Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the
operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private
structures, facilities, mechanical equipment ortopographical features, involving negligible or no expansion of use
beyond that existing at the time of the lead agency's determination are exempt from environmental review.
Project Description: The applicant, Ferenc Pataki, is requesting a Conditional Use Permit to operate a
massage establishment (therapeutic massage) in an existing finro-story commercial building at 1340 Bayshore
Highway. The subject tenant space (2946 SF) is located on the ground floor at the rear of the building and was
most recently occupied by an office use (currently vacant). Burlingame Municipal Code Section 25.45.025 Q)
requires a Conditional Use Permit for a massage establishment in the SL zoning district.
In a letter dated August 28, 2009, the applicant notes that the business will offer "therapeutic massage to the
general public by certified massage technicians" and further notes that "our therapeutic massage will involve
manipulating the bodywith structured pressure with the therapist's hands, fingers, elbows and forearms". Foot
and chair massages will also be offered. The applicant is planning to employ four certified massage technicians
and two receptionists.
The applicant currently operates a similar massage establishment, Siesta Massage, at 2771 EI Camino Real in
Redwood City (San Mateo Countyjurisdiction). Planning staff contacted the County of San Mateo Planning and
Code Compliance Divisions and learned that there have been no complaints filed against this business since it
opened in 2008.
The only interior alteration proposed includes upgrading the restrooms so that they comply with disabled
accessible requirements (see plans date stamped October 29, 2009). The business will contain a reception and
waiting area, six massage rooms, restrooms and an office.
The proposed massage establishment will be open seven days a week from 10:00 a.m. to 9:00 p.m. (hours of
operation allowed are from 7:00 a.m. to 9:00 p.m., Code Section 6.40.100, d, 5). The applicant notes that on
weekdays and weekends, there will be seven full-time employees before and after 5 p.m. The applicant does
not expect this number to increase in two to five years. The applicant expects to have four to six customers
before 5 p.m. and four customers after 5 p.m. on weekdays and weekends. In five years, the number of
customers is expected to increase to seven to ten customers before 5 p.m. and six to eight customers after 5
p.m. It is expected that there will be a maximum of 13 customers and employees on site at any one time. A
linen service using a truck or van will pick up and drop off linens as necessary.
There are approximately 57 on-site parking spaces. This project includes changing the use in a tenant space
within an existing commercial building from office (1:300 parking ratio) to massage establishment (1:400 parking
ratio based on personal service/retail use). Since the proposed use is less intense than the existing use, no
additional on-site parking is required.

Staff Comments: See attached memos from the Chief Building Official, Fire Marshal, City Engineer and NPDES
Coordinator. The applicant is currently working with the Chief Building Official to address his comments.
Planning staff would note that the most recent approval of a massage establishment was for therapeutic
massage in an existing medical/office building located at 1828 EI Camino Real, zoned ECN (conditional use
permit required). While in operation from June 2007 to October2008, there were no complaints filed againstthis
business (this business is no longer operating at this site).
Planning staff would also note that if the Conditional Use Permit is approved for a massage establishment at
1340 Bayshore Highway, the applicant will be required to submit an application to the Police Department, which
includes review by the Police and Business License Departments.
Design Review Study Meeting: At the Planning Commission study meeting on November 9, 2009, the
Commission asked the applicant to clarify why there will be more employees and customers on the property
during the day (November 9, 2009 Planning Commission Minutes). The applicant notes that he plans to hire a
total of 6-7 employees (up to four massage technicians and finro receptionists), but not all employees will be on-
site at one time.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;
(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Conditional Use Permit Findings: Based on the findings stated in the attached minutes of the Planning
Commission's November 9, 2009, study meeting, that the proposed massage establishment (therapeutic
massage) will offer therapeutic massage to the general public by certified massage technicians, that the
massage establishment will replace an office use and therefore is not an intensification of use, and that the
business will only be open seven days a week from 10:00 a.m. to 9:00 p.m., and for these reasons the proposed
use is found to be compatible with the required findings for a Conditional Use Permit.

