Requests for this project: The applicant, Oliveira Signs, is requesting a sign exception for area,
number and height of signs on the primary frontage (Rollins Road) and for area and number of signs
on the secondary frontage (Cadillac Way) for Rector Motor Car Company at 1010 Cadillac Way,
zoned C-2. A sign exception is not required for the Broadway frontage since no new additional signs
are proposed on this secondary frontage. The applicant is requesting the following:
1) Sign exception on the primary frontage (Rollins Road):
• 4 signs, where a maximum of 3 signs are allowed on the primary frontage (C. S. 22.16.050);
• 662 SF of sign area, where the code allows 150 SF (C. S. 22.16.020); and
• height of ground sign (14'-10" proposed, where 12' is allowed) (C.S. 22.38.020).
2) Sign exception on the secondary frontage (Cadillac Way):
• 6 signs, where a maximum of 3 signs are allowed on the secondary frontage (C.S. 22.16.050);
and
� 93 SF of sign area, where the code allows 50 SF (C.S. 22.16.030).
3) No new additional signage proposed on the Broadway frontage. Applicant will be removing one
of the two existing signs on the Broadway frontage. A sign exception was approved in October,
1988 for these two signs. A sign exception is not required on this frontage since no new
additional signs are being proposed.
History: There have been several sign exceptions approved on this property since 1988. The
approved and amended sign exception applications of September 12, 1994; April 27, 1992; April 8,
1991; October 24, 1988; and July 7, 1986 requires the applicant to apply for a sign exception for any

additional signs to be put on this site or changes in copy of signs on this site (September 12, 1994;

At the March 8, 1999 study meeting, the applicant proposed to remove all of the existing signs on
the Broadway frontage (two wall signs). Since then, Rector Motor Car Company has decided to
remove only one of the two e�sting signs on the Broadway frontage. The `Porsche' wall sign (6' x
12', 72 SF) will be removed and the `Audi' wall sign (6' x 12', 72 SF) will be retained. The staff
report has been revised to reflect this change.
Summary: The site contains a primary frontage (Rollins Road) and two secondary frontages
(Cadillac Way and Broadway). Currently, there are two existing signs on the primary frontage, five
signs on the secondary frontage facing Cadillac Way and two signs on the secondary frontage facing
Broadway (please refer to Table 1 for a description of the existing signage on the site). On the
primary frontage, there is one double-faced pole sign (10' tall x 32' long overall, 612 SF), 85' in
height. On the secondary frontage facing Cadillac Way, there are two double-faced projecting signs
(2' tall x 3'-6" long, 28 SF), and one awning sign (3' tall x 12' long, 36 SF). On the secondary
frontage facing Broadway, there are two wall signs (6' tall x 12' long each sign, 144 SF). The
applicant is proposing to remove one of these two signs on the Broadway frontage as part of this
application.
Proposed Signs on the Priniary Frontage:
The applicant is proposing to add a double-faced ground sign on the primary frontage (Rollins Road).
The proposed double-faced ground sign (5' tall x 5' long, 50 SF in area) would contain a Porsche logo
and measures 14'-10" in height above grade. A sign exception is required for the height of the
proposed ground sign (14'-10" proposed where 12' is the maximum allowed). Please refer to Table
2 for a description of the proposed signage on the site.
A sign exception is also required for the number and area of signs proposed on the primary frontage.
The total signage proposed on the primary frontage is four signs measuring 662 SF in area (3 signs,
150 SF allowed).
Proposed Signs on the Secondary Frontage (Cadillac Way):
The applicant is proposing to add a wall sign on the secondary frontage (Cadillac Way). The
proposed wall sign (7'-4" tall x 4' long, 29 SF in area) would contain a Porsche logo and word
`service' and measures 15' in height above grade. The total signage proposed on the secondary
frontage is six signs measuring 93 SF in area (3 signs, 50 SF allowed). A sign exception is required
for the number and area of signs proposed on the secondary frontage (6 signs, 93 SF proposed where
3 signs, 50 SF is the maximum allowed for signs on the secondary frontage).
Proposed Signs on tlae Seconrl�ry Frontage (Bronrlway):
There are no new signs proposed on the Broadway frontage. Planning staffwould note that a sign
exception was approved for the two existing signs on Broadway in October, 1988. The applicant
is proposing to remove one of two existing signs on the Broadway frontage as part of this application.
The e�cisting Porsche sign (6' x 12', 72 SF) will be removed and the Audi sign (6' x 12', 72 SF) will
be retained. The total signage on this secondary frontgage would be one 72 SF wall sign (3 signs,
50 SF allowed).

