food will be served on ceramic plates with
metal flatware and cloth napkins.
The restaurant seeks amendments to the Conditional Use Permit as approved on June 23, 2006.
Please see the attached Request for Amendment to the Conditional Use Permit and the related
Conditional Use Permit Application and Commercial Applications supplemental forms attached
thereto.
4. Determioation of Public Necessitv and Convenience: The restaurant intends to serve
alcoholic beverage under a Type 47 license from the Department of Alcoholic Beverage Control.
The previously operating premises offered alcoholic beverages at this location. In consultation
with the ABC, the restaurant owner has learned that a hearing regarding Determination of Public

with alcoholic beverages served as an accessory. There is no plan to change the existing use. Applicant has
submitted plans for tenant improvements to update the premises for its full service restauraut usc. The planned
use is consistent with Burlingame Code Section 25.32.070. There aze no anticipated changes to the traffic,
noise, lighting, paving, landscaping, sunlighUshade or views from the neii;hboring property. All public healt6,
safety and general welfare considerations will remain consistent with prior use and compliance.
Existing sanitation systems remain in place and have been inspected for proper funcUon and compliance with
Code. Fire suppression systems are existing in the premises and have been inspected for proper function and
compliance with Code. There should be no negative effect on public convenience as the use remains
consistent with prior use.
How will the proposed use be located and cundueted in aeeordanee with the Burlingante
General Plan and Zoning Ordinanee?
The applicant's proposed full service restaurant use will be located and conducted in the
same fashion as the previous full service restaurant, consistent with the Burlingame Avenue
Commercial District, Subarea A Zoning Ordinance. Applicant has consulted with its
Burlingame Planning Division representative and reviewed the applicable Codes. (Please
see applicant's letter in response to the Planning Division's questions confirming intended
use as a full service food establishment consistent with the Burlingame Code.)
How will the proposed project be compatible with the aesthedes, mass, bulk and charaeter of
the existing and polential uses on adjoining properties in the general vicinity?
The applicant's use of the existing structure does not pose an aesthetic, mass or bulk change of
character to existing or adjoining properties. The planned changes to the existing structure
include internal design changes to be consistent with the full service restaurant use. The
proposed design change for the entrance expands the existing outdoor space, yet remains

• Discharge the wash water to landscaping or to the sanitary sewer (with permission from the local
sanitary sewer agency). If this is not an option, haul the wash water off-site for proper disposal.

on-site seating may change its food establishment classification only to a limited food
service or bar upon approval of a conditional use permit for the establishment change;

History: On June 12, 2006, the Planning Commission approved a Conditional Use Permit Amendment to
change the classification of an existing food establishment from a specialty shop to a full service food
establishment and to increase the seating area from 385 SF to 875 SF at 1125 Burlingame Avenue. Over the
years, there have been several full service food establishments which have operated at this location; the space
is currently vacant.
With this application, the applicant is requesting a Conditional Use Permit Amendment to increase the hours of
operation and maximum number of employees on site at any one time.
Summary: The subject building is located at the corner of Burlingame Avenue and Lorton Avenue. The
applicant is proposing to replace an existing full service food establishment which recently closed at 1125
Burlingame Avenue, zoned BAC. The proposed restaurant, a Japanese fusion sushi bar, will be open for lunch
and dinner. The applicant currently operates a similar restaurant, iSushi, in Castro Valley. The food
establishment would contain customer seating, a kitchen, back of house area and restrooms. The proposed
food establishment will have approximately 538 SF of customer seating. The food establishment measures
approximately 2,644 SF in area (1,913 SF on the ground floor and a 731 SF basement). The existing basement
(731 SF) will used by the food establishment for storage.
This application includes changes to the exterior facades of the building along Burlingame Avenue and Lorton
Avenue. The applicant is proposing to create an open patio at the front of the space, similar to Crepevine at
1310 Burlingame Avenue and Urban Bistro at 270 Lorton Avenue (see Floor Plan on sheet A2.01). The existing
wood doors, wood frame operable windows and clerestory windows, fabric awnings and tile wainscoting along
both facades would be removed and replaced with the new storefront. The existing stucco siding, tile roofing,
wood eave brackets, gutter, scuppers and downspouts would remain. The proposed fa�ade along Burlingame
Avenue includes a new open patio, metal canopy and black aluminum frame sliding door system beyond the
patio. Along the Lorton Avenue farade, the applicant is proposing an aluminum railing for the open patios,
black aluminum frame windows and door, a metal canopy, one-inch extruded concrete wainscoting and
perforated fabric on the existing awning frames.
A full service food establishment is defined as a business which sells food prepared indoors on the premise with
a full menu and provides an indoor seating area of at least two hundred fifty (250) square feet. Such businesses
may provide for the sale of alcoholic beverages as an accessory and secondary use. Operating criteria to define
a full service food establishment include most or all of the following: served by waiters to seated customers and
where payment is made at the end of the meal; presence of a full commercial kitchen and commercial
dishwasher; and food is served on ceramic plates with metal flatware and cloth napkins. The proposed food
establishment meets most of these operating criteria. Please refer to the applicant's letters, both dated January
10, 2014, for a description of the proposed business operation.
Commercial Design Review and Conditional Use Permit Amendment 1125 Burlingame Avenue
The proposed food establishment will be open seven days a week, from 10:00 a.m. to 10:00 p.m. on Sunday
through Thursday and from 10:00 a.m. to 12:00 a.m. on Friday and Saturday. The applicant is applying for a
Conditional Use Permit Amendment to increase the hours of operation on Friday and Saturday (previous
approval allowed the business to be open seven days a week from 10:00 a.m. to 10:00 p.m.)
When the business opens, the applicant anticipates having 11 full-time and 7 part-time employees before and
after 5 p.m. In five years, the number of employees is expected to increase to 12 full-time and 8 part-time. The
applicant is applying for a Conditional Use Permit Amendment to increase the maximum number of employees
on site at any one time (previous approval allowed 11 full-time and 3 part-time employees). At opening, the
applicant projects 120-180 customers per day on weekdays and 180-240 customers per day on weekends.
Food establishments located on the first floor within the parking sector of the Burlingame Downtown Specific
Plan shall be exempt from providing off-street parking (CS 25.70.090 (a)). Therefore, no additional off-street
parking is required for the proposed food establishment. The following applications are required:

