There was read the public Notice of Hearing of Petition for Variance of Zone
affecting the property known as Portion of Lot 1, 75' frontage on Oak Grove Avenue,
Corbitt Subdivision and designated as 1000 Oak Grove Avenue. Jack Hecht, appeared as
President of Burlingame Improvement Association and spoke at length against rezoning
this property from "Residential" to "Business" use. Robert Doss also appeared and spoke
against the petition. Emerson Miller spoke in favor. Commissioner Brown made a motion
that in view of preponderance of protests, the petition be tabled, which motion was
seconded by Dr. Macomber, and on roll call, the motion was unanimously adopted. Follow-
ing this motion, Mr. Miller stated that he was willing that the petition be tabled for
future consideration.
On the matter of set -back lines for Lot 9, Block !+, Corner Douglas and Bellevue
Avenues, continued from last Meeting, the Chairman inquired if there had been any new de-
velopment during the interim. Building Inspector Watson reported that he has studied the
matter and is satisfied that there is no ordinance stating what the set -back should be.
The Secretary read a communication from K. S. Fitch, Director of Public Works, September
14, 1949 which stated that the existing ordinance, Section 1911, applicable to residential
and apartment set -backs makes no provision for determining the set -back for this type of a
corner lot. A. D. Duncan, owner of the lot, was present and stated that, in order to make
the project financially feasible, he calculated that it would be necessary to include 50
apartments in the structure and use as much of the lot area as is permitted under the
State Housing Code.In the discussion which ensued, reference was again made to the tenta-
tive plot plan submitted at the last meeting showing set -back lines as small as 6' and at
certain points 3' from the property line, and an alternate plan showing a set -back to 61.
In the extended discussion which ensued, Mr. Duncan agreed to submit an amended plot plan
with the building lines to be set back 15' from the property line, commencing at the rear
yard on both Bellevue and Douglas Avenues for an indeterminate distance but .for the
present tentatively to the stairways as shown on the typical floor plan which was sub-
mitted and 101minimum set -back from the rear property line. Dr. Maoomber raised a questio
from a health standpoint of the advisability of crowding 50 apartments on a building site
stated to contain an area of approximately 15,000 square feet. However, it appears that
there is nothing in the ordinances at the present time regulating this question. While no
formal action was taken, the members of the Commission indicated that if the owner will
submit an amended plot plan or floor plan with increased set -back lines, the matter will b
considered in a more favorable light.
Petition for variance of zone - Lots 21A-21B, Block 21, Lyon & Hoag Subdivision,
being Northwesterly corner Howard Avenue and Myrtle Road (continued from last meeting for
further study). The Chairman inquired if there has been any development in the interim,
and the individual members of the Commission stated that they are familiar with the loca-
tion of the property and have viewed it and surroundings and did not look with favor upon

recommending a variance from the zoning ordinance. Mr. Boring, the petitioner and owner of
the property, appeared and asked that the petition be postponed for another month, during whi
time he would expect to bring in a list of names and signatures of a large percentage of sur-
rounding property owners, who would be in favor of rezoning. City Attorney Karmel was presex
and advised Mr. Boring that,as a practical matter in view of the long -continued non-conformiz
use, the owner of this particular parcel should not urge a spot zoning, but be satisfied to
continue with the advantage he has. Dr. Macomber made a motion that the Planning Commission
recommends the petition for variance be denied. Motion seconded by Commissioner Brown. On
roll call the vote was as follows:

Mrs. F. C. Lee, 736 Paloma Avenue, seeking permission to establish music studio in
residence. No one appeared in response.
Mrs. Robert Levy, Sr. - Carmelita and Drake Avenues. No one appeared.
Building Inspector Watson presented plans for a proposed apartment house to contain
six units to be constructed by George A. Smith, on Lot 1, Block 3, Burlingables, Bayshore
Service Road and Bloomfield Road. Approved.
