History: On June 21, 2010, the City Council adopted Ordinance 1849, which allows up to five additional food
establishments at any location within Subarea A of the Burlingame Avenue Commercial Area, so long as the
food establishment is limited to only a food establishment use classified as full service, limited food service or
bar, upon approval of a Conditional Use Permit. This ordinance change was adopted on June 21, 2010, and
became effective on July 21, 2010. The applicant is requesting a Conditional Use Permit for a new limited food
service food establishment. This is the first application for a new food establishment in the Burlingame Avenue
Commercial Area since the ordinance was adopted.
Summary: The applicant is proposing to operate a new limited food service food establishment, ULove Yogurt,
at 1118 Burlingame Avenue, zoned C-1, Subarea A of the Burlingame Avenue Commercial Area. Currently, the
tenant space is vacant but was most recently occupied by a retail use. The tenant space measures 1,669 SF.
The food establishment will contain customer seating, a service area, self serve yogurt machines, a preparation
area, storage rooms and a restroom. The following application is required:
• Conditional Use Permit for a new limited food service food establishment in the Subarea A of the
Burlingame Avenue Commercial Area with 145 SF of on-site seating area.
A limited food service food establishment is defined as a business which sells food which is readyto eat such as
sandwiches, frozen deserts or beverages served in edible, plastic or disposable containers. Operating criteria to
define a limited food service include some or all of the following: no commercial kitchen; no commercial dish
washer; take out food service only; and an indoor seating area of less than finro hundred-fifty (250) square feet.
The proposed limited food service food establishment fulfills all of these criteria.
The limited food service food establishment will have approximately 145 SF of seating area. Chairs and bench
seating will be provided for customers. The business will have a maximum of 2 part-time employees on
weekdays and 1 full-time employee on weekends for each shift. On weekdays, the applicant projects a total of
200 customers per day before 5:00 p.m. and 400 customers after 5:00 p.m. On weekends, 500 customers per
day are expected before and after 5:00 p.m. In the future, the applicant anticipates a total of 300 customers
before 5:00 p.m. and 400 customers after 5:00 p.m. on weekdays. The applicant expects no change in the
number of customers on weekends in the future. A maximum of 4 people are expected on site at any one time,
including employees and customers. The food establishmentwill be open seven days a week, from 11:00 a.m. to
11:00 p. m.
Conditional Use Permit

Personal and retail services on the first floor in the Burlingame Avenue Commercial Area are exempt from
vehicle parking requirements as set forth in code section 25.36.040 (d). In the Burlingame Avenue Commercial
Area, a food establishment is considered to be a retail use for parking purposes. Therefore, since there is no
intensification of use proposed with this application (retail to retail), no additional on-site parking is required.
Staff would note that public parking is available on the street and in neighboring public Lots D(49 stalls), E(70
stalls), M(26 stalls) and V(19 stalls).

Study Meeting: At the July 26, 2010, Planning Commission study meeting, the Commission had several
questions regarding the application. Below are responses to those questions.
1. There is an error on the p/an; if shows doors opening onto the public sidewa/k; this needs to be
corrected. (Hurin — nofed fhat fhe door is inset into fhe fa�ade, but will re-check fo ensure that it is
proper/y represenfed on the plans.) Will a door change trigger commercial design review? (Hurin —
on/y if it is a significant change to the fa�ade.)
� Although not shown on the proposed plans, the front entry is recessed from the property line by
approximately 5'-0", which allows the doors to swing out as required by the Building Division. The plans
are inconsistent because some of the sheets show the doors swinging in and other show them swinging
out. In the interest of saving paper the plans were not revised. However, Planning staff will ensure that
the plans are corrected for the building permit submittal.
Since the existing aluminum doors will not be changed, commercial design review is not required.
2. lnclude a condition requiring regu/ar sidewalk cleaning.

Required Findings for a Conditional Use Permit: In order to grant a conditional use permit for a limited food
service food establishment, the Planning Commission must find that the following conditions exist on the
property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or
convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action:
The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be
considered:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped July
19, 2010, sheets A-0 through A-3, HD-1, AD-0, E-1 and E-2, and P-1 and P-2;
2. that this business location to be occupied by a limited food service food establishment, with 145 SF of
seating area, may change its food establishment classification only to a full service food establishment or
bar upon approval of a conditional use permit amendment for the establishment, and the criteria for the
new classification shall be met in order for a change to be approved;
3. that the 145 SF area of on-site seating of the limited food service food establishment shall be enlarged or
extended to any other areas within the tenant space only by an amendment to this conditional use
permit;
4. that this food establishment shall provide trash receptacle(s) as approved by the city consistent with the
streetscape improvements and maintain all trash receptacle(s) at the entrances to the building and at any
additional locations as approved by the City Engineer and Fire Department;
5. that the business shall provide litter control and sidewalk cleaning along all frontages of the business and
within fifty (50) feet of all frontages of the business;
6. that an amendment to this conditional use permit shall be required for delivery of prepared food from this
premise;
7. that there shall be no food sales allowed at this location from a window or from any opening within 10' of
the properry line;
8. that if this site is changed from any food establishment use to any retail or other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;

9. that any seating on the sidewalk outside shall conform to the requirements of any encroachment permit
issued by the city;
10. that the conditions of the Chief Building Official's July 2, 2010 memo, the Fire Marshal's July 1, 2010
memo, the City Engineer's July 12, 2010 memo, the Parks Supervisors July 9, 2010 memo and the
NPDES Coordinator's July 2, 2010 memo shall be met; and
11. that the project shall meet all the requirements of the California Building Code and California Fire Code,
2007 edition, as amended by the City of Burlingame, and that failure to comply with these conditions or
any change to the business or use on the site which would affect any of these conditions shall require an
amendment to this use permit.

