VARIANCES FOR THE FRONT AND SIDE SETBACKS FOR A RESIDENTIAL
STRUCTURE AT 24 ANITA ROAD
The applicant, Pat Mannion, is requesting a 2'-10" variance to the required 15' front
setback at 24 Anita Road (Code Sec. 25.62.040) on a property zoned R-3. The side
setback variance is required because of the proposed remodeling and the uncertainty
of the side setback line, the side setback appears to vary from 2'-10" to 3'-4"
(minimum allowed is 3'-0") (Code Sec. 25.50.070). All other zoning requirements
for parking, lot coverage and height are met by the proposed design.
Staff have reviewed the request. The City Engineer (August 1, 1983 memo) and the
Chief Building Inspector (August 8, 1983 memo) had no comments. The Fire Marshal
(August 3, 1983 memo) notes that he will need more detailed plans of the garage and
the one hour construction of all garage walls within 3' of the property line.
Planning staff would point out that there is a bay window on the house next door
to 24 Anita. But the window on the adjacent home projects only a foot or so, and
the house meets the 15' required setback to the wall of this window. It should also
be pointed out that the garage will be relocated to the rear of the site.
On July 17, 1983 the applicant submitted a letter regarding his request. In
letter he notes that exceptional circumstances do not apply to this request.

In summary, this property is zoned R-3. The applicant is making repairs and an
addition to an existing sin,gle.family structure. The side yard setback item is
insignificant and the result of the original placement on the lot. The cost of
correction to the side yard setback would be prohibitive. The existing front
setback appears to be consistent with all the structures on the same side of Anita.
This setback was probably established at the time of construction when the area was
single family residential. Even when redeveloped according to the R-3 requirements,
development would have to meet the 15' setback requirement.
To grant a variance the Commission must find that the following conditions apply to
the property (Code Sec. 25.54.020):
a. that there are exceptional or extraordinary circumstances applicable
to the property or class of uses in the district, so that a denial of
the application would result in undue property loss;
b. that such variance would be necessary for the preservation and enjoyment
of a property right of the owner of the property involved;
c. that the granting of such variance would not be materially detrimental
to the public health, safety or welfare, or injurious to the property
or improvements of other property owners, or the quiet enjoyment of
sWch property or improvements; and

d. that the granting of such variance will not adversely affect the
comprehensive zoning plan of the city.
The Commission should hold a public hearing. The following condition should be
addressed:
1. that the project as-built be consistent with the plans dated
August 15, 1983.
