The Canmission held a pu�lic hearing Septen�ber B, 1980 on a variance application by
f�1r. and (�irs. Phil Taurian i:o add a 7J.8 SF second floor bedroom and Uathroom to the
existing 1800 SF single family home at the corner of Hillside Drive and Alvarado
Avenue. During the hearing Alexandra Nicholson, ov�n�er of the adjaceni; home at
2715 Hillside Drive, spoke against the application, stating that the tt�,�o windows in
the new second floor bedroom �vould result in a loss of privacy in her bacl<yard.
After Commissi�n discussion at the co��c�usion of the hearing the plans were modi�fied;
a motion was thnn made to approve the ap��lication "based on the modified plans",
i.e., "a revised window e�esign ... which reduced the size of the t�vo easterly
bedroom windo��Js to less than half tl��at sho�vn on i:he (August 2?_, 19�0) plans, and
raised the sill level to 4'-3" above the floor line (rather than the proposed 2'-0")".
Based on the above approval, a Building Permit for the addit�ion was issued September 16,
19�0. Work has now started and the fram-ing of the second floor completed. The attached
October 6, 19�U letter fram Mrs. Taurian states i:f�at I�er neighbor has recently had
second thougf�ts about �;he amended vrindow design and now feels that "the original
size would lool; much better". Mrs. Taurian therefore requests that the Cor�mission
allow the installation of tuao 3' x 5' windo4,rs of 15 SF each, rather than the smaller
7 SF windows �rhich were approved (see E>:hibits A and B}.
Staff has requested a letter from Ms. Nicholson in support of Mrs. Taurian's stateri�ents;
the letter has been promised by the October 15 hearing.
In reviewing th-is matter, Comrnission should consider the reasonableness of the
ori�inal protest. If Ms. Nicholson were to sell f�er home ai, some futu��e date, the
new�owner would also be subject to a possible loss of privacy. However, the new
windows would be in place at that time and may not be perceived as a significant
issue to the buyer.
Assuming that a letter in support of the requested change is received from Ms. Nicholson
by the October 15 hearing, staff has no strong objection to this request for a larger
window size and reduced sill height.

Dear Sir:
This will advise you that after consideration and
advise from ou.r neighbor, we hereby re-submit our plans for
your consideration concerni.ng the size of windows in the bed-
room.
At your m�eting of September 8th, 1980, we were
asked to modify the plans due to one of our neighbor's com-
plaint. After you approved our plans, as amended, the same
evening our neighUor came over to our house to review the plans
thoroughly. When we explained to her that we had to make the
bedroom windows smaller because of her comments, she toJ.d us
that the ori.ginal size would look much better and would be more
pleasing to look at from her yard. She insisted on calling the
Planning's office the next day to see if the windows could be
restored to the original design. We were told that we sliould
re-submit the plans for your approval.
Enclosed herewith is a

CP Yost revieYred this requcst to a11ow a bedroom and bathroom addition at the second
floor level; the required variances a,�ere noted. Reference staff report dated'9/3/80;
Project Application & CEQA Assessr�ent accepted by,staff 8/27/80; aerial photograpf� of
the siie; site plans dated II/22/�0; garage detaii site plan dated 8/27/80; and cover
letter from F.M. Taurian dated August 22, 1980. Staff had no objection.to the granting
of the variance it the Commission deterr�ined that the legal requiremznts for a variance
had been r�e� satisfactorily. �
Pir_. and P-1rs. Phil Taurian, applicants, were present. Mr. Taurian stated that the pra-
posed addition ��ras being built to accomrodate his mother, r�aho was coming to live with
him. 4�hen asked by C. Jacobs aUout the parking of his personal autos, Mr. Taurian
er.plained that he ke�t one of his vehicles, a truc}:, parked on the street �ue to the
difficulty of getting it into his garage.
Chm. Sine opened the public hearing. There were no audience con�ments in favor.
Al�xandra Nicholson, owner of the adjacent hor�e at ?_715 Hillside Drive, s}�ake against
the application, stating ti�at the windows in the new second floor bedroom ��aould result
in a loss of privacy� and the 2B' f�eight would reduce afternoon sunlight. Acting secr•e-
tary Taylar then read letters in opposition from h1rs. En;ma Gorr*�an, 130II Alvarado Avenue,
Mr. and Mrs. t�1.M. Gullett, 1312 Alvarado Avenue, and P�1r. and h1rs. Aldo H. Fontana, 1331
Hillside Drive; their concerns were that an additional bedroom would allo��a another p�rson
to live in the home, ���hich could increase on-street parking on a narrow street and be an
inconvenience to nearby residents.
There were no further comments and the public hearing was closed.

Corr�nissioner discussion included: ti�e nature of the non-conformities involved and hoa�
the proposed structure r�ight be modified to protect the pr�vacy of the neighbors;�that
except for the exisi�ing non-conforming side setback and garage dimensions, the proposed
addition met all zon-ing requirements; modification of the size or location of the windoti,rs
facing Ms. tJicholson's home.
After further discussion, C. P�ink found that Mr. Taurian had shown hardship and excep-
tional circumstances, and the addition itself is consistent with code requirements; he then
moved to approve the application. There was no second and the motion died. There was a
five minute recess, �vhiie the applicant and staff discussed a modification of the plans
whi.ch would be consistent tvith the concerns expressed during the public hearing. A
revised arindo�v design was then presented to the Con,mission wt�ich reduced the size of the
two easterly bedroom windows to less than half that shown on the applicant's plans, and
raised the si11 level to 4'3" above the floor line (rather than.the proposPd 2'0").
C.. Mink then moved that the variance be yranted to Mr. Phil Taurian based on the modified
plans and the findinqs that the application now met the legal requirements for a variance
as specified by Code Chapter 25.54. C. Taylor seconded the moi;ion; motion approved 5-0
on ro11 call vote, C. Harvey absent. Appeal procedures tivere advised. '
