Previous Use: retail bakery and food establishment (Le Petite Boulangerie and Java City Cafe). Proposed Use: Mexican food made to order in a 40 seat food establishment Allowable Use: take out services associated with a retail use require a special permit. Summary: The applicant is proposing a Mexican food establishment with take out services. The tenant is leasing 1,080 SF wliich is part of the 15,400 SF parcel on the corner of Lorton and Burlii�game Avenues. '1'l�e restaurant opened for business the week before Thanksgiving. There is seating for 40 people and the applicant anticipates that the take out portion of the business will be less than 5%. This space was previously leased by Java City Cafe and Le Petite Boulangerie, both bakeries with tables and chairs. Take out food sales require a special permit in the C-1 zoning district. The Mexican food establishment will be open seven days a week 10:00 A.M. to 10:00 P.M.. They anticipate a maximum of iive employees today, and in iive years. A maximum of 70 customers are expected during days and 130 in the evening with a projection of 80 - 140 in iive years. The maximum number of customers and employees on site at any one time is 45. Parking is not required For first floor retail uses including food establishments in Subarea A of the G1 zoning district. There is no parking on site. Parking is available along Burlingame Avenue and in nearby public parking lots (Lot M on California Avenue has 25 stalls; Lot E between Lorton and Park Road has 6$ stalls). Meets all other zoning code requirements. Staff Comments: The City Engineer notes (November 20, 1995 memo) that a trash container shall be placed in front of the store on Burlingame Avenue. The container shall be purchased and maintained by the applicant. Also the store shall maintain the sidewalk within 50' of the store front including regtilar 'policing' by the business for litter control. The Fire Marshal and Chief Building Inspector (November 20, 1995 memos) had no comments. Required Findings for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: � SPECIAL PERMIT for TAKG OUT Conditions: I125 Burlingame Avenue 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped November 14, 1995 Sheet A0.0 Title Sheet and Site Location, and Sheet A2.11 Floor Plan; 2. that the conditions of the City Engineers' November 20, 1995 memo shall be met; 3. that the business will be open 10:00 A.M. to 10:00 P.M, seven days a week with a ma�cimum of iive employees at any one time; 4. that the applicant shall purchase and maintain at least daily, more often if necessary, a trash receptacle of a type approved by the City, at the door along Burlingame Avenue, or at locations as approved by the City Engineer and Fire Department; 5. that the applicant shall remove once a day or more frequently if determined to be necessary by t11e City, all take out debris on the sidewalk, in the gutter, and in planters, in front of the store along Burlingame Avenue and Lorton Avenue, and within 50' of the store; and 6. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. The space is approximately 1,080 square feet and �vas fornierly occupied by the Java City� Bakery Cafe. The new facility will consist of LaSalsa fresh Mexican grill. Our operation serves fresh Me�ican food made to order. We do not have servers as the customer orders and picks up the food at the counter, We anticipate that most of our customers �vill consume their food on the premises. We would also like to offer our food to go to those customers within walking distance who prefer to take their lunch back to their office or place of business. Although we do not anticipate a significant portion of our business to be take-out (less than �%) we would like to provide our customers with this feature. Consequently, �i�e respectfully ask that you approve our application for take out food. This location will have approzimatel}� 30 seats. Since «�e scrve our food on disposable flatware and throw• away utensils it is possible for customers to take our food off the premises. Ho���ever, our particular operation focuses on the fresh grillcd approach to Me�ican food featuring large portioned burritos, nachos, tacos etc. and «�e have found that most of our customers prefer to eat on premises. As a matter of fact we have opened a couple of drive-thru locations in southern California and have discovered that this is not our niche in the market. Due to our fresh grill approach we imitate morc of a sit do���n ty�e of atmosphere than a fast food restaurant. Since this location is located within the center of the central business district, it will be highly unusual and much less convenient for a customer to attempt to secure a parking space, place mone_y in the meter, ptirchase food at our facility and take it home. If our concept becomes that desirable, we will no doubt open a second facility close by. However, as mentioned earlier there will always be a number of close by patrons ���ho find a need to take their lunch back to tl�e office or other work place. RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for take out food at _1125 Burlin�ame Avenue APN• 029-211-260 ; property owner• Sandra York, 296 Bay View Avenue Belvedere�; and WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on December 11, 1995 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a signiiicant effect on the environment, and categorical exemption per Section: 15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2.
