This fence exception application is the result of the re-constiuction and raising of a new rear yard deck and ttie const�-uction of raised fencing to screen the new raised deck from the adjacent property owners. Work was initially completed without the benefit of a building permit. Neighbors located immediately to the North and South of 1414 Alvarado Ave. have retained their outdoor privacy through the use of screening or the new high 12'-2" fencing that you are evaluatiiig this evening. Categorically Exempt per Section: 15303 - construction and location of new, small facilities or structures -(e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. History: On March 12, 2007, the Planning Department received a complaint about illegal construction of a deck at 1414 Alvarado Avenue. A building permit has since been issued for the deck, but during the Building Official's inspection a new fence exceeding height requirements was identified on the property. On March 20, 2007, a notice of violation was sent to the property owners. After communication between the property owners and the Code Enforcement Officer, the property owners submitted an application to the Planning Commission for a Fence Exception on April 9, 2007. The Planning Commission reviewed the application as a study item on June 25, 2007. Summary: The applicant is requesting a Fence Exception to allow a 7'-2" to 12'-7" tall redwood fence along the right side and rear property lines. The as-builUproposed fence is located entirely on private property and will not extend into the public right-of-way. The R-1 District fence regulations state that the maximum height of a fence along both the side and rear property lines is 6'-0" of solid material plus one additional foot of material that is open in design (allowing light and air to pass through). A building permit will be required for this new fence. Along the rear property line, the fence is 6'-2" tall with 1'-0" of lattice and totals 7'-2" in height. Along the right side property line, the new fence begins 43'-0" towards the rear of the property from the front property line. For the next 7'-7", the solid wood fence is between 7'-4" and 8'-5" in height with and additional 1'-0" of lattice. For the next 15'-9" it is between 7'-0" and 8'-1" in height with 4'-1" of lattice. For the next 24'-1" along the right side property line, the solid wood fence is between 7'-6" and 8'-6" in height with an additional 4'-1" of lattice. And for the final 31'-7" of the right side property line, the fence is 6'-2" in height with 1'-0" of lattice. Please refer to the diagram included in the staff report and the table below for the height of the fence at different locations along the right side property line. Fe�ice E.�ceptiora 1414 Alvcn-ado A1�enue Staff Comments: The City Engineer, Fire Marshal, and NPDES Coordinator reviewed the proposed project. The City Engineer had a comment concerning the location of the fence, stating that neither the fence nor the gate shall encroach into the City's right-of-way. Study Meeting: At the Planning Commission study meeting on June 25, 2007, the Commission had comments regarding the project and placed this project on the Action Calendar when the comments had been addressed (June 25, 2007 Planning Commission Minutes). Listed below are the Commission's comments and responses provided by Planning Division staff. 1. The site at 1421 Benito Avenue (directly behind fhe subject property) has a new house; it has limited landscaping at the rear of the lot. The approved /andscape plan should be reviewed to determine if the property is in compliance. Planning staff completed a final inspection of the project at 1421 Benito Avenue in 2005, confirming all trees and lawn had been installed where required. Following the Planning Commission's inquiries on June 25, 2007, Planning staff inspected the backyard of 1421 Benito Avenue from the rear easement on July 12, 2007. Staff noted that the landscaping appears to have been installed according to plan, and although some specific plants may have died or been moved since the final inspection, the rear yard is landscaped and maintained. 2. Written confirmafion from the neighbors at 1412 Alvarado is required to confirm they have agreed fo fhe increased fence height. • Randy and Janice VandenBrink, the property owners of 1412 Alvarado Avenue, submitted a letter to the Planning Division on August 9, 2007. The VandenBrink's consent to the fence height and are in full support of the fence exception (Response letter from neighbors date-stamped August 9, 2007). 3. The applicant is encouraged to meet with the city to determine options for landscaping within the easement behind the subject property. (Any landscaping within the easemenf would require an encroachment permit). The applicant has not yet had a discussion with the Public Works Department to discuss landscaping options. Required Findings for a Fence Exception: In order to grant a Fence Exception for height, the applicant must show, and the Planning Commission must find, the following exist (CS 25.78.050): that there are exceptional circumstances; 2. that there is no public hazard; 3. that neighboring properties will not be materially damaged; and 4. that the regulations cause unnecessary hardship upon the petitioner. Affirmative action should be made by resolution and should include findings made for the requested fence exception. The reasons for any action should be clearly stated. The portion of the fence that exceeds the al lowable height is situated between our adjacent houses, and decks. It was built by mutual consent and we jointly paid for the portion of the fence that separates our properties. We are in full support of a variance being granted. The fence is not visible from the street, and those that can see it from the rear would see the side of our house rather than a fence covered with greenery if it is not allowed. Due to the sloping nature of the lots at 1412 and 1414 Alvarado Ave, a fence or screen of this height is necessary in order to provide any privacy between the first floors of our residences and decks. The upper portion of the fence is largely latticework, and the vines that have been planted are already providing more of a view of the greenery, than of fence. The height of the fence also screens our breakfast room and deck from the property at 1421 Benito Ave. It is my understanding that the owner of 1421 Benito has asked for screening trees to be required as a condition of this variance by the Oldham's. Before considering that request I would ask that you understand the history of the involved properties. We have resided at 1412 Alvarado Ave for 30 years. For at least 25 of those years the rear of 1414 Alvarado has had a pool, and concrete covering the rear yard. We have added screening trees on 1412 A(varado as we were surrounded by pools, and now have 15 trees in excess of 12 feet tall. The property at 1421 Benito, until recently had a smaller house on a lot that was 2-5 feet lower than the current lot in elevation. In addition there were 3-4 tall skinny trees on the North side of the lot, and one large tree in the rear yard in the Southwest corner. These combined elements screened most of 1421 Benito from the neighbors. The current owner of 1421 Benito chose to build a larger house and not to replace any of the trees that had been removed. We do not feel that putting conditions on the fence, which impacts only the Oldham's and ourselves, is the proper way to mitigate the lack of screening landscaping between the other adjoining properties. The subject property is a rear sloping lot that looks down on my back yard. I'm the neighbor being affected by the on- going rear yard improvements. The property before you this evening is currently �oing through three sepazate rear yard improvements, the 151 being a permitted rear yard addition, the 2° and 3"�, being the re-construction and raising of a major rear yard deck and the construction of raised fencing and barricades along the side yards for the neighbors located immediately to the North and South, The deck and fence improvements were completed itutially without the benefit of the required building pernut, and did not show up on the original reaz yazd addition drawings. I understand from Debbie Oldham, the owner of 1414 Alvarado that a fourth project is in the wnrks that will re-landscape the backyard. It is unfortunate that a consolidated master improvement plan for this property has not taken place, because if you assemble these on-going projects in the aggregate, it would have supported involdng design review to coordinate the substantial construction activity occumng in the rear yard of 1414 Alvarado. Invoking design review would have prevented the construction of high fence barricades that you're reviewing this evening. Chapter 9 of the City of Burlingame Design Guidebaok requires that Large Plant Elements should be placed to provide visual separation and privacy between neighboring outdoor rooms. Requiring khe Oldhams to install large trees along the rear fence, as screening between the outdoor space of 1421 Benito, located East of 1414 Alvarado would help to create a sense of separation and privacy.