Planning Commission Action:

The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be
considered:
that the massage establishment shall be limited to 2,946 SF at 1340 Bayshore Highway, as shown on
the plans submitted to the Planning Division and date stamped October 29, 2009 sheets A1.0 and A2.0;
2. that the massage establishment shall comply with all of the requirements of Chapter 6.40 (Massage, Spa
and Bathing Establishments) and any requirements established by the State of California for massage
establishments;
3. that the massage establishment shall not expand or increase the tenant space without an amendment to
this Conditional Use Permit;
4. that the massage establishment may not be open for business except during the hours of 10:00 a.m. to
9:00 p.m., seven days a week;
5. that any changes in operation, floor area or use, which exceeds the maximums as stated in these
conditions shall require an amendment to this Conditional Use Permit;
6. that the conditions of the Chief Building Official's November 2, 2009 memo, the Fire Marshal's and
NPDES Coordinator's September 8, 2009, memos and the City Engineer's September 16, 2009 memo
shall be met;
7. that the use and any improvements for the use shall meet all the requirements of the California Building
Code and California Fire Code, 2007 edition, as amended by the City of Burlingame; and
8. that this Conditional Use Permit shall be reviewed upon complaint.

My name is Ferenc Pataki and I am writing this letter as one of the requirements for the application process to open a
massage establishment in the city of Burlingame.
I found a vacant building for lease at 1340 Bayshore Hwy Burlingame, CA 94010 with ample parking for my future
massage business. The location is excellent since it is right by the Broadway exit off highway 101 and surrounded by
many business in the shoreline zone of Burlingame. I am proposing to bring professionalism in my field by providing
therapeutic massage to the general public by certified massage technicians. When I open my massage business, others
will benefit as well, especially local restaurants, because after receiving a massage usually people are thirsty and
hungry and therefore that means more revenue and more taxes for the city of Burlingame. Since our State is in deficit, I
think allowing to open new businesses is in the best interest of the public and is a win-win situation for local businesses
and our government.
I believe there is a great need for a business like mine since we are living in very stressful times and a good quality
massage has many benefits to the human body including stress relief. Personally I have not met anybody yet that did
not like a good massage. We will provide full body therapeutic massage manually to our customers while they are
lying on a massage table and their bodies covered with sheets and blankets. Our therapeutic massage will involve
manipulating the body with structured pressure with the therapist's hands, fingers, elbows and forearms. We will also
offer foot and chair massage while the customer is fully clothed. I am planning to hire 4 certified massage technicians
and 2 receptionists. I appreciate your time reading my letter and considering for allowing me to open my massage

1) On the plans specify that this project will comply with the 2007 California Building Codes (CBC).
2) Anyone who is doing business in the City must have a current City of Burlingame business
license.
3) Provide fully dimensioned plans.
4) All work shall be conducted within the limits of the City's Noise Ordinance.

5) Provide a complete demolition plan that indicates the existing walls, walls to be demolished, new
walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building Permit
is issued for the project.
6) Comply with the 2005 California Energy Efficiency Standards. Note: All projects for which a
building permit application is received on or after January 1, 2010 must comply with the 2008
California Energy Efficiency Standards. Go to http://www.enerqv.ca.gov/title24 for publications
and details.
7) On your plans indicate whether the building is sprinklered or non-sprinklered. If the building is not
sprinklered then the maximum travel distance for one exit is exceed and a second exit must be
shown on the plans.
8) The exit through the massage room does not comply as an exit. Please remove the "ExiY'
designation from the plans.
9) Provide an exit plan showing the paths of travel and distance from the farthest point within the
tenant space to each exit.
10) The accessible ramp as shown on the plans does not comply with the minimum code
requirements. Because the door opens onto the ramp the width of the landing must 78". 42" plus
the width of the door (36"). Please show this on the plans.
NOTE: A written response to the items noted here and plans that specifically address items 1,
5, 7, 8, 9, and 10 must be re-submitted before this project can move forward for Planning
Commission action.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on

