S�B�E�T: Appeal of Planning Commission action on a use permit for a Car
Rental operation at the Embassy Suites Hotel , 150 Anza
Boulevard, Zoned C-4.
RECOMMENDATION:
City Council should hold a public hearing and take action.
Conditions recommended to Planning Commission:
1. that the car rental operation shall operate during the hours
of 8:00 a.m. to 6:00 p.m. Monday through Friday, 8:00 a.m. to
12:00 noon Saturday and Sunday with no more than one employee
on site;
2. that there shall be no more than five rental cars on site
being returned or awaiting pickup at one time and no more than
150 cars rented from this site each month;
3. that no rental cars shall be stored more than 24 hours,
cleaned or serviced or� this site;
4. that any change to this use in excess of the criteria set by
the use permit shall require an amendment to this use permit
prior to the change and failure to comply shall result in
consideration of revocation of the permit by the Planning
Commission; and
5. that this use permit shall be reviewed for compliance in one
year (August, 1989) and each two year thereafter.
Action Alternatives:
1. City Council can uphold the Planning Commission denial of a
special use permit for a concessionaire to operate a car
rental agency from a desk in the lobby of the Embassy Suites
Hotel with 8 parking spaces reserved on-site for car rental
vehicles. Council should state clearly the reasons for their
action.
2. City Council can reverse the Planning Commission and approve a
special permit for a car rental agency operated by a
concessionaire from the lobby of the Embassy Suites Hotel.

The reasons for the action should be clearly stated and the
action should be taken by resolution.
3. City Council can deny without prejudice the special permit
request. If this alternative is pursued Council should state
clearly what items would require further study or evaluation
by the applicant and staff prior to rehearing by the Planning
Commission.
BACKGROUND•
The Hertz Rent-A-Car Corporation represented by William Aragon is
requesting to aperate a car rental agency from a desk in the lobby of
the Embassy Suites Hotel at 150 Anza Boulevard, zoned C-4 (Code Section
25.41.020-f). The lobby desk would be open seven days a week (Monday
through Friday 8:00 a.m.to 6:00 p.m., Saturday to Sunday 8:00 a.m. to
12:00 noon). The operation would be the responsibility of a
concessionaire who would have one person on-site during the hours that
the desk was open. An average of 5 vehicles for rent would be on-site
with a maximum of 8 at any one time. They would like no restriction on
the length of time any one car could be stored on-site and no
restriction on the number of cars to be rented from this site each
month. This operation has been at Embassy Suites for about 2 years. It
is a code enforcement item.
PLANNING COMMISSION ACTION:
On July 25, 1988 the Planning Commission held a public hearing and voted
4- 2 (Commissioners Giomi and Jacobs dissenting, Commissioner Harrison
absent) to deny this request. (Planning Commission minutes July 25,
1988). Commission discussed the advantages and disadvantages of
setting aside the parking spaces for cars to be rented; the parking
problem at all the hotels and Embassy Suites in particular; the fact
that a corporation the s,ize of Hertz should have been aware of the need
to contact the city; concern about the need for each hotel to have car
rental, noting people shuttle to the airport they can shuttle two rental
cars; parking requirements for hotels and the need for more if such
services are to be common; increase in vehicle trips within the area
caused by cars being shuttled back and forth as well as rented; this car
rental approach is half-hearted, not truly full service with one person
sitting behind the desk.
In their appeal letter (August l, 1988) Hertz Rent-a-Car represented by
attorney Mark Hudak, it is pointed out that Hertz has a nationwide
program of leasing cars at hotels as a part of a travel package
promotion which compliments hotel business. He states that Hertz feels
the guest should be given priority in serving their needs at a hotel
over the needs of occasional visitors or restaurant patrons.
He notes that their survey indicates 25� of guests arrive without a car
and their needs are best served if they can rent a car at the hotel.
They rent about 110 cars a month from Embassy Suites. The five spaces
recommended by staff to be set aside for car rental use would equal
1.45$ of the total (345) parking spaces. They prefer 8 spaces to be set

aside (2.3�). But the retention of these 5 spaces for the use of the
general public will not solve the hotel's parking problem. Hotel guests
prefer not to shuttle to rental cars causing a loss of revenue and sales
tax without improving the parking problem.
Hertz would su,ggest setting aside 5 parking spaces in the leased use
portion of the parking lot. They would not like their rentals per month
to be limited. Their agent at the time the hotel opened was from
Southern California and did not realize a use permit was required.

