200 CALIFORNIA DR�VE AND 1123 HOWARD AVENUE BY CUMNiINGS & CO.

Chairman Kindig advised that this sign proposal also had been continued
from the July 23 meeting. Mr. L. E. Goble of Cummings & Co. appeared
for Mr. Arata. i•Sr. Goble advised he had submitted new drawings as
per Commission request. ,
Chairman Kindig asked for audience reaction. Mr. Arnold Rodman of
905 Morrell, Burlingame commented that he believed the sign was 10
feet higher than existing signs in that location and that this should
not be allowed. Mr. Goble said that in order to see the sign that
height was necessary. The open hearing was then declared closed.
Commissioner Sine questioned the applicant with regard to the sizes
of the various signs General Motors has available to dealers and
the intent of Arata Pontiac with regard to the walls of the building
where there were existing signs. Mr. Goble advised the square footage
of available signs as 245, 137 and 92. He said the wall signs would
remain there, protruding ones would be removed. Commissioner Sine
objected to General Motors dictating as to what kind of sign they
would have in Burlingame, and said he would like these signs scaled
down still more. Chairman Kindig asked what kind of lighting would
be used and was advised it would be slim line lighting, plastic faces.
Commissioner Norberg thought the width of the base of the sign should
be cut down. Discussion about the sign support brought out that it
was a square, 10" x 10" solid type pole engineered by General riotors,
the space between the two actual supports was open, and that the
sign was within one foot of the property line.
Chairman Kindig asked City Planner Swan for comments. Mr. Swan stated
that this sign is diagonally across the street from The Bubble Machine
sign but it is twice as high. With this height and the proposed
intensity, it might be visible from Broadway. The Arata signs are
variance applications. The City Planner wished these signs were
smaller because they will set a precedent for Auto Row.
In further discussion Commissioner Mink said he was hesitant to put
signs higher than city street electroliers, thinking of these as sort
of a guideline. He also commented he thought Sign D was atrocious
for a C-1 district. Further discussion followed by the Commissioners
regarding the height of the sign and Co�r�nissioner Sine stated he would
like to appeal to Mr. Arata's civic pride, asking if he would cut
back to 30 feet. Mr. Arata said he had no objection if Mr. Goble
could work it out with i�he sign people. Discussion continued regarding
the size of the used car sign. City Planner Swan indicated that each
sign is a var�ance and City Attorney Karmel stated they are sign
variances under the sign laws and should be considered independently
with action being taken upon each sign.
Commissioner Mink commeni:ed that signs noted B and C were satisfactory
in his opinion. iie then moved that Sign A be approved contingent
upon the heigh� being no higher than street electroliers located on
the corner of California Drive and Howard Avenue. The motion was

seconded by Commissinner Cistulli and caY•ried on unanimous roll call
vote. Commissio:�er Sine moved that Sign B be approved as indicatF�d
on the Howard Street elevation, the motion was seconded and passel
on unanimous roll call vote. Commissioner Sine then made the motion
that Sign C as detailed be approved. This was seconded and passed
on unanimous roll call vote. Commissioner Sine moved that the sign
on Highland Avenue and iioward Avenue labeled Sign D be approved
contingent on it being no more than 2?. feet in height. This motion
was seconded and carried on �he following roll call vote:

City Planner Swan stated that if no sign appeal is made to City Council
within five days, this decision is valid.
City Engineer Marr arrived at �he meeting at 9:00 P.M, Chairman Kindig
declared a short recess at 9:02 P.M. after which the meeting reconvened.
3. VACATION OF EXISTING 10 FOOT GVIDE SANITARY SEWER EASEMEPJT ACROSS
LOTS l, 2, 3 AND 8 OF VI�WLAND ESTATES SUBDIVISION FOR FLORIN
RHOADS, 1530 LA MESA DRIV�
City Engineer Marr stated that this has been presented to the City
Council. City Attorney Karmel advised that the Planning Commission
must hear it ar.d make recommendation prior to the City Council hearing.
Mr. Florin Rhoads appeared at the hearing and explained that five
years ago he was granted a st.andard sewer easement across the back. �
This was in essence a private easement and didn't connect to the
newer easement which was deeded to the City. Mr. Rhoads was asking
the City to aband.on the live easement. Fie was proposing to use the
lower sanitary sewer easement rather than the top one. He stated it
was a ma�ter of formality. It has been worked out with the
Engineering Department and is legal. He was asking to present this
to the Planning Commission so legal formality can be accomplished.
Chairman Kindig asked for comments from City Engineer Marr who replie�
that Engineering has okayed the new sewer and installation of the
sewer is almost cemplete. The City Council may act to establish the
new sewer easement along tre rear of the lots and then the old one
can be abandoned. He stated that the Engineering Department has no
objection. City Attorney Karmel advised there are two ways of
abandoning an easement. One is just by Council action with no hearing
except that Council satisfies itself. The other cor_cerns an easement
that appears on a map and has never been used or hasn't been used
in a period of time (say, three years) prior to Council action. In
the case of a live easement, then Councii must proceed to the public
easement vacation law which requires recommendation by Planning
Commission and public hearing for City Council to adopt. He stated
the Council has done this and a hearing has been set for September 17.
City Attorney Karmel added that under the public easement vacation law
no order of the Council shall be made in an area until the proposed
vacation is submitted to and acted upon by the Planning Commission.
Obviously, the Planning Commission cannot vacate the easement, and
the nature of the Planning Commission action is a report to City
Council.

