James Hannay APN: 026-233-080 Designer: Pattison Sign Group Lot Area: 0.94 acres General Plan: Commercial, Service and Special Sales Zoning: C-2 Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15311 (a), which states that construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to on-premise signs, is exempt from environmental review. Project Description: The applicant is requesting a Sign Variance to exceed the maximum allowed height of a new freestanding monument sign at 1010 Cadillac Way, Zoned C-2. In the C-2 zoning district, one two-sided freestanding monument sign is permitted on a parcel frontage of at least 150 feet; the parcel frontage along Rollins Road is 206.59 feet and therefore is allowed to have one freestanding monument sign. The proposed monument sign would be located along the Rollins Road frontage, 15'-0" from the face of curb to the center of the sign (see Sign Location on sheet 1, date stamped December 23, 2009). The Engineering Division reviewed the proposed location of the monument sign with regards to impacts to vehicle site lines and had no comment. The finro-sided monument sign contains the wording `Audi' and the company logo, and its design is consistent with the architecture of the existing building. The proposed monument sign measures 40 SF per side (4'-0'/4 x 9'-10") where the code allows a maximum of 50 SF per side along Rollins Road (100 SF total area allowed). Planning staff would note that in order to promote monument signs in this district, two-sided monument signs are considered to be a single sign and in measuring total sign area and therefore only one side of the sign is included in the calculation. The proposed monument sign is 9'-10" tall where the code allows a maximum height of 8'-0" for monument signs along Rollins Road. Therefore, a Sign Variance is required to exceed the maximum allowed height of a freestanding monument sign. All existing signs on site will remain as part of this proposal. The sign code contains specific sign criteria for freestanding monument signs, and therefore they are reviewed independently from wall signs, projecting signs and awning signs. Sign Variance 1010 Cadillac Way Staff Comments: See attached comments from the Chief Building Official, City Engineer, City Arborist, Fire Marshal and NPDES Coordinator. Planning staff would note that because of the nature of the request for a Sign Variance to exceed the maximum allowed height of a monument sign by 1'-10", it was determined that this request could be brought to the Planning Commission directly as an action item. If the Commission feels there is a need for more study, this item may be continued with direction to the applicant. Required Findings for Sign Variance: In order to grant a Sign Variance relating to height, area, location or number of signs the Planning Commission must apply the following circumstances (Code Section 25.06.110 a-b): (a) any exception granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and the C-4 district in which the subject property is situated; and (b) because of special circumstances applicable to the subject property, including size, shape, topography, street frontage, location or surrounding land use; the size or height of the building on which the sign is to be located; the classification of the street or highway on which the sign is located or designed primarily to be viewed from, the strict application of zoning regulations is found to deprive subject property of the privileges enjoyed by other properties in the vicinity and under identical zone classification. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped December 23, 2009; 2. that the conditions of the Chief Building Official's January 5, 2010 memo, the City Engineer's January 11, 2010 memo, the City ArborisYs and Fire Marshal's January 4, 2010 memos, and the NPDES Coordinator's December 30, 2009 memo shall be met; and 3. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2007 Edition, as amended by the City of Burlingame. Towards this end Audi and Rector Motors have entered into reciprocal agreements which include advertising the Audi name and logo. An existing 9' 10" Audi freestanding sign was moved and made available to Rector Motors. The sign was selected for its high quality finish, compatibility with published sign criteria, and compatibility with the local traffic speed, approaches and surrounding architecture. Rector Motors is now committed to this signs use and no other will be made available. Subsequently it was discovered that the published sign criteria that was reviewed, was obsolete and then removed from public view. In order to proceed with the permitting of this sign today we are applying for a variance to the current sign criteria which would limit the height of the sign to 5.00'. The sign is highly finished of automobile grade materials and finishes. Architecturally the 9' 10" height is consistent with existing signage along Rollins Road and Broadway. In particular the sign will be very helpful for that traffic entering Rollins Road from Broadway to navigate successfully to the Audi Service/Sales area. JAMES HANNAY, APPLICANT AND PROPERTY OWNER) STAFF CONTACT: RUBEN HURIN Reference staff report dated January 25, 2010, with attachments. Senior Planner Hurin presented the report, reviewed criteria and staff comments. Three (3) conditions were suggested for consideration. Chair Terrones opened the public hearing. Richard Luchini, 1051 46th Avenue, Oakland; represented the appiicant. Commission comments: ■ Why the request for the additional height? (Luchini — this is an existing sign which was made available to Rector Motors in order to bring more business back to Burlingame. Part of the standard plan for Audi.) Public comments: ■ None There were no further comments and the public hearing was closed. Commissioner Yie moved to approve the application, by resolution, with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped December 23, 2009; 2. that the conditions of the Chief Building Official's January 5, 2010 memo, the City Engineer's January 11, 2010 memo, the City ArborisYs and Fire Marshal's January 4, 2010 memos, and the NPDES Coordinator's December 30, 2009 memo shall be met; and 3. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2007 Edition, as amended by the City of Burlingame. The motion was seconded by Commissioner Lindstrom. Discussion of motion: ■ Existing sign being made available; is essentially being recycled. • There is very little pedestrian traffic in the vicinity; there is a need to have a more significant presence due to the high level of vehicular traffic in the area.