Our firm represents The Hertz Corporation. Hertz hereby
appeals the July 27, 1988 decision of the Planning Commission
denying a special use permit to allow Hertz to use five parking
spaces at the Embassy Suites Hotel to provide on-site car rentals
and returns for guests.
By way of background, you should know that San Francisco is
the second largest car rental market in the country: having
readily available transportation is critical in the Bay Area.
Given the large number of hotel rooms in Burlingame, it is
important that the City Council identify and meet the needs of
travelers to ensure a high occupancy rate.
Hertz participates in nationwide advertising campaigns to
offer package deals to travellers including airfare, hotel
' accommodations, and on-site car rentals. This national campaign
helps to ensure that travellers will use Burlingame hotels as
part of the package. In addition to the benefit for hotel
occupancy, the on-site rental program ensures that Burlingame
receives sales tax revenues that otherwise would go to San
Francisco for rentals made at the airport.
Hertz appreciates that many of the hotels located east of
the freeway are experiencing parking problems. Hertz strongly
believes that, as a matter of policy, priority should be given to
serving the needs of registered hotel guests and secondary
consideration to the parking needs of occasional users of
restaurant facilities in the hotels. Dedication of a minimal
number of spaces to the transportation needs of hotel guests is
necessary to ensure that guests and conventions will return.

With respect to the situation at Embassy Suites, a recent
survey shows that approximately 25�s of the guests arrive without
a car (usually via shuttle from the airport). The most
convenient way to meet the transportation needs of these guests
it to have a small supply of rentals available for immediate
delivery. Hertz averages approximately 110 rentals per month at
this site.
The staff report shows that there are 345 spaces available
for 344 rooms, or one more than required by code. The staff
report recommends that five spaces be used for short-term rental
and return (Hertz had requested eight). If a permit is issued
for the five spaces, it will involve only 1.45% of the parking
spaces. On balance, keeping these five spaces available for use
by the general public and restaurant patrons will not solve the
parking problems experienced at peak hours on the site. However,
the loss of a special use permit will be very inconvenient for
the 25% of hotel guests who arrive without a car.
The City Engineer and some Planning Commission members have
suggested that Hertz shuttle guests from Embassy Suites to the
nearest rental location. If there are none at other Burlingame
hotels, the nearest available rental locations are at the airport
or Millbrae hotels. Few regular travellers will appreciate
having to drive back to the airport to rent a car, and many
guests would prefer the convenience of the express return at
their hotel rather than a return at a site from which they would
have to take a bus. We know from experience that customers
prefer to walk to their rental cars rather than take a shuttle.
If Embassy Suites is not a convenient rental location
because cars are not on-site, guests will seek another hotel or
rent at the airport. If they rent at the airport, a rental car
still will be parked overnight in the hotel lot. In either case,
the hotel will lose revenues without solving the parking problem.
As shown in Attachment 1, the loss of revenues and sales tax at a
hotel can be significant.
At the Planning Commission hearing, Hertz suggested that
five spaces be set aside in the least-used area of the Embassy
Suites lot to minimize the impact of the special use. This seems
the fairest and most workable solution.
We also raised concerns at the hearing about some of the
limitations on the permit proposed in the staff report
(particularly the limit of 150 rentals per month, which bears no
relation to the parking problem) and Hertz would be happy to
address those concerns with the Council or with staff is this
appeal is granted.

Finally, a question was raised as to why Hertz had waited
before applying for a special use permit. At the time operations
began at Embassy Suites, the operations were supervised by a
Hertz employee in Palo Alto who was not familiar with
Burlingame's policies. In fact, it_appears that Burlingame is
the only municipality that requires a use permit for this type of
operation. Now that the policy is understood, Hertz will make
every effort to comply with it.
In summary, Hertz is willing to work with Burlingame to
ensure that the needs of hotel guests are met without an undue
burden on parking at Embassy Suites. Representatives of Hertz and
I will be present at the Council meeting to answer any questions.
We look forward to a favorable consideration of the appeal.