The project meets all other zoning code requirements.
Stafi Comments: The Chief Building Inspector in his memo dated February 10, 1999, notes that all
electric signs to be U.L. (or equivalent) listed. The City Engineer and Fire Marshall reviewed the
project and had no comments.
Study Questions:
At their meeting on March 8, 1999, the Planning Commission asked several questions regarding this
application (P.C. Minutes March 8, 1999). All three signs on Cadillac Way would be interiorly
illuminated from 6 p.m.-6 a.m. (8 p.m-6 a.m. during the summer). The applicant submitted a color
palette of the proposed ground sign on Rollins Road and the proposed sign on Cadillac Way. The
color palette also shows the ground sign above grade. The applicant also submitted color
photographs of the building.
The Planning Commission requested a letter from the applicant addressing the Broadway frontage
and why no signs are proposed for this frontage now and in the future. The applicant received a letter
from Rector Motor Company (letter dated March 10, 1999) indicating that only the Porsche sign will
be removed. The Audi sign will remain on the Broadway frontage. The staff report has been changed
to reflect this revision. The letter indicates that the Porsche sign on Broadway is being replaced by
the ground sign (Rollins Road) and wall sign (Cadillac Way) as mandated by Porsche as part of its
national facility identification program.

Sign Exception 1010 Cadillac Way
Required Findings for Sign Exception: In order to grant a Sign Exception relating to height, area,
location or number of signs the Planning Commission must apply the following circumstances (Code
Section 25.06.110 a-b):
(a) any exception granted shall be subject to such conditions as will assure that the adjustment
thereby authorized shall not constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and the district in which the subject property
is situate; and
(b) because of special circumstances applicable to the subject property, including size, shape,
topography, street frontage, location or surrounding land use; the size or height of the
building on which the sign is to be located; the classification of the street or highway on which
the sign is located or designed primarily to be viewed from, the strict application of zoning
regulations is found to deprive subject property of the privileges enjoyed by other properties
in the vicinity and under identical zone classification.
Planning Commission Action: The Planning Commission should hold a public hearing. �rmative
action should be taken by resolution. The reasons for any action should be clearly stated. At the
public hearing the following conditions should be considered:

1. that the signs sha11 be installed as shown on the plans submitted to the Planning Department and
date stamped February l, 1999 (11" x 17" Site Plan, Cadillac Way Building Elevation, Ground
Sign Elevation, and Ground Sign Installation) and March 12, 1999 (8'h" x 11 ") Ground Sign and
Wall Sign Elevations);
2. that the applicant sha11 apply for a sign exception for any additional signs to be put on this site or
any changes in copy on these signs prior to installation of the sign or change in copy;
3. that the `Porsche' wall sign (6 'x 12', 72 SF) shown on the site plan (sign G) date stamped
February 1, 1999, on the Broadway frontage shall be removed prior to installation of the new
signs on Rollins Road and Cadillac Way;
4. that the conditions of the Chief Building Of�icial's February 10, 1999 memo shall be met; and
5. that the project shall meet all the requirements of the municipal code and of the 1995 edition
California Building and Fire Codes as amended by the City of Burlingame.

discussed the request, reviewed criteria, Planning Department
comments, and study meeting questions. Three conditions were
suggested for consideration.
Chm. Galligan opened the public hearing. Steve Buckner, 169
Medford Avenue, Hayward, representing Economy Sign Company was
present. There were no further comments and the public hearing
was closed.
C. Jacobs noted this sign will probably become a landmark, she then
moved approval of this application, by resolution, with the
following conditions: 1) that the project shall be built as shown
on the plans submitted to the Planning Department and date stamped
August 11, 1994 Elevation Layout (11" X 17") and Section (82" X
il") and the maximum size of the 'Oldsmobile/Porsche' copy portion
of the pole sign shall be 190 SF; 2) that the applicant shall apply
for a sign exception for any additional signs to be put on this
site or any changes in copy on these signs prior to installation of
the sign or change in copy; and 3) that the project shall meet all
Uniform Building and Uniform Fire Code requirements as amended by
the City.
Motion was seconded by C. Mink and passed on a 7-0 voice vote.
Appeal procedures were advised.
In discussion Commissioners noted that this sign is unique due to
its height and the fact it revolves and the sign exception was
required because the applicant had agreed to it years ago; however
future reviews should consider this as a nonconforming sign on
which the copy is being changed.