Project Description: The applicant, Ferenc Pataki, is requesting a Conditional Use Permit to operate a
massage establishment (therapeutic massage) in an existing two-story commercial building at 1340 Bayshore
Highway. The subject tenant space (2946 SF) is located on the ground floor at the rear of the building and was
most recently occupied by an office use (currently vacant). Burlingame Municipal Code Section 25.45.025 (j)
requires a Conditional Use Permit for a massage establishment in the SL zoning district.
In a letter dated August 28, 2009, the applicant notes that the business will offer "therapeutic massage to the
general public by certified massage technicians" and further notes that "our therapeutic massage will involve
manipulating the body with structured pressure with the therapist's hands, fingers, elbows and forearms". Foot
and chair massages will also be offered. The applicant is planning to employ four certified massage technicians
and two receptionists.
The applicant currently operates a similar massage establishment, Siesta Massage, at 2771 EI Camino Real in
Redwood City (San Mateo Countyjurisdiction). Planning staff contacted the County of San Mateo Planning and
Code Compliance Divisions and learned that there have been no complaints filed against this business since it
opened in 2008.
The only interior alteration proposed includes upgrading the restrooms so that they comply with disabled
accessible requirements (see plans date stamped October 29, 2009). The business will contain a reception and
waiting area, six massage rooms, restrooms and an office.
The proposed massage establishment will be open seven days a week from 10:00 a.m. to 9:00 p.m. (hours of
operation allowed are from 7:00 a.m. to 9:00 p.m., Code Section 6.40.100, d, 5). The applicant notes that on
weekdays and weekends, there will be seven full-time employees before and after 5 p.m. The applicant does not
expect this number to increase in two to five years. The applicant expects to have four to six customers before 5
p.m. and four customers after 5 p.m. on weekdays and weekends. In five years, the number of customers is
expected to increase to seven to ten customers before 5 p.m. and six to eight customers after 5 p.m. It is
expected that there will be a maximum of 13 customers and employees on site at any one time. A linen service
using a truck or van will pick up and drop off linens as necessary.
There are approximately 57 on-site parking spaces. This project includes changing the use in a tenant space
within an existing commercial building from office (1:300 parking ratio) to massage establishment (1:400 parking
ratio based on personal service/retail use). Since the proposed use is less intense than the existing use, no
additional on-site parking is required.

My name is Ferenc Pataki and I am writing this letter as one of the requirements for the application process to open a
massage establishment in the city of Burlingame.
I found a vacant building for lease at 1340 Bayshore Hwy Burlingame, CA 94010 with ample parking for my future
massage business. The loeation is excellent since it is right by the Broadway e�t off highway 101 and surrounded by
many business in the shoreline zone of Burlingame. I am proposing to bring professionalism in my field by providing
therapeutic massage to the general public by certified massage technicians. When I open my massage business, others
will benefit as well, especially local restaurants, because after receiving a massage usually people are thirsty and
hungry and therefore that means more revenue and more taxes for the city of Burlingame. Since our State is in deficit, I
think allowing to open new businesses is in the best interest of the public and is a win-win situation for local businesses
and our govemment.
I believe there is a great need for a business like mine since we are living in very stressful times and a good quality
massage has many benefits to the human body including stress relief. Personally I have not met anybvdy yet that did
not like a good massage. We will provide full body therapeutic massage manually to our customers while they are
lying on a massage table and their bodies covered with sheets a.nd blankets. Our therapeutic massage will involve

I am sorry, but I could not get back to you earlier since I am out of the country until the 9th of
December and I did not get a chance to check my e-mails until now. Also, that is why I asked
you to schedule the public hearing for the 14th of December and you agreed to that.
So, I ask you kindly please schedule it for the 14th of December 2009.
The answer to your question regarding the number of employees and customers is that on any
given day the number of employees including myself will not be more than 7 and what I meant
about the number of customers is for example weekdays: 6 customers before 5 PM and 4
customers after 5 PM so total of 10 customers during the hours of operation which is 10 AM to 9
PM. I appoligaze for any misunderstanding that I caused.

2. Site Plan and Floor Plans
► The proposed floor plan for your tenant space needs to clearly indicate how each room will be used.
