MEMO TO: PLANNING COMMISSION

SUBJECT: CONDOMINIUM PERMIT FOR FIVE UNITS AT 137 ANITA ROAD
The applicant, Dunlap Design, is requesting a condominium permit for
five two-bedroom units. The three-story building provides nine covered
spaces on the ground floor; the noses of the cars will project into the
side yard area (no security gate is proposed). The tenth required
parking space is uncovered, at the rear of the buildin_q. Private open
space is provided with 75 SF decks (75 SF minimum is required); 1,500
SF of general open space is provided in the rear yard area (500 SF
minimum is required). The proposal complies with other zoning
requirements for height, lot coverage, setbacks and landscaping
requirements.
City staff hav� reviewed this project. The Chief Building Inspector
had no comments. The Director of Parks (July 10, 1985 memo) requires
the street trees to be protected during construction and the final
landscape plans to be reviewed by his department. The City Engineer
lists seven requirements (August 20, 1985 memo), two of which have
already been met by the applicant (see revised sheets 2 and 3, date
stamped August 16, 1985). He requires a complete lot survey, drainage
to the street, both sidewalk layout and final site plan to be approved
by the Parks and Public Works Departments, and utilities to be
installed underground. The Fire Marshal notes (July 9, 1985 memo) that
the building must be sprinklered and monitored by a central station,
the security gate at the third floor exit can have no locking device in
the direction of exit travel, no exterior walls less than 5' from a
property line can have openings, one hour construction required
throughout and the third floor dead end corridor is to be eliminated.
In order to eliminate the dead end corridor the applicant will be
required to add a stairway at the east end of the third floor balcony/
exit so that persons fleeing a fire can run in either direction on the
balcony and find an exit.
The Planning Commission should note that the applicant has not
submitted the required copy of the Covenants, Conditions and
Restrictions for review by the City Attorney. This is reviewed
normally at staff level before the project appears on the agenda for
study. Since this has not occurred at this time, the permit can be
conditioned that this document be reviewed and approved prior to the
issuance of a foundation permit.
At study the Planning Commission asked if quest parking spaces will
marked. In a conversation with Jim Valenti (architect) he said that
they intend to assign two spaces to each tenant and one of each pair
spaces will b� used by the tenant for his/her guests but will not be
marked.

The Planning Commission also asked about additional lighting for
security. The applicant's revised site plan shows the addition of
"light fixtures on timer" at the landing of the front stairs.
The applicant's revised plans also address several of the City
Engineer's concerns: drainage is shown to be directed to the street,
the driveway has been realigned, and a trash area is provided on the
south side of the building. Other requirements can be handled at the
time that the building permit is issued.
The Planning Commission should hold a public hearing. Affirmative
action on the condominium permit should be taken by resolution. At the
public hearing the following conditions should be considered:
l. that the conditions of the Fire Marshal's memo of July 9, 1985, the
City Engineer's memo of August 20, 1985 and the Director of Parks'
July 10, 1985 memo shall be met;
2. that the project shall be consistent with the plans submitted to
the Planning Department (except as amended to meet the exiting
requirements of the Fire Department> and date stamped August 16,
1985;
3. that the landscape plan shall be consistent with the plan date
stamped June 26, 1985 except as revised to allow the realignment of
the front 3riveway;
4. that the garage ar2a will not be secured by a gate without
amendment of the condominium permit; and
5. that the Covenants, Conditions and Restrictions for this building
be reviewed and approved by the City Attorney prior to issuance of
the foundation permit for this project.

The following conditions should be attached to any approvals of this project:
1. A complete survey plat to the detail of a parcel map is required
before building permit showing how property corners were established
and set.
2. Surveyor or Civil Engineer to determine direction of drainage of
lot at rear prior to building permit issuance.
3. All drainage from site, including the rear area, must be directed
to Anita. This will require additional site fill at rear property
line of about 18" above adjacent property.
4. Through curb drainage system required for all site drainage.
5. A screened trash receptacle area needs to be provided behind front
setback area.
6. Final layout of sidewalk to be approved by Parks and Public Works
Departments.
7. Final site plan to be as approved by Parks and Public Works Departments.
8. Any utilities shall be installed underground. Any transformer required
shall also be underground or behind front setback and screened from
street.

I have reviewed the plans submitted for this permit and have the following comments:

throughout. This system must be monitored by an approved central station.