Arrow Sign Company explained the glowcube to be used for the
readerboard; the cube is pigmented, not painted; the"�sign is not
illuminated from within; the glowcube display wil.l"fbe indirectly
illuminated by lamps focused back on the sign fac'e for night time
visibility, no illumination is required durinq daylight hours.
There were no audience comments and the public�hearing was closed.
C. Graham stated she had no problems with this application, it will not
be a grant of special privilege for this property, it is a standard
sign application similar to those approved for other automobile
dealers. C. Graham moved for approval of the sign exception and master
signage program by resolution with .the following conditions: (1) that
the project shall be built as shown on the plans submitted to the
Planning Department and date staaiped March 11, 1992 Section, Elevation
and Plot Plan; (2) that the double faced readerboard sign shall have a
maximum height of 26'-0" and.�heither face shall be larger than 164 SF
and the Jeep-Eagle double f�aced sign shall be 150 SF per face with a
maximum height of 35'-q"; (3) that the conditions of the City
Engineer's March 16, 1992 memo (all signs and parts of signs are to be
placed within the property lines and not in the public right-of-way
�which is 10' from the face of the curb on Rollins Road to the property
line) shall be met;�(4) that the message on �he readerboard sign shall
change copy at a maximum frequency of every five minutes; (5) that no
off-premise products or services shall be advertised by any signs on
� this property; -� ( 6) that the proj ect shall meet Uniform Building and
Uniform Fire;Codes as amended by the City of Burlingame; and (7) that
prior to receiving a building permit from the City of Burlingame the
applicant;shall apply for and receive a permit from CalTrans Outdoor
Advertis�ng Branch in Sacramento approving installation of all signage
on the;�ites requiring CalTrans review.

12. SIGN EXCEPTION FOR CHANGE OF COPY ON AN EXISTING POLE SIGN AT 1010
CADILLAC WAY, ZONED C-2
Reference staff report, 4/27/92, with attachments. CP Monroe reviewed
details of the request, staff review, comments on the application form,
required findings. Three conditions were suggested for consideration
at the public hearing. .
Chm. Kelly opened the public hearing. Vern Erickson, Economy Signs,
Inc., representing the property owner, James Hannay, was present.
There were no audience comments and the public hearing was closed.

�PUBLIC HEARING — APPEAL OF DBNIAL OF SIGN EXCEPTION AMENDMENT FOR
RECTOR CADILLAC AT 1010 CADILLAC WAY
City Planner reviewed her memo of June 27 in which she recommended
council hold a public hearing and take action. Rector Cadillac has
applied for an amendment to a previously granted sign exception. The
request is to add three signs to the frontage on Rollins (total of
seven signs proposed, two are permitted), one sign on the secondary
frontage of Cadillac Way (total of three signs proposed, two
permitted), and addition of two signs and an extension to a third sign
on the secondary frontage on Broadway (total of four signs, two
permitted). This item came before the Planning Commission as an
enforcement item and was denied without prejudice at the meeting of
June 9.
Mayor Mangini opened the public hearing.
Edwin James Hannay, owner of Rector Cadillac, reviewed that he was
unaware that the signs were installed without permits, believed that
signs are needed, he has made many improvements to the site and hoped
for council approval.
Mayor Mangini closed the public hearing.
Councilman Lembi questioned the need for the vertical signs on the
large pole. Councilman Pagliaro asked if Hannay would be willing to
remove these vertical signs saying "Rector" and "Rector Motor Company"
if council granted other signs. Hannay replied yes. Councilwoman
Barton thought the site would benefit from an overall coordinated sign
program.
Councilman Lembi moved to reverse the Planning Commission and approve
the sign exception amendment with conditions suggested in staff report
and additional condition that the vertical signs on pole be removed.
Seconded by Councilman Pagliaro. Motion carried 3-2 on roll call
vote, Councilwoman Barton and Mayor Mangini voting no.