conditions were suggested for consideration at the public hearing.
Discussion: this hotel met code parking requirements when it was
approved, it meets code now; staff explained Hertz does not have a
special permit for a Hertz desk at the Marriott and the reasons for
this; security guard at the Embassy Suites is employed by the
hotel; spaces used for parking on property across the street from
Embassy Suites are not counted in their parking space figures, this
is an independent arrangement between that property owner and the
hotel.

commented that Hertz in conjunction with the airlines and hotels
are attracting travelers to Burlingame locations, package
arrangements will bring more visitors to Burlingame. He discussed
Hertz' parking arrangements at Marriott with staff. At Embassy
Suites they would like to set aside five spaces for rental cars,
not necessarily close to the entrance but would like that option;
the suggested condition limiting the time a rental car could be
stored on the site to 24 hours may be too restrictive, he suggested
a 72 hour maximum; they could accept a limit of five rental cars on
site for the upcoming year but following review in one year might
like to up this figure to eight cars; Hertz feels it cannot live
with 150 rentals per month, if they do not have more than five cars
on site at one time why the 150 rentals per month requirement, most
months they average 110 rentals but with package deals this could
go as high as 200 people a month, they could still meet the five
cars on site requirement.

Hertz Rent-A-Car Corporation represented by William Aragon is
requesting to operate a car rental agency from the lobby of the
Embassy Suites hotel at 150 Anza Boulevard, zoned C-4 (Code Section
25.41.020-f). The agency would have a desk in the lobby of the
hotel which would be manned by a commissioned agent Monday through
Friday 8:00 A.M. to 6:00 P.M., 8:00 A.M. to Noon Saturday and
Sunday. An average of five vehicles available to rent would be
stored on the site with a maximum of eight at any one time.

City staff have reviewed this request. The Chief Building
Inspector (June 13, 1988 memo) and the Fire Marshal (June 14, 1988
memo) had no comments. The City Engineer (June 9, 1988 memo)
opposes the storage of car rental vehicles on this site because of
the shortage of parking on the site. The parking shortage in his
opinion is the result of the demand for the dining and
entertainment facilities on the site. Abuse, double parking and
blocking of exits frequently occur. He suggests that clients be
shuttled to the closest Hertz storage site instead of picking cars
up at the hotel.
Planning staff would note that the present on-site parking for this
hotel is 345 spaces which meets the requirements of the zoning
code, one per room (344) (Code Section 25.70.030-d). However, the
zoning code assumes that the restaurant, meeting room, bar and
other facilities within the hotel are incidental to the primary
hotel use. In other words these facilities will not be a separate
attractor of patrons. When the Embassy Suites hotel was originally
approved there was a freestanding restaurant proposed and a
breakfast bar inside the hotel. After approval, while final plans
were being prepared, the applicant deleted the freestanding
restaurant and its associated parking and added a small (4,500 SF)
restaurant/bar area within the hotel, retaining the continental
breakfast bar. Since this restaurant was comparable in size to
those which were operated as incidental uses in other hotels in the
area, staff allowed this change with the subsequent reduction in
on-site parking as provided at the other hotels. Council was
informed of the change but no action was required. Before opening,

the hotel contracted with a chain of restaurants, Bobbie McGee�s,
to operate the on-site restaurant. The new operator of the
restaurant commenced to advertise the restaurant and bar
independently of the hotel, attracting a large patronage. There
were no provisions in our code addressing this type of management
activity. The result has been a serious evening hours parking
problem, particularly when there is heavy use of the meeting rooms
by locally based groups.
To address the evening parking problem the hotel has used the
parking lot of the adjacent office building in the past. This is
an arrangement that they have worked out themselves. The city is
not aware of the particulars of the arrangement nor do we require
this usage of adjacent property�s parking by any previous use
permit. In fact it has been city policy not to allow uses which
require off-premise parking in order to function.
The experience of the facility management on parking demand with
the Embassy 5uites has made staff much more critical in reviewing
"incidental" uses included in hotels. Crowne Plaza was required,
for example, to provide parking to C-4 zoning requirements for the
second restaurant which was a part of their recent addition
proposal.
Several other hotels in Burlingame have car rental uses as
incidental to their hotel use. The Marriott has an operation, but
does not have a use permit since no cars are stored on the site.
The Sheraton and Ramada Inns both have such operations with
allowance to store about five cars on site temporarily for pickup
or dropoff. These two hotels have use permits for these agencies.
The agency at Ramada was not successful and presently is not in
operation.
Applicant�s Letter
William Aragon, representing Hertz Rent-A-Car Division, submitted
three letters, April 26, 1988, June 6, 1988 and June 27, 1988, in
support of his application. In the first letter he is responding
to a code enforcement letter sent by the Planning Department
following up a business license review. He notes that there are no
Hertz employees on site. (Note: Later he clarifies that the
responsible employee is a contractor/concessionaire.) The hours of
operation are 8:00 A.M. to 6:00 P.M. Monday through Friday, 8:00
A.M. to 12:00 P.M. (Noon) Saturday and Sunday; and that the average
number of cars to be parked on site (to lease or returns) is five.
The vehicles, he states, are cleaned and stored at the Shell gas
station at 1300 Bayshore Highway.
In the second letter he adds that the Shell station returns the
cleaned/serviced cars to Embassy Suites for subsequent rental.
(Note: In a phone conversation June 6, 1988, Mr. Aragon commented
that they presently rent 110 cars per month from the Embassy Suites

