Prior to this parking issue, we � had no contact with Ms. Ferer, the owner of 1408 Alvarado. � The recently constructed concrete pad, except for the three feet next to the sidewalk, is contiguous to the entire length of her level driveway. A large utility van had been parked there on a nearly continuous basis. The van, when parked as you see in the photo taken by Mr. Alfred Palmer, is visible from our front yard, side yard, living room, breakfast room, and three upstairs bedrooms. The document given to us by Mr. Sean O'Rourke states that to grant this variance to code (Code Section 25.54.020 a-d), you must find: a. There are exceptional or exfraordinary circumstances or conditions applicable to the property involved fhat do not apply generally fo property in the same district. Street parking is probably better here than for most properties in the district. There is ample level street parking, 25 to 30 spaces, within 100 feet of 1408 Alvarado. In front of our home, there is almost always space open and not used for five cars. When she approached us, we advised Ms. Ferer she is welcome to park in front of our home. Regarding the concern that a parked van might block the view of traffic - that applies to virtually every property in the district. b. The granfing of the application is necessary for the preservation and enjoymenf of substantial property right of the applicant, and to prevent unreasonable property loss or unnecessary hardship. Mr. O'Rourke reviewed a drawing of 1408 Alvarado. It shows the three-bedroom home has two covered parking spaces, and two spaces in the driveway. Nothing prevents the use of these parking spaces. Where is the loss or hardship? c. The granting of the application will not be detrimental or injurious to property or improvements in the vicinity and will not be defrimental to fhe public health, safety, general welfare, or convenience. We certainly feel this is detrimental to our home. To allow vehicles, especially commercial vehicles, to park in the front setback area, degrades the character of the neighborhood from a residential district to a commercial district. d. The use of the property will be compatib/e with the aesthetics, mass, bulk and characfer of existing and potential uses of properties in the general vicinity. A vehicle parked there is highly visible because the pad is three feet from the sidewalk and is contiguous to the driveway. It has a commercial look. It is not compatible with existing or potential residential uses in the general vicinity. Categorically Exempt per Section: 15301 - Class 1(c)(1) — minor alterations of existing private facilities involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Summary: As a result of a neighbor complaint and subsequent follow-up by the City's Code Enforcement Officer, the applicant is requesting a parking variance to allow parking within the front setback at 1408 Alvarado Avenue, zoned R-1 (see attached code enforcement officer's letter dated July 1, 2002). The property is an interior lot located on Alvarado Avenue at the intersections of Hillside Drive and Hillside Circle. The current property has an attached tandem garage with existing driveway that measures approximately 8'-4" x 42'-9". The new parking pad is located in the front setback adjacent to the driveway and is bordered on the front and right side by an existing 5'-0" hedge. The applicant states that the Alvarado/Hillside intersection is very busy and there is very little street parking available. In addition, neighbors have complained that visibility is impaired when the applicant parks her van which she uses for her work on the street. No building permits are required for the addition of the parking pad. The applicant is requesting the following: • Parking variance to allow parking in the front setback (C.S. 25.70.030 (3)(a)). Staff Comments: There were no comments from the Building, Public Works, or Fire Departments. Planning staff would note that because of the nature of the request it was determined that this project could be brought forward directly to the action calendar. If the Commission feels there is a need for more study, this item may be so directed. Findings for a Variance: In order to grant a variance, the Planning Commission must find that the following conditions exist on the property (Code Section 25.54.020 a-d): (a) (b) (c) (d) There are exceptional or extraordinary circumstances or conditions applicable to the property involved that do not apply generally to property in the same district; The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant, and to prevent unreasonable property loss or unnecessary hardship; The granting of the application will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; and That the use of the property will be compatible with the aesthetics, mass, bulk and character of existing and potential uses of properties in the general vicinity. Affirmative action should be by resolution and include findings made for design review, and the reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Department date stamped July 16, 2002, sheet 1; 2. that the parking variance for parking within the front setback shall expire if either or both the house or garage are demolished or remodeled; and 3. that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame. IF I park my van on the street, I risk contributing to an accident, or damage to my van. Additionally, several of my neighbors have complained that when my van is parked on the street, they have difficulty pulling out of their driveways because the van blocked their view of oncoming traffic. b. I have a right to protect my van from damage. IF lef parked on this busy street, I risk damage from an accident, or