Boulevard Meeting Date• 1/13/97 Request: Amendment to master sign program and sign exception to add an illuminated cabinet sign to the bay side of the hotel (secondary frontage) at 150 Anza Boulevard, zoned C-4 (CS 22.20.030, 040, 060). Sign exception is required for height and area on a secondary frontage. Applicant: Anow Sign Company and Embassy Suites Hotel APN: 026-342-350 Property Owner: State of California Lot Dimensions and Area: 14.25 Ac. MOL General Plan: Commercial Uses, Hotels/Motels, Restaurants Adjacent Development: Office buildings, restaurants, hotels Zoning: C-4 CEQA Status: 15311 - Accessory Structures Class 11(a), (b),(c) consists of construction, or placement of minor structures accessory to e�cisting commercial, industrial, or institutional facilities, including but not limited to: (a) On premise signs. Summary: The applicant is asldng to add one illuminated cabinet sign to the north side of the hotel at 150 Anza Boulevard (cunently Embassy Suites). The north side of the hotel faces San Francisco Bay and is considered a secondary frontage, which allows 2 signs and 75 SF of sign area. The applicant is requesting one sign with 96 SF of sign area. The proposed sign exceeds allowable height (84' where no signs are allowed above the fourth floor), and area (96 SF of sign area where 75 SF is allowed). There is an approved master signage program for this site. A summary of the existing signs with respect to the number, area and height, as approved by the master signage program is included for reference. If approved the applicant would add the proposed sign to the master signage program. There are seven existing signs on the site, all of which are to remain. The sign program approved in 1991 allowed 8 signs totaling 1049 SF (see Table A for 1991 approved sign program). On the primary frontage, there are six signs: two double faced pole signs sharing one pole, 24'-0" high (2 X 96 SF = 192 SF; 2 X 48 SF = 96 SF)(4 signs); one 84' high 99 SF wall sign (Logo & Embassy Suites); and a 14' high 38 SF awning sign (Bobby McGee's). On the secondary frontage facing 800 Airport Boulevard there is now one sign: a 98' high, 139 SF wa11 sign (Logo & Embassy Suites). There were no signs approved for the other secondary frontages in the master signage program. All seven of these signs are to remain. m SIGN EXCEPTION I50 Anza Boulevard The existing signs in the 1991 master sign program have been subsequently modified by changes to copy approved in March of 1996, which resulted in lesser square footage. While the 1991 sign program permitted 8 signs totaling 1049 SF, the current signage consists of 7 signs totaling 564 SF. The new sign will increase the total sign square footage to 660 SF. The attached Table B details the existing and proposed signs. History: In 1991, Commission approved a master sign program and sign exception for the number, height and area of signs at this site. That master sign program allowed 8 signs and 1049 SF of sign area (see Table A attached). Since that time, the hotel name has changed from Crown Sterling Suites to Embassy Suites. In March of 1996, the Planning Department allowed a change of copy for the name change on existing signs A, B and C. The change of copy resulted in a net decrease of sign area (from 1049 SF total to 583 SF) as noted in the attached Table B. This reduction includes a 6 SF awning sign which has been removed. On the primary frontage, the master sign program approved in 1991 permitted 7 signs on the primary frontage, where the zoning code allows 2 signs, a sign 84' high on the primary frontage where the zoning code allows no signs above the fourth floor, and allowed 766 SF of sign area, where the zoning code allows a maximum of 200 SF. On the secondary frontage facing 800 Airport Boulevard, the 1991 master sign program permitted a 98' high wall sign, where the zoning code allows no signs above the fourth floor. This request would amend this master sign program to allow a 98' high, 283 SF wall sign on the secondary frontage facing the San Francisco Bay, where the zoning code allows no signs above the fourth floor, and limits signs on a secondary frontage to a total of 75 SF. Staff Comments: The City Engineer, Chief Building Inspector, and Fire Marshall had no comments. Planning staff notes that approval of this application would supercede the Master Sign Program which was approved in 1991. The attached Table B lists the existing signs which are to remain and the proposed new sign. If approved, the signs shown on Table B will constitute the new Master Sign Program. Study Meeting: At their December 9, 1996 Planning Commission meeting, the Commissioners had no questions regarding the application. Required Findings for Sign F�ception: In order to grant a Sign Exception relating to height, area, location or number of signs the Planning Commission must apply the following circumstances (Code Section 25.06.110 a-b): (a) any exception granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the viciniry and the C-4 district in which the subject property is situated; and (b) because of special circumstances applicable to the subject property, including size, shape, topography, street frontage, location or surrounding land use; the size or height of the building on which the sign is to be located; the classification of the street or highway on which the sign SIGN EXCEPTION 150 Anza Boulevard is located or designed primarily to be viewed from, the strict application of zoning regulations is found to deprive subject property of the privileges enjoyed by other properties in the vicinity and under identical zone classification. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should include findings made for the sign exception requested. Reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 1. that approval of this application shall supercede the Master Sign Program for this site approved on 7uly 22, 1991; 2. that the project shall be built as shown on the plans submitted to the Planning Department date stamped November 14, 1996, and shall constitute those signs described in Table B, Proposed Sign Program, 150 Anza Boulevard, 7anuary 13, 1997; and 3. that the project shall meet all California Building and Fire Code, 1995 Edition as amended by the City. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration. Chairman Ellis opened the public hearing. Ramona Hernandez, 625 Burlingame Avenue addressed the commission. She noted that this had been going on a long time and she wished to have the matter resolved; the neighbor who complained lives almost at Rollins, far removed from the corner of Burlingame and Bloomfield where she lives; the immediate neighbors have not complained. Alex Bogdes, 601 Burlingame Avenue,spoke in support. He noted that he was the instigator of the litigation; this situation was originally based on a deception that this is a roof mounted antenna not allowed by the code, do not know if this had been presented properly in the law suite it would have come out differently; this is in ligation and will continue; even in this staff report the engineer that the city hired made a statement that was not true; the present location of the antenna is the best, no other will work without cutting trees or the neighbor's house; trees will need to be maintained forever; the report does not make sense because the antenna has been there three winters through storms, but still say need a structural analysis, just want to add expense; between city and applicant litigation has cost $60,000; no one is bothered by the antenna and no one is complaining; this is the only place on the site that gives decent reception and is the best place to serve tl�e purpose for which the antenna was installed. Applicant was asked if the cunent antenna could be replaced with a 40" dish, she stated that she has asked and had been told that a 40" dish would not work.