on this alleged conflict by the next meeting.
Councilman Pagliaro also acknowledged a packet received from Sequoias
regarding a change in plans. He thought that if the project has been
revised it should go back to the Planning Commission, but if it is an
alternative then the council might review it.
David Carr, attorney representing Sequoias, stated the developers are
willing to accept additional conditions reducing height of structure
from 150.5 feet to 90 feet with resulting reduction in number of
residents, traffic and parking. He said this is a mitigation that was
in the EIR and that Planning Commission has seen. He asked if council
wishes Planning Commission to review the change it direct the
commission to hear at its next meeting. Staff reviewed noticing
requirements and the commission could not review before end of July.
Cnuncil noted the public expects the project to be reviewed by council
nor+. It can decide at its next meeting whether the Planning
Commission should also review. Council requested press aid in
notifying public about this proposed change to the project, Hearing
was scheduled for July 21 meeting.
COMMISSION VACANCIES
Mayor Mangini also noted that the press could announce that the city
has vacancies in the Library Board and the Traffic, Safety and Parking
Commission.
PUBLIC HEARING — REVIEW OF SPECIAL USE PERMIT FOR CAR RENTAL AGENCY
AT 1299 BAYSHORE HIGHWAY
City Planner reviewed her memo of June 26 in which she recommended
council hold public hearing and take action. The applicant, Dennis
Kay, is requesting a special use permit to operate Ugly Duckling Rent—
A—Car from 600 square feet of office area at 1299 Bayshore. 'The
project proposes to designate 10 on site parking spaces for the car
rental use. The applicant will employ 2.5 persons and operate six
days a week from 7 a.m. to 6 p.m. The rental fleet will be 20 cars,
employees will use fleet vehicles and pick up customers in these
vehicles. There is another car rental permit at this site, although
it is not currently active, which has 25 designated parking spaces.
With the relocation of the north bound freeway on ramp, access to this
site will become more difficult.
Councilman Pagliaro confirmed that they are requesting more parking
than is available on the site due to other uses.
Mayor Mangini opened the public hearing.
Dennis Kay, applicant, reviewed that the car rental agency at the site
with the current permit has not been operating for six months. He
plans to start operation with ten cars and add two a month until he
reaches maximum number of 20 cars.
Mayor Mangini closed the public hearing.
Councilman Amstrup noted he had called this up for review because the
building in in such a poor location. Councilwoman Barton said that if
the other car rental operation becomes active they would be short of
parking. Councilman Lembi wondered if city could find out if the
other was actually out of business.
Councilman Amstrup moved to reverse the Planning Commission and deny
the permit. Seconded by Councilwoman Barton, carried unanimously by
roll call vote.

WHEREAS, a categorical exemption has been proposed and application has been made

WHEREAS, said matters were heard by the Planning Commission of the City of
Burlingame on March 22, 1999, at which time it reviewed and considered the staff report and
all other written materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and Categorical Exemption per Article 19 Section: 15311 - Accessory
Structures, Class 11, construction or placement of minor structures accessory (appurtenant to)
existing commercial, industrial, or institutional facilities, including but not limited to (a) on-
premise signs is hereby approved.
2. Said sign exception is approved, subject to the conditions set forth in Exhibit
"A" attached hereto. Findings for such sign exception is as set forth in the minutes and
recording of said meeting.

Conditions of approval categorical exemption and sign exception
1010 CADILLAC WAY
effective APRIL 5, 1999
that the signs shall be installed as shown on the plans submitted to the Planning
Department and date stamped February 1, 1999 (11" x 17" Site Plan, Cadillac Way
Building Elevation, Ground Sign Elevation, and Ground Sign Installation) and March 12,
1999 (8'/z" x 11 ") Ground Sign and Wall Sign Elevations);
2. that the applicant shall apply for a sign exception for any additional signs to be put on this
site or any changes in copy on these signs prior to installation of the sign or change in
copy;
tkiat the `Porsche' wall sign (6 'x 12', 72 SF) shown on the site plan (sign G) date stamped
February l, 1999, on the Broadway frontage shall be removed prior to installation of the
new signs on Rollins Road and Cadillac Way;
4. that the conditions of the Chief Building Official's February 10, 1999 memo shall be met;
and
that the project shall meet all the requirements of the municipal code and of the 1995
edition California Building and Fire Codes as amended by the City of Burlingame.

