structures provided the addition will not result in an increase of more than 50% of the floor area of the
structures before the addition.
Summary: The existing house is two stories with a lower level half story and was built in 1935. The
owners applied for and were granted a Hillside Area Construction Permit in 2005 to add a sunroom
with a 9'-0" plate height at the rear of the first floor. Since that approval, the owners have decided to
revise the project so that the sunroom has a 10'-0" plate height to match the plate height in the
adjoining living room.
The applicant is proposing to build a 360 SF sunroom on the first floor at the rear, left side of the
house. The proposed addition will have a 10'-0" plate height where any plate height greater than 9'-0"
requires design review. The first floor of the existing house has a plate height of 9'-0" throughout,
except for the living room which has a 10'-0" plate height.
With the proposed addition, the floor area on site will increase from 3,632 SF (0.32 FAR) to 3,992 SF
(0.35 FAR) where 4,779 SF (0.42 FAR) is the maximum allowed. There are 4 existing bedrooms and
this number will not be increased with the proposed addition. The existing attached garage in the
lower level half story provides two non-conforming covered parking spaces (18'-10" in length where
20' is required) where there one covered parking space is required for a 4-bedroom house. All other
zoning code requirements have been met.
The applicant is requesting the following:
• Design Review for an addition with a plate height higher than 9'-0" (C.S. 25.57.010, a, 2); and
• Hillside area construction permit for a single-story addition (CS 25.62.020).

Design Review Study Meeting: At the Planning Commission design review study meeting on
September 25, 2006, the Commission asked the applicant to make several minor changes to help the
addition blend with the existing architecture (9.25.06 Planning Commission Minutes). The
Commission moved to place this item on the consent calendar when revised plans were submitted.
The designer submitted revised plans for Sheets 1 and 5 and a letter of explanation, dated October 4,
2006, in response the Commission's suggestions. The applicant made the following revisions to the
plans to address Planning Commission's concerns:

• The roof over the addition was revised from a mansard design to a flat roof with a pilaster-rail
system to match the existing roof over the garage at the front of the house;
• A plaster medallion, similar to the existing feature over the front door, was added to the center
of the rear elevation, over the doors; and
• A direct-vent terminal cap was added to the interior side of the pilaster wall above the proposed
fireplace.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted
by the Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Findings: Based on the findings stated in the attached minutes of the Planning Commission's
September 25, 2006, design review study meeting, that the architectural details of the addition,
including the flat roof with a pilaster railing and the vent cap on the iireplace, succeed in blending the
architectural style, mass and bulk of the addition with that of the existing structure, the project is found
to be compatible with the requirements of the City's five design review guidelines.
Required Findings for Hillside Area Construction Permit: Review of a hillside area construction
permit by the Planning Commission shall be based upon obstruction by construction of the existing
distant views of nearby properties. Emphasis shall be given to the obstruction of distant views from
habitable areas within a dwclling unit (Code Sec. 25.61.060).
Findings for Hillside Area Construction Permit: Based on the design of the addition as a single-
story element and the proposed location of the addition at the rear of the existing house, and on the
findings stated in the attached minutes of the Planning Commission's September 25, 2006, design
review study meeting, the project is found to be compatible with hillside area construction permit
criteria listed above.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for design review and hillside area
construction permit, and the reasons for any action should be clearly stated. At the public hearing the
following conditions should be considered:

1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped August 17, 2006, sheets 2,3,4 and 6 and date stamped October 10, 2006, sheets 1 and
5, and that any changes to building materials, exterior finishes, footprint or floor area of the
building shall require and amendment to this permit;
2. that the conditions of the Chief Building Inspector's August 22, 2006, memo, the City
Engineer's, the Fire Marshal's and the NPDES Coordinator's August 28, 2006, memos, and the
Recycling Specialist's September 9, 2006 memo shall be met;
3. that demolition or removal of the existing structures and any grading or earth moving on the site
shall not occur until a building permit has been issued and such site work shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
4. that any changes to the size or envelope of the basement, first or second floors, or garage, which
would include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to Planning Commission review;
5. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as
window locations and bays are built as shown on the approved plans; if there is no licensed
professional involved in the project, the property owner or contractor shall provide the
certification under penalty of perjury. Certifications shall be submitted to the Building
Department;
6. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
8. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2001 Edition, as amended by the City of Burlingame;
9. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance
which requires affected demolition, new construction and alteration projects to submit a Waste
Reduction plan and meet recycling reqtiirements; any partial or full demolition of a structure,
interior or exterior, shall require a demolition permit; and

10. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance.

