An application for a Conditional Use Permit for a limited food service food establishment at 1118
Burlingame Avenue was approved by the Planning Commission (PC) on August 9, 2010, and became
effective on August 19, 2010.
The proposed business at 1118 Burlingame Avenue, TPumps Burlingame, must comply with the
conditions of approval for the previously approved Conditional Use Permit as outlined in the attached
letter dated August 20, 2010.
As evidence of your agreement to comply with the conditional of approval, please sign the
acknowledgement following my signature line and provide me with an original signed copy of this
document. Once the signed acknowledgement is received, the Planning Division will complete its
review of your construction documents for the use.

Since there was no appeal to or suspension by the City Council, the August 9, 2010, Planning
Commissian approval of your application for Conditional Use Permit became effective August 19,
2010. This application was for a new limited food service food estabfishment at 1118 Burfingame
Avenue, zoned C-1, Subarea A, Burfingame Avenue Commercial Area.
The August 9, 2010 minutes of the Planning Commission state your appfication was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to fhe Planning Division date
stamped July 19, 2010, sheets A-0 through A-3, HD-1, AD-0, E-1 and E-2, and P-1 and
P-2;
2. that this business location to be occupied by a limited food service food establishment, with
145 SF of seating area, may change its food establishment classification oniy to a fu(I
service food establishment or bar upon approvai of a con�itional use permit amendment for
the establishment, and the criteria for the new ciassification shall be met in order for a
change to be approved;
3. that the 145 SF area of or-site seating of the fimited food service food estabiishment shalf
be enlarged or extended to any other areas within the te�ant space only by an amendment
to this conditional use permit;
4. that this foo� establishment shali provide trash receptacie(s} as approved by the cify
consistent with the streetscape improvements and maintain all trash receptacle(s) at the
entrances to the building and at any additional locations as approved by the Gity Engineer
and Fire Department;

7. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
8. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit sha(I
become void;
9. that any seating on the sidewalk outside shall conform to the requirements of any
encroachment permit issued by the city;
10. fhat the conditions of the Chief Building Official's July 2, 2010 memo, the Fire Marshai's
July 1, 2010 memo, the Cify Engineer's July 12, 2010 memo, the Parks Supervisors July 9,
2010 memo and the NPDES Coordinator's July 2, 2010 memo shall be met; and
11. that the project shall meet ali the requirements of the California Building Cade and
California Fire Code, 2007 edition, as amended by the City of Burlingame, and that failure
to comply with these conditians or any change to the business ar use on the site which
would afFect any of these conditions shail require an amendment to this use permit.
All site improvements and construction work v�ill require separate app(ication to the Buifding
Department. This approval is valid for three years during which time a building permit must be
issued. One extensian of up to iwo years may be considered by the Planning Commission if
application is made befare the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civii Procedure
Section 1094.6. If you wish to chailenge the decision in a court of competent jurisdiction, you must
do so within 90 days af the date of the decision unless a shorter time is required pursuant to state or
federal law.