contributing to someone else's accidenet. c. Explain why the proposed use at the proposed location will not be detrimental or injurious to property or improvements in the vicinity or to public health, s�f�dy, general ivelfare or convenience. I do not believe that parking my new 2001 van in my driveway will reduce property values in my neighborhood, nor does it devalue my home. It will not jeopordize the public health, safety, or welfare of property or improvements in my neighborhood. d. How will the proposed project be compatible with the aesthetics, mass, bulk and character of the existing and potential uses on adjoining properties in the general viCin[ty? My parking pad is the smae color concrete as my driveway, and is protected by 5 foot hedges on 2 of 4 sides. When a vehicle is parked on the pad, it is only visible from a few angles, becasue it is protected by hedges. Do any condirions exist on the site which make other altemarives to the variance impracricable or impossible and are also not common to other properties in the area? For example, is there a creek cutting through the property, an exceptional tree specimen, steep terrain, odd lot shape or unusual placement of existing structures? How is this property different from others in the neighborhood? b. Explain why the variance request is necessary for the preservation and enjoyment of a substantial properry right and what unreasonable property loss or unnecessary hardship might result form the denial of the application. Would you be unable to build a project similar to others in the area or neighborhood without the exception? (i.e., having as much on-site parking or bedrooms?) Public health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water supply safety, and things which have the potenrial to affect public health (i.e., underground storage tanks, storage of chemicals, situations which encourage the spread of rodents, insects or communicable diseases). Public safety. How will the structure or ��se within the structure affect police or fue protecrion? Will alarm systems or sprinklers be installed? Could the structure or use within the stcuchue create a nuisance or need for police services (i.e., noise, unruly gatherings, loitering, traffic) or fue services (i.e., storage or use of flammable or hazardous materials, or potentially dangerous activiries like welding, woodwork, engine removal). General welfare is a catch-all phrase meaning community good. Is the proposal consistent with the city's policy and goals for conservation and development? Is there a social benefit? Convenience. How would the proposed structure or use affect public convenience (such as access to or parking for this site or adjacent sites)? Is the proposal accessible to particular segments of the public such as the elderly or handicapped? d. H�w will the proposed project be compatiLle with tl:e aesthetics, mass, bulk and character of the existing and potential uses on adjoining properties in the general vicinity. How does the proposed structure or use compare aesthetically with existing neighborhood? If it does not affect aesthetics, state why. If changes to the structure are proposed, was the addition designed to match existing architecture, pattern of development on adjacent properties in the neighborhood? If a use will affect the way a neighborhood or area looks, such as a long term airport parking lot, compare your proposal to other uses in the area and explain why it fits. How does lhe proposed structure compare to neighboring structures in terms of mass or bulk? If there is no change to the structure, say so. If a new structure is proposed, compare its size, appearance, orientation, etc. with other structures in the neighborhood or area. How will the structure or use within the structure change the character of the neighborhood? Think of character as the image or tone established by size, density of development and general pattern of land use. Will there be more traffic or less parking available resulting from this use? If you don't feel the character of the neighborhood will change, state why. How will the proposed project be comparible with existing and potential uses in the general vicinity? I constructed a concrete pad on my front setback area adjacent to the driveway. I did this so I could park my van on this pad, and alleviate parking and traffics problems. As you may already know, the Alvarado, Hillside intersection is very busy and there is very little street parking. When I used to park my van on the street, it made this very busy intersection even more dangerous and congested. In addition, when my van was parked on the street, several of my neighbors had difficulty pulling out of their driveways because the van blocked their view of oncoming traffic. My next door neighbor complained to me about this, and I thought the best way to fix the problem was to construct and park on the pad. A letter from Alfred Palmer, dated July 1, 2002 states that I have the option to apply for a variance to allow me to park my van on my driveway. Attached please find my application for a variance. I have recently become a single parent. I have two girls ages 7 and 5. I also work two jobs, one of which requires my van. Can I request that I be placed early on the agenda so I can be home for my girls in the evening, and do not have to leave them with a babysitter while I attend the planning meetings? I hope you can determine from the pictures in the attached letter from Mr. Palmer, that my van is discreetly parked on my setback area, and is fully covered by hedges. If I am must park my van back on the street, I risk contributing to an accident, or damage to my van. Your consideration in this matter is greatly appreciated.