house style should have a greater setback between houses created by a detached garage•
■ understand problem with the garage, neighborhood has a mixed parking pattern of att ed and detached
garages, the proposed 32 foot setback does help with the existing parking patte in the neighborhood;
attached garage fits in with the neighborhood;
■ the addition is well proportioned in massing, like the design;
■ should consider using some type of base to give something for t ouse to sit on, maybe horizontal
wood siding with a water table on top; and
■ provide landscape plan, include larger scale trees and s s for screening.
C. Auran noted that the property owner completed ery nice project on Sanchez Avenue which included a
garage, addition to the house and cobblestone veway and made a motion to place this item on the consent
calendar at a time when the above revisio ave been made and plan checked. The motion was seconded by
C. Cauchi.
Comment on motion: Co issioner noted that he would be voting against the project only because the
garage is proposed to attached, feel a dctached gara�e is more appropriate in this neighborhood. There
were no other co ents from the floor and the public hearing was closed.
Chair B nrigg called for a vote on the motion to place this item on the consent calendar when plans had
bee revised as directed. The motion passed on a voice vote 6-1 (C. Deal dissenting). The Planning
ommission's action is advisory and not appealable. This item concluded at 10:05 p.m.
11. 1461 ALVARADO AVENUE, ZONED R-1— APPLICATION FOR DESIGN REVIEW AND HILLSIDE
AREA CONSTRUCTION PERMIT FOR A FIRST FLOOR ADDITION (JACK MCCARTHY,
APPLICANT AND DESIGNER; GEORGE AND ANDREA SCARBOROUGH, PROPERTY OWNERS)

CP Monroe briefly presented the proj ect description. Commissioner noted that while on a site visit he spoke
with the property owner about the details of the proj ect but not the merits. There were no questions of staff.
Chair Brownrigg opened the public comment. Jack McCarthy, designer, 5339 Prospect Road #311, San
Jose, noted that thc addition was previously approved with a 9 foot plate height, now would like to increase
the plate height to 10 feet so that it matches the existing plate height on the first floor living room, would
like to take advantage of the beautiful rear yard. There were no other comments from the floor and the
public hearing was closed.
Commissioners had the following comments regarding the project:
■ concerned with the mansard roof design on the addition, mansard will not work;
■ therc is great detail on the front fa�ade of the house, should carry the details at the front of the house to
the rear addition;
■ consider using a flat roof to tie the addition into the house; and
■ new gas fireplace should be architecturally consistent with the existing fireplace, should look like the
existing fireplace narrowing towards the top; could add architectural elements such as brick or iron or an
ornament to tie it together.

C. Terrones made a motion to place this item on the consent calendar at a time when the above following
revisions have been made and plan checked. This motion was seconded by C. Vistica.

advisory and not appealable. This item concluded at 10:10 p.m.
XI. COMMISSIONER'S REPORTS
- Summary of Permit Processing Committee Meeting of September 8, 2006.
CP reviewed briefly the direction given staff by the Permit Processing Subcomm' ee regarding demolition
without a permit, fees for such demolition and fees for work done without permit. After some general
discussion the and no direction to change Subcommittee's direction to S f, Commission directed that the
item be brought back to the Commission on the action calendar for blic hearing.
XII. PLANNER REPORTS
- Review of City Council regular meeting of Septe er 18, 2006.
CP Monroe noted that the Council had revie the Council and Commission survey results regarding
single family residential development and ign issues and suggested that the commission to look at mass
and bulk as it related to neighborhood f nd consistency in the coming year. This item was referred to the
Neighborhood Consistency Subco ittee of the Planning Commission for further consideration.

Commission had no com ents on the proposed change to the roofing material on this project.

We have revised the plans per the suggestions made by the members of the Planning Commission at the
September 25, 2005 meeting. The revisions are shown on page 1 and page 5 as follows:
1. The sloped roof of the structure has been completely removed and replaced with a pilaster-rail
system to blend with the front patio over the garage.
2. A medallion has been added to the center of the rear elevation over the doors.
3. The direct vent terminal cap will be placed on the interior side of the pilaster wall above the
fireplace. In this way the fireplace will look like part of the exterior rather than small fireplace
trying to compete with the existing brick fireplace of the living room.
We will be glad to answer any questions of the commission at the public hearing.

The Scarborough's would like to construct a family room to the rear of their residence at 1461 Alvarado
that was originally constructed in 1935. We are requesting that we be allowed to construct the ceiling of
the family room to the same height as the living room to the front and the nook to the side so that all three
ceiling will plane together at the same elevation. At present you step down 1 foot from the entry/nook
finished floor to the living room finished floor. The existing entry/nook ceiling height it 9 feet high and the
existing living room is 10 feet high. The living room has two existing beautiful double French doors that
we would like to keep and the natural flow of the residence to the rear yard works best with the family
room and living room at the same finished floor elevation therefore requiring the 10 foot ceiling height.
We feel that, as stated above, the natural flow of the structure will best be accomplished and the original
style of this 1935 structure kept with a 10 foot family room ceiling. The room also will not be visible to the
street, the rear or the right side. The neighbor to the left side at 1457 Alvarado has all of their windows
well above the elevation of the addition and the addition will not impact their light or ventilation in any way.
We would be h ppy to answer any questions that you will have at the public hearing.