1. The proposed location will be not detrimental or injurious to property.
The site will used as a frozen yogurt shop. We will follow the proper
ordinance from the city. We wil) have proper disposal of nl) waste and
keep the area clean. The alarm systems and sprinklers nre nlready
installed. The structure is already saund, will not need any or very
little police and fire protection. We will not be using any flammable or
hazardous materials. As for convenience, downtown Burlingame
already hns several pnrking lots, each access to the surrounding
stores
2. The space is located in downtown Burlingame. The yogurt shop will
only improve the business district. It will bring business to downtown
Burlingame, more foot traffic for other stores in the vicinity.
3. The yogurt shop will be a welcome addition to downtawn Burlingame.
The space is filled, no (onger loaking deserted. The new shop will not
changed the existing structure. Also this will not change the overall
fee) and character of the neighborhood. This is not the first yogurt
shop in the neighborhood. One used to be (ocnted behind Sephora.
We feel the proposed project would bring additiona) foot traffic to
area.

On the plans specify that this project will comply with the 2007 California Building
Codes (CBC).
Anyone who is doing business in the City must have a current City of Burlingame
business license.
Provide fully dimensioned plans.
Provide existing and proposed elevations.

1. Replace all displaced/damaged sidewalk, driveway, curb and gutter.
2. Project plans need to show designated area for garbage bins and cleaning
purposes.
3. This project is located within the business district and is required to conform
to the Streetscape Master Plan. A specific type of garbage receptacle shall be
placed in front of project site. The sidewalk fronting the store shall be kept

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution from construction
activities. Project proponent shall ensure all contractors implement Best
Management Practices (BMPs) during construction.
Please include a list of construction stormwater pollution prevention best
management practices (BMPs), as project notes, when submitting plans for a
building permit. Please see attached brochure for guidance. The brochure may also
be down loaded directly from "flowstobay.org." It is recommended that the
construction BMP's be placed on a separate full size plan sheet (2' x 3` or larger as
appropriate) for readability.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
Conditional Use Permit for a new limited food service food establishment at 1118 Burlinqame
Avenue, zoned C-1, Subarea A, Burlingame Avenue Commercial Area, Lorenz and Louisa Zee

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
August 9, 2010, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per CEQA Article 19, Section: 15301 -
Existing facilities, Class 1(a), interior or exterior alterations involving such things as
interior partitions, plumbing, and electrical conveyances, is hereby approved.
2. Said Conditional Use Permit is approved subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Conditional Use Permit are set forth in the staff
report, minutes, and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official

2. that this business location to be occupied by a limited food service food establishment,
with 145 SF of seating area, may change its food establishment classification only to a
full service food establishment or bar upon approval of a conditional use permit
amendment for the establishment, and the criteria for the new classification shall be met
in order for a change to be approved;

History: On June 21, 2010, the City Council adopted Ordinance 1849, which allows up to five additional
food establishments at any location within Subarea A of the Burlingame Avenue Commercial Area, so long
as the food establishment is limited to only a food establishment use classified as full service, limited food
service or bar, upon approval of a Conditional Use Permit. This ordinance change was adopted on June
21, 2010, and became effective on July 21, 2010. The applicant is requesting a Conditional Use Permit
for a new limited food service food establishment. This is the first application for a new food establishment
in the Burlingame Avenue Commercial Area since the ordinance was adopted.
Summary: The applicant is proposing to operate a new limited food service food establishment, ULove
Yogurt, at 1118 Burlingame Avenue, zoned C-1, Subarea A of the Burlingame Avenue Commercial Area.
Currently, the tenant space is vacant but was most recently occupied by a retail use. The tenant space
measures 1,669 SF. The food establishment will contain customer seating, a service area, self serve
yogurt machines, a preparation area, storage rooms and a restroom. The following application is required:
• Conditional Use Permit for a new limited food service food establishment in the Subarea A of the
Burlingame Avenue Commercial Area with 145 SF of on-site seating area.
A limited food service food establishment is defined as a business which sells food which is ready to eat
such as sandwiches, frozen deserts or beverages served in edible, plastic or disposable containers.
Operating criteria to define a limited food service include some or all of the following: no commercial
kitchen; no commercial dish washer; take out food service only; and an indoor seating area of ►ess than
two hundred-fifty (250) square feet. The proposed limited food service food establishment fulfills all of
these criteria.
The limited food service food establishment will have approximately 145 SF of seating area. Chairs and
bench seating will be provided for customers. The business will have a maximum of 2 part-time

The site will used as n frozen yogurt shop. We will follow the proper
ordinance from the city. We wi11 have proper disposal of all waste and
keep the nrea clean. The alarm systems and sprinklers nre nlready
installed. The structure is alrendy sound, will not need any or very
little police and fire protection. We will not be using any flammable or
hazardaus mnterials. As for convenience, downtown Burlingame