I have been asked by my client Stanley Chan to prepare this letter in response to the Planning
Division's Comments regarding Mr. Chan's application for Commercial Design Review related
to 1125 Burlingame Avenue, plans dated December 6, 2013.
1. Food Establishment Use (Code &25.32.0701: The planned business will be a full service
restaurant establishment serving food from a full menu. It is also intended that the restaurant
will serve alcoholic beverages as an accessory and secondary use. The restaurant shall have
more than 250 sq. ft. of indoor seating. Waiters will serve food to seated customers. Customers
will pay for their meal at the end of their meal. The restaurant will have a full commercial
kitchen and a commercial dishwasher on premises. Food will be served on ceramic plates with
metal flatware and cloth napkins.
The restaurant seeks amendments to the Conditional Use Permit as approved on June 23, 2006.
Please see the attached Request for Amendment to the Conditional Use Permit and the related
Conditional Use Permit Application and Commercial Applications supplemental forms attached
thereto.
4. Determination of Public Necessitv and Convenience: The restaurant intends to serve
alcoholic beverage under a Type 47 license from the Department of Alcoholic Beverage Control.
The previously operating premises offered alcoholic beverages at this location. In consultation
with the ABC, the restaurant owner has learned that a hearing regarding Determination of Public
Convenience and Necessity will not be required by the City of Burlingame as a condition of to

noise, lighting, paving, landscaping, sunlighUshade or views from the neighboring property. All public health,
safety and general welfare considerations will remain consistent with prior use and compliance.
Existing sanitation systems remain in place and have been inspected for proper function and compliance with
Code. Fue suppression systems are eacisting in the premises and have been inspected for proper function and
compliance with Code. There should be no negative effect on public canvenience as the use remains
consistent with prior use.
2. How will the proposed use be located and conducted in accordance with the Burlingame
General Plan and Zoning Ordinance?
The applicant's proposed full service restaurant use will be located and conducted in the
same fashion as the previous full service restaurant, consistent with the Burlingame Avenue
Commercial District, Subarea A Zoning Ordinance. Applicant has consulted with its
Burlingame Planning Division representative and reviewed the applicable Codes. (Please
see applicant's letter in response to the Planning Division's questions confircning intended
use as a full service food establishment consistent with the Burlingame Code.)
3. How will the proposed project be compatible with the aesthetics, mass, bulk and character of
the existing and potential uses on adjoining properties in the general vicinity?
The applicant's use of the existing structure does not pose an aesthetic, mass or bulk change of
character to existing or adjoining properties. The planned changes to the existing structure
include intemal design changes to be consistent with the full service restaurant use. The
proposed design change for the entrance expands the existing outdoor space, yet remains
within the existing building's footprint.

Copper from Buildings May Harm Aquatic Life
Copper can harm aquatic life in San Francisco Bay. Water that comes
into contact with architectural copper may contribute to impacts,
especially during installation, cleaning, treating, or washing. Patination
solutions that are used to obtain the desired shade of green or brown
typically contain acids. After treatment, when the copper is rinsed to
remove these acids, the rinse water is a source of pollutants.
Municipalities prohibit discharges to the storm drain of water used in the
installation, cleaning, treating and washing of architectural copper.

• If possible, purchase copper materials that have been pre-patinated at the factory.
� If patination is done on-site, implement one or more of the following BMPs:
o Discharge the rinse water to landscaping. Ensure that the
rinse water does not flow to the street or storm drain.
Block off storm drain inlet if needed.
o Collect rinse water in a tank and pump to the sanitary
sewer. Contact your local sanitary sewer agency before
discharging to the sanitary sewer.
o Collect the rinse water in a tank and haul off-site for
proper disposal.
• Consider coating the copper materials with an impervious
coating that prevents further corrosion and runoff. This will
also maintain the desired color for a longer time, requiring
less maintenance.
Du�ing Maintenance
Implement the following BMPs during routine maintenance activities, such as power washing the roof,
re-patination or re-application of impervious coating:
• Block storm drain inlets as needed to prevent runoff from entering storm drains.
• Discharge the wash water to landscaping or to the sanitary sewer (with permission from the local
sanitary sewer agency). If this is not an option, haul the wash water off-site for proper disposal.
Protect the Bay/Ocean and yourself!
If you are responsible for a discharge to the storm drain of non-
stormwater generated by installing, cleaning, treating or washing
copper architectural features, you are in violation of the municipal
stormwater ordinance and may be subject to a fine.