1) All construction must comply with the 2001 California Building Codes (CBC),
the Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
2) Provide fully dimensioned plans.
3) Provide a complete demolition plan that indicates the existing walls, walls to
be demolished, new walls, and a legend. NOTE: The Demolition Permit will
not be issued until a Building Permit is issued for the project.
4) Comply with the new, 2005 California Energy Efficiency Standards for low-rise
residential buildings. Go to http://www.enerqy.ca.qov/title24 for publications
and details.
5) Provide guardrails at all landings. NOTE: All landings more than 30" in height
at any point are considered in calculating the allowable floor area. Consult the
Planning Department for details if your project entails landings more than 30"
in height.
6) Provide handrails at all stairs where there are four or more risers.
7) Provide lighting at all exterior landings.

1) Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not
limited to ensuring that all contractors implement construction Best Management
Practices (BMPs) and erosion and sediment control measures during ALL phases
of the construction project (including demolition). Include appropriate stormwater
BMPs as Project Notes. These BMPs include but are not limited to the following:
• Store, handle, and dispose of construction materials and wastes properly
to prevent contact and contamination of stormwater;
• Control and prevent the discharge of all potential pollutants, including
pavement cutting wastes, paints, concrete, petroleum products, chemicals,
wash water or sediments, and non-stormwater discharges to storm drains
and watercourses;
• Use sediment controls or filtration to remove sediment when dewatering
site and obtain all necessary permits;
• Avoid cleaning, fueling, or maintaining vehicles on-site except in a
designated area where wash water is contained and treated;
• Protect adjacent properties and undisturbed areas from construction
impacts using vegetative buffer strips, sediment barriers or filters, dikes,
mulching, or other measures as appropriate;
• Perform clearing and earth moving activities only during dry weather;
• Limit and time application of pesticides and fertilizers to prevent polluted
runoff;
• Limit construction access routes and stabilize designated access points;
• Avoid tracking dirt or other materials off-site; clean off-site paved areas
and sidewalks using dry sweeping method;
• The Contractor shall train and provide instruction to all employees and
subcontractors regarding the construction BMPs.

2) The public right of way/easement shall not be used as a construction staging
and/or storage area and shall be free of construction debris at all times. The
easement shall be protected from any site runoff.
3) Implement Erosion and Sedimentation Controls (if necessary):
a. Install and maintain all temporary erosion and sediment controls
continuously until permanent erosion control have been established;
b. Address method(s) for diverting on-site runoff around exposed areas and
diverting off-site runoff around the site;
c. Address methods for preventing erosion and trapping sediment on-site.
4) Provide notes, specifications, or attachments describing the following:
a. Construction, operation and maintenance of erosion and sediment control
measures, including inspection frequency;
b. Methods and schedule for grading, excavation, filling, clearing of
vegetation, and storage and disposal of excavated or cleared material.
Brochures and literatures on stormwater pollution prevention and BMPs are available for
your review at the Planning and Building departments. Distribute to all project
proponents.

RESOLUTION APPROVING CATEGORICAL EXEMPTION, DESIGN REVIEW AND
HILLSIDE AREA CONSTRUCTION PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
desi�n review and a hillside area construction permit for a first floor addition at 1461 Alvarado
Avenue, zoned R-1, Geor�e and Andrea Scarborou�h property owners APN: 027-103-030;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
October 23, 2006, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearin�;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19, Section: 15301 Class
1(e)(1) - additions to existing structures provided tlie addition will not result in an
increase of more than 50% of the floor area of the structures before the addition, is
hereby approved.
2. Said design review and hillside area construction permit are approved, subject to the
conditions set forth in Exhibit "A" attached hereto. Findings for such design review and
hillside area construction permit are as set forth in the minutes and recording of said
meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Department
date stamped August 17, 2006, sheets 2,3,4 and 6 and date stamped October 10, 2006,
sheets 1 and 5, and that any changes to building materials, exterior finishes, footprint or
floor area of the building shall require and amendment to this permit;
2. that the conditions of the Chief Building Inspector's August 22, 2006, memo, the City
Engineer's, the Fire Marshal's and the NPDES Coordinator's August 28, 2006, memos,
and the Recycling Specialist's September 9, 2006 memo shall be met;
3. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall be
required to comply witl� all the regulations of the Bay Area Air Quality Management
District;
4. that any changes to the size or envelope of the basement, first or second floors, or garage,
which would include adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to Planning
Commission review;
5. that prior to scheduling the framing inspection, the project architect, engineer ar other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is
no licensed professional involved in the project, the property owner or contractor shall
provide the certification under penalty of perjury. Certifications shall be submitted to the
Building Department;
6. that prior to final inspection, Planning Department staff will inspect and note compliance
of the architectural details (trim materials, window type, etc.) to verify that the project
has been built according to the approved Planning and Building plans;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the portions of the roof not visible from the street; and
that these venting details shall be included and approved in the construction plans before
a Building permit is issued;
8. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2001 Edition, as amended by the City of Burlingame;

9. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit; and
10. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm
Water Management and Discharge Control Ordinance.