site. He anticipates the maximum number of monthly rentals will
not exceed 150. In the same conversation he confirmed that the
concession has been operating at the hotel for two years.)
In the third letter he comments that the Hertz rental operation is
located at Embassy Suites as a service to hotel guests. He notes
that with 440 parking spaces (note: actually 345) there are plenty
of spaces for the waiting car rentals. He comments that they
remove excess cars immediately to other locations where people wish
to rent them. Most of their rentals are by business people who use
them Monday through Thursday or Friday. On weekends when the
demand is low only a few cars are kept on site. He feels the big
restaurant and entertainment demand at the hotel is during the
weekend, their off peak. He notes they are willing to work with
the city to see that the number of idle rentals does not accumulate
at the hotel.
Finally, he feels that they provide an important service for hotels
and that their advertising contributes to the hotel occupancy
levels in Burlingame. Moreover the city receives tax revenue from
their �entals.
Study Ouestions
Planning Commission reviewed this request at study on June 27, 1988
and asked the following questions (Planning Commission Minutes,
June 27, 1988). The hotel has 344 rooms. There are 345 parking
spaces on site or one over the code requirement. Therefore, in the
worst case seven of the eight spaces requested would come from
required parking.
Hertz operated from the Hyatt Hotel before it closed for
remodeling. In that case they had a freestanding building they
used as an office and parked cars on site as well. They also
operate from Marriott where they are not required to have a use
permit because no cars are stored on site. Previously they had
operated at Marriott without a use permit and had about five stalls
designated for rental cars. When, as a part of code enforcement,
we asked them to submit for a use permit, they altered their
operation so a use permit was not required. Marriott has an on-
going parking problem.
Staff does not know why Hertz did not get a use permit at Embassy
Suites. According to the applicant there are 110 people a month
who rent cars at Embassy Suites. There is one person who operates
the desk and shuttles cars to the service station. Car jockeys are
used to move cars a greater distance. It is not clear how many car
jockeys would be involved; it would depend on the volume of cars
returned.
Presently rental cars are parked in regular, unmarked parking
stalls on site at Embassy Suites. At other hotels where a use

permit has been granted a number of stalls taken from the existing
inventory are marked with signs reserving them for rental cars.
This has not been suggested at Embassy Suites because the applicant
feels that reserving spaces which are not needed by rental cars
takes them out of the inventory for hotel guests. The porte
cochere area is not included in the required parking for the
Embassy Suites hotel. The Commission will have to ask the
applicant about the location and operation of the main Hertz
location serving this area; the applicant did not address this in
his written responses.
Plannina Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action
should be clearly stated. At the public hearing the following
conditions should be considered:
1. that the car rental operation shall operate during the hours
of 8:00 A.M. to 6:00 P.M. Monday through Friday, 8:00 A.M.
to 12:00 Noon Saturday and Sunday with no more than one
employee on site;
2. that there shall be no more than five rental cars on site
being returned or awaiting pickup at one time and no more
than 150 cars rented from this site each month;
3. that no rental cars shall be stored more than 24 hours,
cleaned or serviced on this site;
4. that any change to this use in excess of the criteria set by
the use permit shall require an amendment to this use permit
prior to the change and failure to comply shall result in
consideration of revocation by the Planning Commission; and
5. that this use permit shall be reviewed for compliance in one
year (August, 1989) and each two years thereafter.