revised the ori��inal map and had prepare�i schematics and two additional
diagrams. These outlined changes since Lhe first document was
submitted. He gave the revisions to the Commission for their
inspection, and explained the detail of the chanc�es.
Mr. Howard Hickey told the Commission that in his opinion this parcel
map would accomplish three legal lats with the necessary frontage,
noting that in this R-1 area the lots wo�ild be used for the construction
of new homes rather than apartments or condominiums.
It was the opinion of the Cammissi.on that these revisions should be
studied before a vote raas taken on the map, and this application was
continued to the regular meeting in December, with consideration at
the December 10 study meeting. Mr. Hickey was asked to submit a
topographic map.
8. SIGN PERMIT FOR 40 SF POLE SIGN, 20 ��EET IN HEIGHT AT 123
CALIFORNIA DRIVE ZONED C-2 FOR ARATA PONTIAC.
Mr. Glen Crum was present as representative of Cummings and Company.
Also present was Mr. Phil Pinto, manager of Arata's boc�y shop facility
at 123 California Drive.
Mr. Crum addressed the Commi�sion, speaking to the permanence of tlze
facility and the need for the sign. He stated that the body shop
has be�n operating in that location for four years, the lease will
be renewed, and the facility definitely is permanent. As to the
need, the only sign is now a wall sign which addx-esses �raffic
traveling south on California. There is a need for identifieation �or
traffic going north, since the body shop is in between other businesses.
This �rill be a double-faced internally illumina�ed sign, no brighter
than other signs on the stre�t.
The Chairman reguested audience comment. There v�ras none, and �c�e
public hearing was declared closed.
Commissioner 5ine noted that Mr. Arata was not at the meeting
although his presence had been requested. Both Mr. Crum anG t�ir.
Pinto indicated they had been authorized by Mr. Arata to represent
him.
Commissioner Taylor questioned why the sign must be 40 SF when 32 SF
would be permitted without a sign permit. Mr. Crum replied that this
was a prefabricated sign. The 40 SF was a standard size and the
next size would be 16 Sk' which would be.only one half what the City
would actually permit. A 32 SF sign would be a special order.
Commissioner Sine thought action on this application should be
delayed because Mr. Arata was not present. Commissioner Cistulli
had personal knowledge that Dir. Arata was not able to attend, and
asked that the hearing continue.
In response to Commission questions, Mr. Crum indicated that he would
remove the wall sign if this permit were granted.
Commissioner Mink moved that the sign permit be granted Arata Pontiac
for sign specified in Exhibit A with the condition that all other

identification �igns be removed with the exception of traffic and
entrance and exit signs. Commissioner Cistulli seconded the moti�n
and it carried on unanimous roll call vote.
10. SPECIAL PERMIT FOR SMALL ANIMAL HOSPITAL AND ASSOCIATED OFFICES
IN C-2 DISTRICT AT 1101 JUANITA AVENUE (APN 026-092-010) FOR
G.E. FREY D.V.M. BY AGENT JOHN F. ROSS
Secretary Sine read letter of November 20, 1973 from Dr. G. E. Frey
transmitting plans and data, and stating this facility would operate
only as a small animal hospital and would not include boarding. Dr.
Frey went vn to note self-cleaning kennels and location of hospital
ward next to C�ilifornia Drive, lessening noise. He added the building
would be redecorated and landscaped.
Mr. John Ross addressed the Commission. He stated Dr. Frey was
present for any questions. Mr. Ross told the Commission he was
aware of several petitions against tha.s hospital in this neighborhaod,
and had talked to several people who had signed the petition. They
were under the impression this was a boarding kennel. He emphasized
that it definitely would not be, and repeated that the building would
be soundproofed, with the animals housed on the California Drive
side.
Secretary Sine read communications opposing this use from Alice L.
Anderson, 1124 Rhinette; and M. E. Carson, 1125 Lincoln Avenue. He
also noted receipt of petition oppo�ing containing 29 signatures, and
petition opposing containing 19 signatures. This latter petition
contained some duplication of names.
City Planner Swan told the Commission the plans were received on
November 20, which was inadequate time to post a negative declaration
wk�ich must be posted 10 days prior to hearing. He thought the

Juanita and is directly across the street from an R-1 District. He
thought this use was questionable for this area.
Commissioner Cistulli protest�d the number of applications which are
continued and questioned why this should b� on the agenda and noti.ced.
He suggested applications b� scheduled and noticed only when all
information is in.
The City Planner stated the Commission had in the study meeting
indicated this application be put on the agenda; and the City
regulations require that negative declaration be posted.
Commissioner Mink moved this application be continued to December 26.
Commxssioner Cistulli seconded and the motion carried by voice vote.
Mr. Ross suggested all applicants be informed of time schedule for
posting of negative declarations.
Chairman Kindig reviewed for audience benefit the fact that this would
be a hospital for injured animals and the wor'� would be done by
appointment only, with no boarding.
