Parking Variance and Conditional Use Permit for Training Facility

Summary: The applicant, Arlen Wall, TSH Architects, is requesting a parking variance and conditional use
permit to allow a computer training facility in an existing 5288 SF SF office space at 1350 Bayshore Highway,
Suites 650 & 660, zoned C-4. There are 176,533 SF total in the building at 1350 Bayshore Highway. There
will be 4 training rooms totaling 3215 SF within this office space. The following applications are required:
1. A conditional use permit is required for a classroom use in the C-4 zone district.
2. A 53 space parking variance is reqtiired for converting 3215 SF of ofiice space to classroom use (538
spaces provided, 591 spaces required).
The applicant notes that the proposed tenant, the Trinity Group, is a computer training facility which brings
in clients from around the western United States. Their training sessions are limited to no more than 12
trainees per session a�ld operate only 2 sessions at any one time. Training sessions are held about two weeks
out of the month and the balance of the time is in preparation for the tipcoming sessions. They are proposing
four training rooms to allow them time to set up teaching materials and prepare for upcoming sessions. The
applicant states that 90% of the trainees stay at tl�e Hyatt Regency Hotel across the street and walk across the
street to the training sessions.
There are now 538 parking spaces for the 176,533 SF, nine-story office building located at 1350 Bayshore
Highway. The building met the code requirement for parking spaces when it was built in 1980. The applicant
has provided a list of the current tenants in the building (see attached list date stamped October 21, 1998).
The conversion of the 3215 SF of office space (1 space per 300 SF) to classroom use (1 space per 50 SF)
requires an additional 53 parking spaces. Therefore, a variance is required for providing 538 spaces where
591 spaces are required.

CONDITIONAL USE PERMIT AND PARKING VARIANCE 1350 Bnysliore High�vay, Suites 650 & 660
This property is zoned C-4 and is located in the portion of the C-4 zone across the street from the O-M
district. In the O-M zone district regulations adopted in 1994, class or school use in an office structure
exceeding 20,000 SF and witli parking provided at a ratio of 1 space for each 300 SF of gross floor area is
allowed by right. Classroom uses only require a conditional use permit in office structures less than 20,000
SF. The reasoning used for adoption of this code requirement in the O-M district was that in larger office
buildings, the parking needs and trafiic generation for the classrooms would be balanced by other uses
occupying the building.
The proposed training facility will be open Monday through Friday from 9:00 a.m. to 5:00 p.m. and will not
be open on weekends. There will be a ma�cimum 24 students and 3 employees for a total of 27 people on site
at any one time. The numbers of employees a��d students are expected to stay the same in 5 years. No trucks
or service vehicles are expected to park on tlle site for this business.

This project meets all other zoning code requirements.
Staff Comments: The Chief Building Ofticial, the Fire Marshal and the City Engineer had no comments on
the project.
Findings for a Variance: In order to grant a variance the Planning Commission must iind that the following
conditions exist on the property (Code Section 25.54.020 a-d):

that do not apply generally to property in the same district;
the granting of the application is necessary for the preservation and enjoyment of a substantial property
right of the applicant, and to prevent unreasonable property loss or unnecessary hardship;
the granting of the application will not be detrimental or injurious to property or improvements in the
vicinity and will not be detrimental to the public health, safety, general welfare or convenience;
that the use of the property will be compatible with the aesthetics, mass, bulk and character of existing
and potential uses of properties in the general vicinity.

Findings for a Conditional Use Pei'llllt: In order to grant a Conditional Use Permit the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Act.ion: The Planning Conunission should hold a public hearing. Affirmative action
should be taken by resolution and should include findings. The reasons for any action should be clearly stated.
At the public hearing the following conditions should be considered:
Conditions:
1. that the project shall be built as shown o�1 the plans submitted to the Planning Department and date
stamped October 21,1998, Sheets A0.01, A1.01, A2.01, A7.01 and A9.01;
2. that the computer training facility may not be open for business except during the hours of 8:00 A.M.
to 5:00 P.M. Monday through Friday, with no more than twenty-four students and 3 instructors and
employees on site at any one time;
3. that at least one-half of all the students in each training session shall not arrive at class by automobile,
if more than half the students for a session will arrive by individual automobiles the business operator
shall provide a bus to take the students to and from the place where they are staying;
4, that the business operator shall implement a TSM program for his employees and shall provide
iinancial incentives to his employees for participating in such a program; and
5. that any improvements for tlle use shall meet all California Building and Fire Codes, 1995 Edition as
amended by the City of Burlingame.

City of Burlingame Variance Application Project Description
The Trinity Group, is an e�sting tenant at One Bay Plaza, a commercial office building located at 1350
Old Bayshore Highway. They are proposing to move from their current space located in the lower level of
1350 Old Bayshore Highway, to a new 4, 993 square foot space on the sixth floor of the same off'ice
building. Their new space shall consist of (4) training rooms (two more than they currently have ), offices
and reception area.

located in the lower level of this building to a(4) training room facility on the sixth floor. They are
expanding to (4) training rooms to allow them time to set up teaching materials and prepare for
upcoming sessions.
The Trinity Group use their cunent facility about 2 weeks out of the month for training sessions and the
balance of the time is in preparation for upcoming sessions. They are located at this site because of its
proximity to the airport and the Hyatt Regency Hotel, located across the street. Approximately 90% of
their trainees stay at the hotel and walk across the street to their training sessions.
We are applying for a special permit because this facility closest classification is a"Trade School" and is
located along the C-4 Waterfront Commercial District, however this facility is not open to the general
public. Their training sessions are limited to specific corporate clients.
We are applying for a variance because we are 14 stalls short of ineeting the parking stall requirement of
551 parldng stalls for the building site if we take into account that all the training rooms are occupied at
once. If this facility were to be viewed as general office, the existing parking requirements for an office
building of 1 parking stall per 300 square feet are in compliance.
We believe that there grounds for this variance for the following reasons:
1. The Trinity Group will not use all (4) training rooms at once.
2. This tenant brings over 90% of their trainees from out of town and boards them at the Hyatt Hotel
across the street thereby causing no impact on existing parking (it actually may reduce the parking
demand).
3. This tenant only has training sessions 2 weeks of the month on average.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
_November 23, 199g , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments

1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 21,1998, Sheets A0.01, A1.01, A2.01, A7.01 and A9.01;
2. that the computer training facility may not be open for business except during the hours of
8:00 A.M. to 5:00 P.M. Monday through Friday, with no more than twenty-four students
and 3 instructors and employees on site at any one time;
3. that at least one-half of all tlle students in each training session shall not arrive at class by
automobile, if more than half the students for a session will arrive by individual automobiles
the business operator shall provide a bus to take the students to and from the place where
they are staying;
4. that the business operator shall implement a TSM program for his employees and shall
provide financial incentives to his employees for participating in such a program; and
5. that any improvements for the use shall meet all California Building and Fire Codes, 1995
Edition as amended by the City of Burlingame.