Hertz provides car rental services at the Burlingame Embassy Suites
Hotel as a special service and convenience for hotel guests. This
service is provided at the request of the hotel because guests
expect this type of service from a first class hotel. If the
Embassy Suites hotel guest was unable to obtain a car at the hotel,
they would be forced to rent the car from another location such as
San Francisco Airport. Regardless of where the car is rented, the
hotel guests will end up with a rental car parked in the hotel
parking lot. According to our records, the hotel has 444 parking
spaces to accommodate 344 rooms. The only "extra" cars on the
hotel parking lot are the few cars that we keep available to meet
hotel guest needs during the next few hours. Excess cars are
removed from the hotel immediately so that they will be available
for rent at other locations where Hertz services are provided. Our
typical renter is a traveling business person that usually picks up

Thursday or Friday. This information is substantiated by our
rental records as well as the hotel occupancy records. During the
end of the week and the weekend, car rental demand is very low and
we only keep a couple of cars at the hotel. It is during this
time also when the dining and entertainment parking causes overflow
situations. We do not think that 2 or 3 Hertz cars being kept at
the hotel property for hotel guests is a significant factor with a
parking lot that holds 444 cars.
We are very willing to work with the City of Burlingame to ensure
that we do not have a significant number of idle rental cars at the
Embassy Suites Hotel. We feel that Hertz provides a very valuable
service for the hotel and the City of Burlingame. Through the use
of joint marketing promotions, we advise the traveling public of
the special services offered by the Embassy Suites Hotel. This
helps to increase their occupancy and gives the City of Burlingame
an opportunity to collect the incremental dollars spent by these

very closely with John Steen at the San Mateo County Convention and
Visitors Bureau in an attempt to stimulate the economy of San Mateo

services in the Burlingame area rather than spending the money in
San Francisco.

Because of the very heavy demand for parking at the Embassy Suites, I
cannot support storage of any rental vehicles on the Embassy Suites'
site.
The demand is so great at this location that parking is frequently
unavailable. This is due not only to the hotel use but the heavy
demand for its entertainment and dining facilities. There freguently
is insufficient parking for patrons with double parking and blocking
vehicular exiting areas.
I suggest that clients be shuttled to a Hertz storage site instead of
this proposal.

The cars come from a pool serving San Francisco, San
Jose, Monterey, and Oakland Airports, Downtown San
Francisco and various hotels. Pool headquarters are
in Millbrae, California.

cars with respect to hotels.

It would be helpful for Hertz purposes to know:
1. When is a permit required in addition to a license?
2. How is it determined whether adequate parking exists
for traditional airport concessions like restaurants,
airline ticket offices, gift shops, rental car
customers?
3. Specifically what code, ordinance and/or criteria are
the Planning Commission referring to in making its

In reaponee to the queetione posed in your letter of July 12,
1988, car rental operations are conditional uaes requiring a
Special Use Permit in the M-1, Light Industrial zoning district
(Code Section 25.42.030 g) as well as the C-4, Waterfront
Commercial district (Code Section 25.41.020 f). Due to the
potential parking and traffic impacts of car rental operations,
Planning Commission review of such uses is necessary.
The best way to verify whether a particular site is suitable for
a certain use or whether sufficient parking exists on the site is
to check with the Planning Department. Since there are special
circumstances associated with individual sites, it is difficult
to provide you with generalities which will apply to all sites in
determining compatability for a proposed use.
In reviewing a project for a Special Use Permit, the Planning
Commission is typically concerned with the project's
compatability with the other uses in the area as well as other
projects approved by the city. In addition, the proposed use is
reviewed for any traffic or parking problems which it may create
or contribute towards, as well as any negative effects it may
have on neighboring properties.

RESOLUTION N0.
RESOLUTION APPROVING SPECIAL PERMIT
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, application has been made for a special permit
a car rental agency at the Embassy Suites Hotel
at 150 Anza Boulevard �p,pN 026-342-220/330/240 �
and
WHEREAS, the Planning Commission held a public hearing on
said application on July 25 , 1988, at which time said
application was approved;
WHEREAS, this matter was cal l ed bp bv counci 1 and a
hearing thereon held on August 15 , 19 8, at which time
it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Council that said special permit is approved, subject to the
conditions set forth in Exhibit "A" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the off•icial records of the County of San
Mateo.