by C. Coffey.
Comment on the motion: would like to add a condition that all future signs on this site have the
same black and white color scheme. C. Luzuriaga maker of the motion and C. Coffey second,
agreed to amendment.
Further comment: generally in favor, agree with idea that this blade sign is over two times the
size of that on Banana Republic, this is going to be quite large and dominate avenue, prefer two
smaller blade signs; would be comfortable if this blade sign was the same size as Banana
Republic, put one or 2 signs or comeback. Maker of the motion and second did not agree to
this amendment.
C. Bojues moved to amend the original motion to provide a blade sign of the same size and
shape as on Banana Republic, for the applicant to revise the sign application and its request, to
continue this item as revised to the consent calendar for action on April 12, 1999. The motion
was seconded by C. Key.
Chairman Deal called for a voice vote on the amended motion to continue this item to the
consent calendar for the meeting of April 12, 1999. The motion passed on a voice vote. There
was no action on the sign exception and the item was continued to the meeting of April 12,
1999.

Reference staff report, 3.22.99, with attachments. City Planner and Commission discussed,
reviewed criteria and Planning Department comments. Five conditions were suggested for
consideration. Commission asked the maximum height of a monument and pole sign;

C. Deal opened the public hearing. Anna de Olivera, and Ferdinand de Olivera, Olivera Signs,
290 So. Jefferson Street, Dixon, representing the applicant explained that the term pylon sign
and a pole sign should be interpreted as the same. City Planner clarified that a pole sign has
to be free standing and have 10' ground clearance between the ground and the bottom of the
sign. There were no further comments and the public hearing was closed.
Commission discussion: the four lit signs on Cadillac Way that are perpendicular to the street
do not give off much light, but the lit Porsche sign facing the street should be limited to the
hours of 11:00 p.m. to 6:00 a.m. because of the Northpark Apartments across the street; could
turn them off at 10:00 p.m. since this is the service entrance.

C. Bojues agreed the signs are nicely done and do not need illumination all night, he then so
moved approval, by resolution, with the conditions in the staff report amending the time of
illumination, as follows: 1) that the signs shall be installed as shown on the plans submitted to
the Planning Department and date stamped February 1, 1999 (11" x 17" Site Plan, Cadillac Way
Building Elevation, Ground Sign Elevation, and Ground Sign Installation); and the signs shall
only be illuminated from 7:00 a.m. to 10:00 p.m.; and March 12, 1999 (8'/z" x 11") Ground
Sign and Wall Sign Elevations); 2) that the applicant shall apply for a sign exception for any
additional signs to be put on this site or any changes in copy on these signs prior to installation
of the sign or change in copy; 3) that the `Porsche' wall sign (6 'x 12', 72 SF) shown on the
site plan (sign G) date stamped February 1, 1999, on the Broadway frontage shall be removed
prior to installation of the new signs on Rollins Road and Cadillac Way; 4) that the conditions
of the Chief Building Official's February 10, 1999 memo shall be met; and 5) that the project
shall meet all the requirements of the municipal code and of the 1995 edition California Building
and Fire Codes as amended by the City of Burlingame.

Discussion on the motion: could the wall sign be moved from 14' to 12', this is auto row, need
exposure from 101, would support 14' height because of increase in sales. There were no
further comments.
Chairman Deal called for the vote on the motion to approve with hours of illumination on
Cadillac Way at 10:00 p.m. to 7:00 a.m.. The motion passed on a 7-0 voice vote. Appeal
procedures were advised.

reviewed criteria and Planning Department comments. Seven conditions were suggested for
consideration.
C. Deal opened the public hearing. Mike Roach, 184 Harbor Way, So. San Francisco,
explained there would be no change in the footprint of the hotel. At the present time the parking
lot is underused and 50% of the customers are bussed to the site via shuttle. Occupancy was
76% last year.
C. Coffey noted the change from meeting room to guest rooms would lower the potential
parking demand to a lesser figure and noted that there would therefore be no negative impact
on the surrounding property owners and there is adequate capacity shown on the traffic analyzer
to accommodate this small increase in rooms, he then moved approval of this application, by
