RECONIlVIENDATION:
The City Council should hold a public hearing and take action. Affirmative action should be by resolution
and should include findings. The reasons for any action should be clearly stated for the record. (Action
alternatives and criteria for required findings are included at the end of the staff report.)
Conditions approved by the Planning Commission:
1. that the tenant improvements for the snack shop shall be installed as shown on the plans date
stamped August 24, 1995, Site Plan and Floor Plan with at least two on-site parking stalls, one
designated for employees and one designated for snack shop customers;
2. that no alcoholic beverages shall be sold from the site or the snack azea;
3. that the hours of operation shall be from 7:00 AM to Midnight seven days per week and there shall
be 5 full time and 2 part time employees;
4 that the property owner shall be responsible for policing the site and adjacent sidewalks for litter
and that adequate trash receptacles shall be placed inside the building and around the site for use
by the customers; and
5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes
as amended by the City of Burlingame.
Planning Commission Action
At the meeting of September 26, 1995, the Planning Commission held a public hearing and voted 7-0 for
a special permit to allow the retail sale of snack foods and beverages (except alcoholic beverages) at the
existing gas station/car wash at 177 California Drive. In their action the commissioners noted that there
would be no change to the site other than to add the snack area within an existing structure, the waiting area
for people whose cars are being repaired would stay the same. The commission discussed the fact that in
another special permit for retail sales at a gas station the sale of alcoholic beverages had been prohibited.
It was equally appropriate to prohibit it here. A condition was amended to prohibit the sales of alcoholic
beverages from this snack area.
BACKGROUND:
Peter Lee, the applicant, is requesting a special use permit to allow retail sales of snack foods and beverages,
including beer, from his gas station/car wash at 177 California Drive, zoned C-2 Subarea D, the corner of

Howard Avenue and California Drive. No other uses aze being changed on the site; no structures are being
added. The applicant is proposing to remodel the interior of an existing 179 SF structure for display of the
snack and beverage items and to house the cashier. The snack area will be open the same hours as the gas
station/car wash, 7:00 a.m. to Midnight,7 days a week. There aze 5 full time and 2 part time employees
who work at this business; the addition of the snack area will not change this number.
T'he conversion of the 179 SF structure from storage to snack sales will require the addition of .4 of a
parldng space. There are presently two parking spaces on site designated for employee parking. Now these
are both designated for employee parking. If approved one of these could be designated for snack area
customers. The remaining employees park on the street. Presently the applicant notes that three of his
employees carpool to work.

ACTION ALTERNATIVES
1. City Council may vote in favor of an applicant�s request.
If the action is a variance, use permit, fence exception or
sign exception, the Council must make the findings as
required by the code. Findings must be particular to the
given property and request. Actions on use permits should
be by resolution. A majority of the Council members seated
during the publ3c hearing must agree in order to pass an
affirmative motion.
2• City Council may deny an applicant�s request. The reasons
for denial should be clearly stated for the record.
3• City Council may deny a request without prejudice. This
action should be used when the application made to the City
Council is not the same as that heard by the Planning
Commission; when a Planning Commission action has been
justifiably, with clear direction, denied without prejudice;
or when the proposed project raises questions or issues on
which the Council would like additional information or
additional design work before acting on a project:
Direction about additional information required to be given
to staff, applicant and Planning Commission should be made
very clear,• Council should also direct whether any
subsequent hearing should be before the Council or the
Planning Commission.
SPECIAL PERMIT FINDINGS
(1) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(2) the proposed use will be located and conducted in a manner
in accord with the Burlingame general plan and the purposes
of this title;
(3) the planning commission may impose such reasonable
conditions or restrictions as it deems necessary to secure
the purposes of this title and to assure operation of the
use in a manner compatible with t�he aesthetics, mass, bulk
and character of existing and potential uses on adjoining
properties in the general vicinity.

Reference staff report, 9/26/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning
Department comments, and noticing requirements. Five conditions were suggested for consideration.
Chm. Jacobs opened the public hearing. Mr. Lopez, 2395 So. Bascom, Campbell, was present representing the
applicant. There will be no changes other than to add the snack area, the waiting area will remain the same.
There were no further comments and the public hearing was closed.
C. Key moved approval of this special permit application, by resolution, with an addition to condition # 2 denying
the sale of alcoholic beverages. The amended conditions are as follows: 1) that the tenant improvements for the

Summary: The applicant, Peter Lee,is requesting a special use permit to allow retail sales of
snack foods and beverages from his gas station/car wash at the corner of Howard Avenue and
California Drive. No other uses are being changed on the site. The gas pumps and the car
wash will remain in place and in service.
The applicant is proposing a tenant improvement to the interior of the existing structure.
Presently the building houses men's and women's restrooms and an office/pay booth. This
proposal is to put the snacks and beverages inside the building along with the cashier. The
snacks and beverages will include such items as candy, sodas in a fountain and in bottles, coffee,
beer and cigarettes. The snack shop will be open 7 days per week from 7:00 a.m. to Midnight,
with 5 full time employees and 2 part-time employees. The number of employees working at the
site is not change because of the proposed snack bar use.
The existing structure is 179 SF and requires 1 pazking space on-site for the snack bar use.
There are two parking spaces on site designated employee parking. Two of the five full time
employees can park on site and the others find street parking. The applicant states in his
application materials that 3 of his employees carpool to work.

Staff Comments: The Chief Building Official commented in his August 28, 1995 memo that the
occupant load is insignificant and the restrooms shall meet all disabled access requirements.
Required Findings for a Special Permit:
In order to grant a Special Permit the Planning Commission must find that the following
conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to

property or improvements in the vicinity, and will not be detrimental to the public,
health, safety, general welfaze, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the
Burlingame general plan and the purposes of this title;

deems necessary to secure the purposes of this title and to assure operation of the use in
a manner compatible with the aesthetics, mass, bulk and character of existing and
potential uses on adjoining properties in the general vicinity.

CATEGORICAL EXEMPTION AND SPECIAL PERMIT
RFSOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
special permit for sale of food and bevera es at a�as station at 177 California Drive APN: 029-232-
160 ;_pronertv owner• Peter Lee 1480 Triumnh Court San 7ose, CA ; and
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
September 26 1995 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and categorical exemption
Section: 15301 - Existing Facilities, Class 1(a) , Interior or exterior alterations involving such things as
interior partitions, plumbing, and electrical conveniences is hereby approved.
2. Said special permit is approved subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Special Permit are as set forth in the minutes and recording of sa.id meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

3. that the hours of operation shall be from 7:00 AM to Midnight seven days per week and
5 full time and 2 part time employees:
4. that the property owner shall be responsible for policing the site and adjacent sidewalks
for litter and that adequate trash receptacles shall be placed inside the building and around
the site for use by the customers; and
5. that the project shall meet all the requirements of the Uniform Building and Uniform Fire
